(KGTV) - Two North County bars have voluntarily closed down because of positive COVID tests.Last Friday, Kate Dionisio went to dinner with her husband at Masters Kitchen and Cocktail."We had dinner and one drink, and stayed about an hour," said Dionisio.A week later, Dinoisio, who has an underlying health condition, says the night of celebration has sparked anxiety."Panic. Scary. We've been so careful with masks and taking precautions, but this felt out of my control," said Dionisio.On Thursday, on the bar's Facebook page, a message announced a recent positive coronavirus test and a voluntary closure for two weeks to best ensure everyone's "health and safety." The bar's owner says an employee was tested on Monday, with the positive result coming on Wednesday. The next day, the same day of the Masters post on Facebook, there was a similar message put up by Mission Avenue Bar and Grill, just a few blocks away. In this case, two employees tested positive. Their post stressed that safety is "our highest priority." It also promised a sanitization by a professional cleaning company. Their reopening date is to be determined, only after every returning staff member has tested negative. The owner of Masters Kitchen and Cocktail says there is no overlap in staff between the bars, but in their industry in Oceanside, "everyone knows everyone."The two bars are just a handful of local bars and restaurants to disclose positive COVID-19 tests. On their Facebook pages, customers weighed in and many lauded the transparency."It shows they respect their customers and care about the community," said Dionisio.In the end, Dionisio contacted the bar and found out the employee wasn't working the night she was there. 1746

(KGTV) — Defense attorneys for 15 Marines accused of human smuggling said they hope the judge dismisses the case.The attorneys argued that the Commander illegally used his power to discipline the Marines publicly, and therefore influenced the outcome of the case.It was a very public display of discipline.Fifteen Camp Pendleton Marines were cuffed and taken away by NCIS agents in front of an 800-person battalion formation in July. They were accused of human smuggling and conspiracy.But now, attorneys representing a few of the accused Marines said the public arrests violated their rights. Now, they are filing what's called an "undue command influence" motion against the Battalion Commander who led the formation."Anytime you have a Commander who is in a position of leadership who potentially affects a subordinate's rights to a fair trial, that can be viewed as potential 'undue command influence,'" military attorney Gary Barthel explained. "This motion for 'undue command influence' was made against the Battalion Commander for making comments and parading the 15 individuals out for what was supposed to be a recognition, and they were ultimately arrested." Barthel is a former legal advisor to Camp Pendleton's Commanding General. He said a Commanding Officer's job is to maintain good order and discipline their command. But in military law, they also wear the prosecutor and jury selector hats."Those two hats can clash," Barthel said. "That's why it's important for Commanding Officers to be careful what they say with regard to their views of the military justice system, or their views of a particular individual who has been accused of an offense."The defense team said the Commander used his power to influence the outcome of the case unfairly. But Barthel said in his experience with 'undue command influence' cases, he believes the military has likely already taken the Commander in question off the case."You can take the individual that allegedly made the statements involved out of the process, and that keeps the process fair and impartial," Barthel said. OCEANSIDE, Calif (KGTV) -- A pedestrian was struck and killed by a semi-truck on Interstate 5 near Mission Avenue early Thursday morning.According to California Highway Patrol, the pedestrian was standing in the middle of the southbound lanes around 2:30 a.m. when they were hit. Deputies say the victim was killed instantly.The semi-truck driver did stay at the scene.Deputies are investigating why the victim was in the middle of the freeway. 452

(KGTV) — Firefighters battled a fire at a North County residence Saturday.The 3-alarm blaze was reported in the 1400 block of Division Street just after 2:30 p.m., according to an Oceanside Fire Battalion Chief. It took fire crews an hour to get the upper hand in the firefight, due to the wind and lack of resources, according to fire officials.Three people were injured. Two people were transported to UCSD hospital for burn injuries. One man was burned on the arm, according to his father, Alfredo Muruato. Muruato said his son and his daughter-in-law were asleep when the fire started and were awoken by the dog.Another resident, Carla Vega, described the harrowing ordeal. She said she was in the shower when she heard a loud boom, "I peeked out my head and smelled fire so I got out of the shower... I just saw a bunch of smoke everybody running." She said everyone was panicked. When she returned to remove her things, she said everyone was going to have to find another place to live. "Everything is replaceable, it is materialistic, my life is not materialistic, that’s what matters, I got myself out, my dog," Vega said.The Red Cross is assisting more than 30 people were displaced in the fire.The cause of the fire is still under investigation.
