SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay started his sentencing hearing Wednesday for violating federal immigration laws.Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash. According to AAA, 31 people were injured in DUI-related crashes last year over Labor Day weekend.Statewide, eight people were killed in DUI crashes last year. “While alcohol-related crash fatalities have dropped in the last three years over this holiday, injuries have risen,” said Auto Club Traffic Safety Manager Anita Lorz Villagrana.“We want to remind everyone to make a plan before celebrating – use a rideshare service, stay at a hotel or someone’s home, or designate a sober driver. SAN DIEGO (KGTV) -- A judge ruled Wednesday that a Navy commander will face a third trial on charges he tried to rape a junior officer in her home.John Michael Neuhart II asked the judge to dismiss all charges after a second jury was unable to reach a verdict.The judge dismissed charges of assault with intent to commit rape during burglary, burglary and resisting or delaying a peace officer.RELATED: Mistrial declared for former Navy commander accused of rapeThe judge added that prosecutors can proceed with a third trial in January on charges of attempted forcible rape and assault with intent to commit rape.Neuhart now faces six years behind bars and lifetime sex offender registration if found guilty. Neuhart had previously been facing life in prison.In the two trials combined, 21 out of 24 jurors voted to convict Neuhart. SAN DIEGO (KGTV) - A Marine was honored Monday at Camp Pendleton for his bravery mid-September when he saved a choking baby.Private First Class Jonathan Lewellen was on leave after graduating boot camp before starting combat training. He was upgrading his phone at the Liberty Station Verizon store when he heard a mother screaming her son's name."She wasn’t hysterical but she was panicked," Verizon Store Manager Cecil Silva said. "He [Lewellen] looked and his instincts just kicked in, like he literally jumped over a desk we had, jumped over the railing, ran through the bushes and just attended to the baby."Lewellen asked the mother if he could help, then performed CPR, and scooped mucus out of the baby's throat."The baby was pretty pale, started getting a little blue-ish," Silva said he called 9-1-1 and was asked to stay on the line, saying several others calling couldn't hold a connection due to bad cell service."Once the ambulance was here they were just like, you’re lucky this guy was here," Silva said both parents were shaken from what happened. He added he has nieces and nephews of the same age and admired how Lewellen had the training and response to provide aide."That just shows, you never you never just turn that part of you off. Good people are just good people," he said, calling him a hero."I did what I was trained to do I don't think I'm a hero more than anyone else would be," Lewellen said. He was thinking of his own two children while saving the baby. He has a 3-year old and a 3-week-old.After combat training, he will go on to work as an aviation mechanic. 1637

SAN DIEGO (KGTV) - A man was sentenced Wednesday after pleading guilty to selling fentanyl to a 26-year-old La Mesa woman who overdosed in 2018, according to the U.S. Attorney's Office.Uriah Odish, 28, was charged with Conspiracy to Distribute Fentanyl and faces 14 and a half years in prison with five years of parole.According to the U.S. Attorney's Office, "Odish sold more than 500 grams of what he knew to be fentanyl between 2017 and the day of the fatal overdose."Tiffany Hansen died from that fatal dose. Her mother Keri Cuppage said Odish apologized Wednesday, "he asked for forgiveness and said he was very very sorry that his decisions led to Tiffany's death."She replied, "my biggest hope is that the time served in jail will help him and he will be able to beat his addiction."She said Tiffany loved the beach and all things Disney. After she passed, Cuppage had her ashes formed into a sea turtle and placed at the Neptune Memorial Reef. The reef is an underwater memorial created to look like the Lost City of Atlantis, off the coast of Miami Florida.Cuppage said every day after Tiffany's death is a struggle. "Every time I get a joyful emotion, it's just a backwash of sad. Not a day has gone by that I haven't cried, that I don't miss her desperately."She urges everyone to stay away from fentanyl, saying death or sentencing your loved ones to a lifetime of sadness isn't worth the high. She said she wishes she could give out her phone number so she could be there for anyone debating using the drug so she could discourage them from making a mistake.The U.S. Drug Enforcement Administration documented a surge in fentanyl-related deaths this year in San Diego County.In 2019, the DEA said 152 people died from fentanyl-related overdoses.
