SAN DIEGO (CNS) - A jury awarded million Friday to the widow of a retired San Diego Police Department criminalist who committed suicide after he was accused of a 1984 murder.The attorneys alleged the investigation was begun improperly by San Diego police homicide detectives, driving her husband to suicide.The verdict was the result of a federal lawsuit alleging wrongful death and civil rights violations filed by Kevin Brown's widow, Rebecca, against the city of San Diego and its police department. Jurors are due back in court Tuesday to consider punitive damages.Brown, 62, was suspected in the murder of Claire Hough, who was strangled and found dead at Torrey Pines State Beach in 1984. Brown hanged himself at Cuyamaca Rancho State Park in October of 2014, which his lawyers said was a result of the homicide investigation, as well as the seizure of numerous items of sentimental value from his Chula Vista home.Rebecca Brown's attorneys alleged now-retired SDPD Detective Michael Lambert misled a judge when securing an affidavit for a warrant to search and seize property at Brown's home. The affidavit was secured on the basis of Brown's sperm cells, which were found on a vaginal swab of Hough, though Rebecca Brown's attorney, Eugene Iredale, said those cells were most likely transferred onto the swab via accidental cross-contamination.Iredale told jurors that lab techs at the SDPD crime lab often used their own semen as reference samples when conducting testing for the presence of semen.Other DNA evidence found on Hough's clothing pointed to another suspect, Ronald Tatro, who was previously convicted in several other rapes and assaults on women. Tatro, who died in 2011, was matched to several blood stains and a pubic hair found on the girl's clothing, Iredale said.Despite Tatro's DNA being far more prominent on the swab, Iredale said Lambert used Brown's sperm cells and evidence that Brown had frequented strip clubs in the 1980s to suggest he worked in concert with Tatro in the killing.However, no such connection between the men was ever discovered, nor was Brown ever connected to the murder.Brown, who suffered from anxiety and depression, was "obsessed with getting his property back," Iredale said, yet was unable to secure their return over the course of several months.Iredale said the prospect of spending time in jail while fighting to clear his name and the property seizure was enough to push Brown to suicide.The attorney said Lambert was aware Brown was suicidal and held onto his property "because he knew it would cause pain and hurt, because he felt he was going to break him down, he was going to crack the case."Deputy City Attorney Catherine Richardson argued at trial that Lambert relied upon DNA experts when he wrote the affidavit and was not given all the information he needed.The attorney said Lambert asked about contamination when presented with the evidence of Brown's DNA, but was told by his sergeant that contamination was not possible. She also said Lambert was not informed that SDPD lab techs sometimes used their own semen for testing until months after the search warrant was secured.Richardson said the items from Brown's home had to be seized in order to prove or disprove a possible connection between Tatro and Brown, which would have dated back more than three decades, and that a rigid investigation was needed to prove there was no favoritism toward an SDPD employee."If he hadn't investigated (Brown), then the police would have been accused of covering up for one of their own," Richardson told the jury in her opening statement. 3615

SAN DIEGO (CNS) - A motorist who fled a traffic stop in Encanto Tuesday led officers on a 40-minute pursuit that ended with his arrest near Lake Hodges, authorities reported.The man refused to yield when San Diego police tried to pull him over for a traffic violation in the 6800 block of Akins Avenue shortly after 9 a.m., SDPD public-affairs Officer Michael Stirk said.The motorist drove off to the east toward Spring Valley, then entered state Route 125 and headed north, Stirk said.Reaching Santee, the man entered SR-52 and headed west, then merged onto northbound Interstate 15 when he got to the Miramar area.While passing through northern San Diego with SDPD and California Highway Patrol personnel tailing him and tracking his pursuit aboard a police helicopter, the driver managed to avoid running over several spike strips that CHP officers hurled onto the roadway in his path.After entering Escondido, however, the man finally pulled to a stop on the side of the freeway near Ninth Avenue and was taken into custody without further incident about 9:45 a.m., Stirk said.The arrestee's name was not immediately available. 1139

SAN DIEGO (CNS) - An Arizona man who carried out a series of knifepoint rapes in the city of San Diego 24 years ago, as well as two rapes in Riverside County in 2002 and 2004, was sentenced Thursday to 50 years to life in prison.Christopher Vanbuskirk, 47, of Goodyear, pleaded guilty last year to six rape counts for attacking the women on four occasions between August and November of 1995 in San Diego, as well as two women in the Coachella Valley area of Riverside County in March 2002 and November 2004.Prosecutors said the four San Diego cases occurred twice in the Tierrasanta neighborhood, once in Pacific Beach and once near San Diego Mesa College. SAN DIEGO (CNS) - A San Diego man who mailed more than four pounds of pure methamphetamine to Guam inside stuffed animals and had more than 500 counterfeit credit cards in his possession was sentenced to 15 years in federal prison, the U.S. Attorney's Office announced Thursday.Daniel Wayne Gorman, 33, pleaded guilty to sending four packages from a Jamul post office in 2016, each containing a stuffed animal filled with methamphetamine, according to the U.S. Attorney's Office.The packages were mailed under the alias "Daniel German" and were intercepted in Barrigada, Guam, prosecutors said.He was sentenced Monday to 10 years for his plea to distribution of methamphetamine and five years for possession of counterfeit access devices stemming from fake credit cards and driver's licenses discovered at his home during a 2018 police search.Investigators found more than 500 counterfeit cards, along with "multiple fake Florida driver's licenses bearing the defendant's photograph but the personal identifying information of others," according to the U.S. Attorney's Office.Many of the credit cards also bore the names of real individuals who were not Gorman, prosecutors said. 1187

SAN DIEGO (CNS) - A San Diego judge's ruling today clears the way for the proposed Plaza de Panama project in Balboa Park to proceed.San Diego Superior Court Judge Gregory W. Pollack ruled both the project's proposed bond funding mechanism and an agreement of cooperation with the Plaza de Panama Committee to be legal, allowing the city to proceed with the plan to reduce traffic congestion in the park, according to the city attorney's office.San Diegans for Open Government argued that the city should have allowed voters to decide whether the city should rely on million in bonds to help fund the project.The City Council approved the project by a 7-1 vote in 2012, but six years of challenges and litigation stalled its implementation.The project will limit vehicle access and improve parking in order to restore the Plaza de California and Plaza de Panama as dedicated pedestrian areas."Balboa Park truly is the jewel of San Diego, and I am excited that the city can finally move forward with its plans to revitalize the Park for the enjoyment of San Diegans and tourists alike," City Attorney Mara W.
