SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. Jason Weeden said.Cushinberry was arrested last Friday about 6:45 a.m. in the 200 block of 17th Street.When Judge Jay Bloom ordered the defendant to stay away from the alleged victim, Cushinberry said ``I don't know the woman,'' according to Deputy District Attorney Martin Doyle.The prosecutor said Cushinberry has a criminal past from Indiana that is still being looked into.Cushinberry -- who is also charged with two counts of digital penetration by a foreign object, faces 21 years in prison if convicted, Doyle said.A readiness conference was set for Dec. 3 and a preliminary hearing for Dec. 5. 1391

SAN DIEGO (CNS) - An 18-year-old man was shot twice in the stomach during an armed robbery early Thursday morning in a Mission Beach parking lot, police said.Two 18-year-old men were in a car leaving a party at the Bahia Resort Hotel, 998 West Mission Bay Drive, when they were approached by two men on foot in a public parking lot on Gleason Road at around 12:30 a.m.One of the men on foot pulled out a gun and pointed it at the pair in the car while demanding items from them, San Diego Police Department Officer Robert Heims said. The victims got out of the car and the man with the gun stole a chain necklace from one of the victims.The other victim tackled the gunman and was shot twice in the stomach, the officer said.The suspects fled in an unknown vehicle and the victim who had his necklace stolen drove the gunshot victim to a hospital for treatment of his wounds, Heims said. The gunshot victim underwent surgery, but an update on his status was not immediately available.A detailed description of the suspects was not immediately available. 1061

SAN DIEGO (CNS) - Authorities Friday publicly identified a 20-year-old man who was found dead of an apparent homicide in a car parked on a Southcrest- area roadside.Patrol officers responding to a report of a possible traffic accident in the 4000 block of Boston Avenue around 11:50 a.m. Wednesday found Ismail Abouabid mortally wounded behind the wheel of the parked vehicle, bleeding from the head, according to San Diego police.Abouabid, who had recently relocated to San Diego from Erie, Pennsylvania, was pronounced dead at the scene, Lt. Matt Dobbs said. SAN DIEGO (CNS) - California Highway Patrol officers arrested fewer people than last year for suspected drunk driving in San Diego County so far during the Christmas holiday enforcement period, the agency said today.CHP officers arrested 33 people in the county between 6 p.m. Friday and 6 a.m. Sunday, an officer said. That's down from 40 arrests in the area at the same time last year.Statewide, the CHP arrested 639 people for suspected DUI violations Friday night and early Sunday, up from 604 in 2017.There were 20 traffic fatalities reported by law enforcement agencies across the state during the period -- including one in San Diego County. There were four fatalities reported statewide at this point in the Christmas holiday last year. 752

SAN DIEGO (CNS) - More than a dozen animal shelters, rescues and sanctuaries across San Diego County Saturday will encourage people to adopt a pet during the fifth annual Clear the Shelters day.Clear the Shelters is a nationwide animal adoption event intended to help as many shelter animals as possible find a forever home. Since the event began in 2015, more than 300,000 pets have been adopted during Clear the Shelters events.The San Diego Humane Society's San Diego, Escondido and Oceanside campuses and the county of San Diego's Department of Animal Services shelters in Bonita and Carlsbad will participate in the event and waive adoption fees for all animals adopted throughout the day.At the county's shelters and the humane society, animals available for adoption have been spayed or neutered, microchipped and brought up to date on their vaccinations, if necessary. Prospective adopters can save time by searching the available pets at a shelter's website."People still need to go through the normal adoption process of filling out an application and doing a screening interview with staff. We just want to make sure their new owners are prepared and committed to an animal," County Animal Services Director Daniel DeSousa said.According to the county, 81 animals were adopted during last year's Clear the Shelters event, while more than 400 animals were adopted at the humane society's three locations last year.
