SAN DIEGO (CNS) - A wrongful death lawsuit was filed Monday on behalf of the family of a 24-year-old woman who died last fall at the Las Colinas Detention Facility in Santee.Elisa Serna died Nov. 11, 2019, a few days after she was booked into the county jail.Earlier this year, the sheriff's department said Serna died from complications of drug abuse, with a contributing factor of early intrauterine pregnancy.The lawsuit filed in San Diego federal court alleges jail staff were aware of Serna's substance abuse and subsequent withdrawal symptoms, but did not provide her with treatment. Though Serna was fainting, had low blood pressure, was vomiting regularly and displaying odd and incoherent behavior, jail staff "ignored the obvious signs of medical distress" and "failed to provide proper medication as Elisa's condition was worsening," the complaint alleges.Sheriff's officials could not immediately be reached for comment on the suit, which names San Diego County and Sheriff Bill Gore as defendants.Plaintiffs in the suit include Serna's parents, Michael and Paloma Serna; her husband, Brandon Honeycutt, and a minor child referred to as S.H.The sheriff's department has come under fire recently over a spate of deaths among county jail inmates, which were referenced within the complaint.The lawsuit cited news reports indicating the county had the highest jail mortality rate among the state's largest counties, and said prior deaths from inmates suffering from withdrawal symptoms should have made jail staff aware of the potentially fatal consequences of those symptoms.The suit also alleges staff are inadequately trained and in-custody deaths at county jails are not being properly investigated."Even though inmates are dying or suffering catastrophic injuries at an alarming rate at San Diego County jails, the medical and correctional staff whose actions or inactions cause the deaths are not investigated; not informed of their failures; not given further training or remedial instruction; and are not monitored or closely supervised after these adverse events," the lawsuit alleges. 2111

SAN DIEGO (CNS) - A man who went on a South Bay crime spree that included shooting at a moving vehicle and ramming an occupied San Diego police vehicle during a pursuit was sentenced Thursday to 19 years in state prison.Alfonso Ayala Flores, 26, pleaded guilty earlier this year to charges of assault with a semi-automatic firearm and resisting arrest for a series of crimes last November that culminated in him driving toward officers who cornered him in a cul-de-sac and ramming a patrol car.One officer opened fire on the pickup truck Flores was driving, striking the truck, but not Flores.He was also given a separate 16-month sentence for an unrelated burglary case, but that term will be served concurrently with his 19-year prison term.The spree began with Flores carjacking a motorist's Ford F-150 pickup at the Frontier Motel in San Ysidro on Nov. 6. Deputy District Attorney Mary Naoom said that on the following day, Flores shot at an occupied vehicle.Two days later, he sped off when San Diego police spotted him driving the stolen truck in the 1900 block of Dairy Mart Road in San Ysidro. The suspect, who had a female companion in the truck with him, fled west, where he wound up at the end of a cul-de-sac in the Nestor neighborhood.As officers got out of their cars and shouted at him to halt, Flores made a U-turn and accelerated toward them, prompting one of the officers to open fire, police and prosecutors said.Naoom said Flores rammed the patrol car with the pickup as he sped away, with police again in pursuit. The subsequent chase ended in the 1200 block of Holly Avenue in Imperial Beach, where he pulled over and ran off along with the woman, according to Sainz.His companion was quickly apprehended and questioned by police before being released. SAN DIEGO (CNS) - A man who fired a pellet gun at Navy SEAL instructors and trainees conducting a nighttime training exercise near Liberty Station pleaded guilty Wednesday to making an attempted threat on a witness and brandishing a replica firearm.Scott Douglass Weaver, 48, faces a year in local prison when he is sentenced Nov. 1.Dispatchers received a report of a man shooting at Navy officers shortly before 10:45 p.m. on July 23 in the 2500 block of Laning Road and Weaver was arrested. SAN DIEGO (CNS) - Flames tore through a large commercial building in the Morena area Friday, causing extensive damage and sending a thick plume of smoke into the air near Mission Bay.The blaze in the 1200 block of Morena Boulevard erupted about 5:40 p.m., the San Diego Fire-Rescue Department reported.Police closed down the north-south street to through traffic while firefighters worked to subdue the intense flames.Crews were still working to get the blaze under control as of 6:30 p.m. and trying to get inside the two-story structure to check on a report there might be someone inside, according to SDFRD public affairs.There were no immediate reports of injuries. 677

SAN DIEGO (CNS) - A man whose altercation with four off-duty San Diego police officers in the parking lot of a Grantville bar drew attention from local activists alleging excessive force was sentenced Thursday to a three year probation term in connection with cocaine and firearm possession, which includes 90 days in jail and nine months to be served in a work furlough program.Jonathan Felix, 29, pleaded guilty last month to possession of a loaded firearm and cocaine, in connection with the Nov. 7, 2018, altercation outside McGregor's Grill and Ale House just before 2 a.m.The case generated substantial public interest regarding the use of police force rather than for the felony case, in which Felix was accused but never charged with pointing the gun at the officers, prompting them to tackle him to the ground and strike him several times until they were able to seize the pistol, according to prosecutors.RELATED: San Diego man says off-duty SDPD officers assaulted himThe blows rendered Felix unconscious, and left him with a fractured pelvis, fractured hand and cuts and bruising to his head, while one of the officers testified that he broke his hand punching the defendant.In addition to possessing cocaine, Felix was prohibited from possessing a firearm due to theft and drug-related convictions out of Arizona, according to Deputy District Attorney Michael Runyon.Following his 90 days in custody, Felix will continue working during the day at Greystone Prime Steakhouse & Seafood in the Gaslamp Quarter, where he was employed at the time of his arrest. Shamoon imposed a suspended four-year prison sentence, meaning Felix could head to prison if he violates the terms of his probation.At a preliminary hearing in February, Officer Anthony Duncan testified that after he and other officers departed McGregor's, they noticed Felix leaving the premises and returning to the parking lot on several separate occasions, both in his Dodge Durango and on a bicycle. He said the officers were concerned that Felix was "casing" vehicles, possibly to break into or steal cars.Felix was exhibiting "odd behavior" and "something didn't feel right (about him)," Duncan said.Officer Jose Rodriguez, who was at the bar with the other men but left before the altercation with Felix, testified that he also felt Felix was looking into vehicles parked in the lot.Despite their concerns, none of the officers called for assistance from on-duty law enforcement until after they restrained Felix, according to Duncan.Duncan said that he approached Felix, at which point the defendant produced a semi-automatic handgun from his waistband and pointed it at him, prompting all four officers to draw firearms on Felix.Surveillance footage from the parking lot of the business captured the physical altercation between the men, but not the purported standoff, which was blocked from view by a parked car. The defendant, who was sitting on his bicycle at the time, backpedaled away from the men, who followed and tackled him to the ground, according to surveillance footage.Felix told investigators after being arrested that he believed the group of men, who he said never identified themselves as law enforcement officers that night, may have been casing his Durango or looking to start trouble.Defense attorney Alicia Freeze argued that her client drew his gun out of concern for his safety, but denied that he ever pointed the weapon at the group. Speaking with reporters outside court following the sentencing hearing, she said she felt the officers used "unlawful force" in subduing Felix.Runyon reiterated outside court that Felix pointed a gun at the officers, "ignored several commands" to drop his gun, and "did not give up the gun immediately" even after being taken to the ground.Along with Duncan, the altercation included fellow San Diego officers Nicholas Dabbaghian, Frank Bigler and Ross Bainbridge. 3956
