SAN DIEGO (CNS) - An ex-con pleaded not guilty to a murder charge today for allegedly stabbing another man in an apparently random attack in a public restroom along the Pacific Beach boardwalk, 16 days after being released from prison.Martin Alvarez, 33, is accused in the Aug. 16 slaying of 39-year-old Michael Wagley, who was found mortally wounded at about 7:30 p.m. on Aug. 16 in the lavatory at 700 Grand Avenue. The victim was taken to a hospital, where he was pronounced dead.Witnesses reported seeing a man fleeing on a bicycle following the stabbing, San Diego Police Department Lt. Andra Brown said.The lieutenant said Alvarez, who matched the suspect description, was detained in the area and later arrested on suspicion of murder.The alleged motive for the slaying was unclear, but a prosecutor said the victim had no connection to his attacker.Deputy District Attorney George Modlin called the stabbing a ``random act of murder'' in which Alvarez allegedly attacked the victim from behind, stabbing him in the neck. The prosecutor said Alvarez then threw Wagley to the ground and stabbed him several more times.Modlin said that following his release from prison, Alvarez failed to report to Post Release Community Supervision and committed the murder 16 days later.It was uncertain what crime Alvarez was serving time for, though the criminal complaint alleges he has prior San Diego County convictions for assault with a deadly weapon and robbery.In addition to murder, Alvarez faces allegations of using a knife in the slaying.He was being held without bail, but a bail review hearing was set for Friday. 1627

SAN DIEGO (CNS) - As his trial entered its eighth week, a man who shot at officers from his ex-girlfriend's condominium in Bankers Hill pleaded guilty to four counts of assault with a firearm on a peace officer and agreed to a 20-year prison sentence, it was confirmed Thursday.Titus Colbert, 36, faces formal sentencing May 18 before Judge Louis Hanoian.Deputy District Attorney Michael Runyon was about to wrap up his case when Colbert decided to plead guilty Monday afternoon.Charges of premeditated attempted murder of a peace officer and assault with a semiautomatic weapon were dismissed.RELATED: Suspect in Bankers Hill standoff that shut down Lindbergh Field in courtRunyon said in his opening statement that Colbert took two rifles and a revolver belonging to his roommate in Las Vegas and showed up at his former girlfriend's condo in Bankers Hill a few days before his Nov. 4, 2015, arrest.According to Runyon, the morning of the shooting, Colbert's ex- girlfriend Ashley Davies realized that he'd had broken into her complex and sent him a text saying: "You're trespassing! You're going to jail!"Colbert responded by texting, "(Expletive), I'm going to be a star. (Expletive) you for putting my life in danger," the prosecutor said.When officers responded to Davies' sixth-floor condo near the roof of the complex, a shot rang out from behind her door and an officer returned fire, according to Runyon.The prosecutor said officers retreated and more shots were fired at them and members of a SWAT team.Hours later, police observed a rifle, revolver and a magazine for a rifle being thrown out of the window where Colbert was holed up, Runyon said.After Colbert's arrest, officers found 17 expended casings and another rifle under a pile of clothes in the room, the prosecutor said.Even though traces of cocaine and methamphetamine were found in Colbert's system, and even though he had a history of mental health issues, the defendant knew what he was doing that day, Runyon said.Defense attorney Melissa Tralla told the jury that Colbert had a psychotic break and was paranoid and delusional. She said that days before, Colbert had called Davies at least 50 times and was not acting right.Colbert was rambling, saying he had special powers and was part of the New World Order, Tralla said.The attorney said Colbert was showing signs of mental illness by age 6, and was diagnosed with schizophrenia by age 15. SAN DIEGO (CNS) - A pedestrian was struck and killed by a BNSF freight train at the Old Town Transit Station in San Diego, authorities said this morning.Officers responded to the station, in the 4000 block of Taylor Street near Congress Street, at 9:25 p.m. Friday and found the victim dead at the scene, according to Deputy Brian Abraham of the San Diego County Sheriff's Department.The age, gender and name of the victim were not disclosed.Anyone with information about this incident was asked to call the sheriff's department at 858-565-5200. 553

SAN DIEGO (CNS) - A man accused of fatally beating a fellow transient with a mini sledgehammer as the two argued along a Midway District street was ordered Monday to stand trial on a murder charge.Greg Repp Jennings, 53, is accused in the Jan. 8, 2018, slaying of 37- year-old Michael Anthony Dean, who was struck several times in the head with a four-pound hammer.First responders found Dean lying face-up in the street with his face "caved in," according to preliminary hearing testimony. He was pronounced dead at the scene, near 3805 Midway Drive.According to testimony from SDPD Detective Sgt. Christopher Leahy, one witness told investigators that an argument sparked the killing, which began when Jennings was talking loudly at a bus stop. Dean, who was also sitting at the bus stop, asked Jennings to "tone it down," angering the defendant, who told him "it was his First Amendment right and he wasn't going to shut up," Leahy said.Other witnesses also saw the men arguing and then saw Dean fall into the street, at which point Jennings allegedly struck him with the hammer multiple times.Jennings told investigators that he acted in self-defense, according to testimony. He alleged Dean had tied a pair of workboots together by the laces and was going to use the improvised weapon to attack him.Jennings remained at the scene and was arrested by responding officers.The defendant remains in custody without bail. SAN DIEGO (CNS) - Cruise ships are scheduled to return to the Port of San Diego this week and through the new year, part of an effort by the cruise lines to reestablish ships in U.S. waters as a prerequisite to resume cruising in a post-COVID-19 world, it was announced Monday.Five Holland America Line ships and one Princess Cruises ship are scheduled to arrive beginning Wednesday, periodically docking at the B Street Cruise Terminal for fuel, food, supplies and services. At this time, none of the vessels will be carrying passengers or conducting any sailings, according to local port officials.To resume cruises after the U.S. Centers for Disease Control and Prevention deems it safe in light of the ongoing COVID-19 pandemic, the ships must reestablish operations in United States waters to meet CDC and U.S. Coast Guard guidelines.According to port officials, time spent docked in San Diego will be limited. Each ship is scheduled to dock at B Street the morning of their scheduled arrival date and depart that evening.The Holland America Line ships are scheduled to remain in the San Diego area and may be visible off the coast, with some periodically positioning in the outer anchorage just outside of San Diego Bay off the coast of Coronado. After their initial arrival, each HAL ship plans to periodically return to the B Street Cruise Terminal to refuel and/or to resupply or receive services. The Emerald Princess is scheduled to go to Los Angeles after its Dec. 24 visit, but port officials stressed that vessel schedules may change.Crew members aboard the vessels will not be allowed off unless as part of crew changes with plans and procedures reviewed and approved by the CDC, Coast Guard, Customs and Border Patrol and county Health and Human Services.
