DENVER (AP) — A Colorado police officer will not face charges for fatally shooting a homeowner who had just killed an intruder inside his suburban Denver home, prosecutors said in a letter released Monday.Adams County District Attorney Dave Young described Richard "Gary" Black's death as a "harrowing tragedy" but said his role was to determine whether the Aurora Police officer who shot the 73-year-old Vietnam War veteran was justified in using deadly force.Based on witness interviews and more than 90 videos captured by officers' body cameras, Young said Officer Drew Limbaugh did not know who Black was and fired when the homeowner refused police commands to drop his handgun.Young said Limbaugh's belief was reasonable and prosecutors cannot prove that the officer was not justified in firing. He said there also is no evidence that Limbaugh was reckless or criminally negligent."Officer Limbaugh engaged in conduct that was consciously focused on minimizing the risk to public safety," Young wrote.At the time of the shooting, Young said police did not know that Black had woken after midnight to investigate banging sounds and soon heard his 11-year-old grandson screaming as an intruder attacked him inside the bathroom. Police also did not know that the intruder, later identified as Dajon Harper, was lying on the bathroom floor after being shot twice by Black, he said."The evaluation of Officer Limbaugh's reasonable belief must be based not upon what we now know, but the circumstances as he perceived them at the time: hearing gunshots and then seeing an armed man emerge from a back room who refused commands to drop the weapon," Young wrote.The witnesses and police officers interviewed by investigators paint a chaotic scene. Young said police arriving at the home in Aurora around 1:30 a.m. on July 30 had little information and no description of a suspect.Within seconds, he said police heard gunshots inside the house and saw Black come into the hallway holding a handgun in one hand and a flashlight in the other. Young said the body camera footage shows police repeatedly told Black to drop his weapon before he came toward officers, raising the flashlight, and Limbaugh fired three times.Police have said Black had hearing impairment due to his military service. Young wrote that Black may not have heard the commands or recognized the officers as police but said that does not change Limbaugh's "reasonable belief that Mr. Black presented a threat."Witnesses told police that Harper was at a party at a family member's home nearby and may have been using drugs. Early that morning, he ran away and apparently broke down the Black family's front door.Black's grandson told police he woke up after feeling a cold breeze. He described walking toward his father's bedroom but then seeing a stranger showering as he passed the open bathroom door.The boy said the man grabbed him, locked the bathroom door and was strangling him before his father and grandfather were able to get inside the room.Harper, who was 26, died after being shot twice in the chest by Black. DEL MAR (CNS) - Two horses had to be taken by van from the track at Del Mar Racetrack Friday but both are expected to recover.The 5-year-old mare Magnolia's Hope was vanned off after being eased in the stretch of the fourth race, a 6 1/2-furlong claiming race on the dirt track for fillies and mares 3 years old and up which have never won two races."Though it is never good to be given a van ride, this does not appear to be a case of a life-threatening injury," Mac McBride, the Del Mar Thoroughbred Club's director of media, told City News Service. "We should know more about her condition tomorrow."Magnolia's Hope was fourth at the start of the race, took the lead a quarter-mile into the race and dropped to fourth in the field of seven through a half-mile.Magnolia's Hope has one victory in nine career starts, along with two second-place finishes and one third-place finish. She has earned ,260 in her career.The 4-year-old filly Velvet Queen also was vanned off after finishing third in the eighth race, a mile race on the dirt track for fillies and mares 3 years old and up which have never won ,000 once other than maiden. (KGTV) — One person died in a fire that destroyed two trailers and a garage in the unincorporated Escondido area on Saturday.The fire was reported just after 2:30 p.m. in the 9800 block of Rocky Ridge Road at Sage Glen Trail in Deer Springs, according to CAL FIRE San Diego.San Diego Sheriff's deputies arrived at the scene to find fire crews actively trying to douse the flames. The 71-year-old homeowner told deputies he just arrived home from fishing before hearing a loud explosion as he was left the garage.The explosion caused a fire that spread throughout the garage and to some adjacent trailers, deputies say. The blaze destroyed two residential trailers and the detached garage.All residents were account for except man, who was later found dead inside one of the trailers, according to the Sheriff's Department. The victim's identity was not immediately released.Sheriff's Bomb and Arson detectives were working to determine the origin and cause of the fire. 998

DENVER — The City of Denver has dealt with at least 289 cases of public urination or defecation so far in 2018.“You’ll come outside in the morning and someone will have just used the restroom all over the wall,” Denver resident Jake Rose said.Rose, who lives in the Capitol Hill neighborhood of the city, says he sees the issue when he walks into his alley to get to his garage.“It’s pretty offensive. I’d rather not see it,” he said.KMGH contacted several residents in the Capitol Hill neighborhood through the Nextdoor app to get their thoughts.“This is a HUGE issue in the area,” one resident said. “This problem has increased dramatically.” Another added that there was “just poop everywhere.”Denver police keep track of how many citations they give out for certain municipal code violations. From January to November, that number came in at 289 for public urination or defecation. A police spokesperson added that usually officers give warnings, sometimes multiple, before issuing a citation.There were another 136 complaints through 311 for human waste in the public right-of-way.“Any waste in the public right of way is essentially a public health issue because that waste can go into our waterways, people can be exposed to it, and we don’t want that,”said Jeremy Garland of the Denver Department of Public Health and Environment.Garland says multiple city departments work together to try to address the issue. Police issue citations, DPHE deals with cleanup through 311 and the Department of Public Works can be called for larger cleanups.“We don’t want this happening in our streets.
