SAN DIEGO (KGTV) -- A Hazardous Materials Team is investigating a Rancho Bernardo residence following reports of a possible fentanyl overdose death at the home Thursday morning.Crews responded at around 4 a.m. to calls of an overdose at a residence at 11300 Calenda Road located a few blocks from Westwood Elementary School.First responders discovered an unconscious 27-year-old male. The victim was declared deceased at the scene, according to San Diego County Sheriff's Office officials. Neighbors told 10News the man lived at the home with his parents.While at the scene, our 10News crew saw a woman being escorted out of the house and placed in an ambulance. It’s still unclear how she’s involved.The San Diego County Medical Examiner will identify the man and confirm his cause of death. 800

According to the San Diego Police Department, Jose Corona went missing from the Jamacha-Lomita neighborhood at some point during the day Saturday, but was located Sunday. Authorities were concerned because they say Corona suffers from dementia and a traumatic brain injury. 376

SAN DIEGO (KGTV) - A lawsuit was filed on Monday in San Diego County Superior Court against the County of San Diego, Registrar of Voters and other entities related to the ongoing battle over the future of the Julian volunteer fire department. Attorney and mayoral candidate Cory Briggs filed the suit and told 10News that the claim is that a group of former volunteer fire department board members made the decision to dissolve the department in secret meetings, and the County allegedly let it happen. For the past two years, locals have been in a contentious battle over the future of San Diego County's last all-volunteer fire department. Many residents believe the County should take over the department because it has more resources and money.Opponents don't trust the County and think that the department's volunteers can do a better job on their own. This morning, an independent regulatory agency conducted a final vote in favor of dissolving the department. A hearing on this new lawsuit is scheduled for Wednesday morning. 1041

SAN DIEGO (KGTV) - A new report reveals water usage continues to climb quickly since state water restrictions were lifted in 2016. Romy Meraz finds joy in watering her yard at her home in Bonita."I know the plants are happy and I'm happy for them," said Meraz.It was a different story amid the state-mandated restrictions, when she cut her watering to once a week. Years later, she'll be watering four or five times a week this summer."I want my garden to be beautiful and green," said Meraz.Meraz isn't alone. According to a report from the research group Equinox Project, The Nonprofit Institute at University of San Diego, the average daily water consumption increased from 84 gallons per person to 91 gallons per person.That's an increase of 8.3 percent. It's still shy of the 119 gallons per day in 2007, but the usage has been steadily going up since restrictions were lifted."Even with the rains, with climate change ... we know another drought will come along so we need to be prepared. We've done it in the past. It's not a matter of whether we can do it. We can," said Nilmini Silva-Send, a researcher with the Equinox Project.When it comes to the biggest daily water users, the Santa Fe Irrigation District is tops at 363 gallons per person, followed by the Rainbow Municipal Water District and Valley Center Municipal Water District. SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544
