SAN DIEGO (KGTV and CNS) — A felony assault charge with a hate crime allegation has been filed against a man who allegedly assaulted a 16-year-old Syrian refugee and used a racial epithet during the attack while the two rode a San Diego trolley.Adrian Vergara, 26, pleaded not guilty to the charge Thursday afternoon.Vergara hid from view Thursday with his head down, at one point standing on the table with his back to the judge. RELATED: Man accused of San Diego trolley hate crime has long rap sheetProsecutors say the victim was on the trolley speaking to his friend in Arabic when Vergara reportedly asked “what trash are you speaking.” When the victim replied that he was speaking Arabic, Vergara reportedly hit the man repeatedly in the face. "The defendant started saying 'F***ing' Arabs, and he began assaulting the teenager while he sat on the trolley," said deputy district attorney Leonard Trinh. Trinh says Vergara hit the boy 5 to 6 times, causing minor injuries to below his eye. "My parents brough us to this country so that we may be safe and go to school and have better lives, and this attack brought fear to them," the victim said. "However, I am very happy I reported this crime and that the attacker was found."Vergara is being held without bail because he violated probation for a prior robbery and vehicle theft. He faces up to 11 years in prison if convicted of the assault by force likely to cause great body injury, which carries hate crime escalation. In 2013, Vergara completed an anger management program. In 2015, a case was dismissed accusing Vergara of attacking another man and in 2016, he was charged with grand theft and burglary for breaking into the Central Library. In late 2016, documents show Vergara violated a restraining order against his ex-girlfriend, kicking her front door, texting her and in a phone call, cursing at her and saying, "if you don't talk to me I'm going to go to your job and cause a scene. I don't care about my life."Documents show he called her 20 times in 30 minutes.Court documents also show a carjacking charge at the beginning of 2017.Later in 2017, Vergara was charged for beating a man at the MTS Imperial Transit Center. WOODLAND PARK, Colo. — The parents of missing Colorado mom Kelsey Berreth filed a wrongful death lawsuit against her fiancé Patrick Frazee.Attorneys for Darrell and Cheryl-Lee Berreth filed the lawsuit Friday in U.S. District Court in Denver.The suit is seeking an unspecified amount for the Idaho couple’s grief and suffering following the death of their 29-year-old daughter, whose body has yet to be recovered. The lawsuit alleges Berreth was “murdered on or about November 22, 2018, at the direction and/or hand of Frazee in or about Woodland Park, Teller County, state of Colorado.”The couple is also suing for negligence, alleging “Frazee enacted physical, mental, and emotional acts of violence upon Kelsey Berreth prior to her death, Frazee breached the duty of care with which a reasonable person should conduct himself toward another human being.”Frazee was formally charged with murder Monday morning. Authorities allege he tried to find someone to kill Berreth three times between September and November and causing her death on or around Thanksgiving.Berreth was last seen Thanksgiving Day on a grocery store surveillance video with the couple's 1-year-old daughter. Frazee said the two met that day to exchange their child.Authorities believe Berreth was killed at her home in Woodland Park, Colorado. Her cellphone was tracked to Gooding, Idaho, three days after Thanksgiving.ABC News reported earlier this week that a 32-year-old Twin Falls, Idaho, woman was under investigation for possibly disposing of Berreth’s cell phone.  OCEANSIDE (CNS) - An electronic device that can bring down drone aircraft, presumably as they interfere with emergency firefighting planes and police helicopters, has been obtained by Oceanside police, it was reported Saturday.Oceanside police and the Los Angeles County Sheriff's Department were among the first police agencies to acquire a "Drone Killer" from IXI Technology, a Yorba Linda company that supplies electronic equipment to the U.S. armed forces, the San Diego Union-Tribune reported Saturday. Deputies deployed the anti-drone device at the 2017 Rose Parade.IXI Technology agreed to donate the ,000 drone-incapacitating weapon to Oceanside police and made a presentation to the Oceanside City Council on March 28, the Union-Tribune reported."The purpose is primarily for emergency situations," Oceanside police Lt. Aaron Doyle told the newspaper. "It won't be used when someone complains about a neighbor flying a drone. It's pretty much for a life-or-death situation, to save lives."Drones can force authorities to ground air operations to avoid collisions. That's what happened in December during the Lilac fire, when aerial firefighting had to be called off for more than an hour due to a drone in the area.The device can be pointed at a drone in the air and will cut off communication between it and its operator, the Union-Tribune reported. A drone targeted by the device will either hover in place, return to the place it was launched or simply land, depending on its programming.The device can disable most drone models, IXI Technology's Andy Morabe told the Union-Tribune. When the drone killer encounter's a drone it can't stop, the company plans to rewrite software to remedy the problem within days, Morabe said. 1754
