SAN DIEGO (CNS) - San Diego City Attorney Mara Elliott announced litigation today against opioid manufacturers including Purdue Pharma for what she called their role in the country's ongoing opioid addiction crisis.The federal lawsuit also names members of the Sackler family, the owners of Purdue Pharma. Elliott's lawsuit is aimed at forcing the defendants to fund rehabilitation and drug-education programs in the city and recoup the funds the city has spent on medical treatment for opioid abuse and homelessness caused by opioid abuse.Purdue Pharma officials could not be reached for immediate comment on the lawsuit.With the lawsuit, Elliott said she expects to join more cities, counties and states to form a multi-district litigation.``Opioid manufacturers have profited handsomely from the human suffering they intentionally inflicted through manipulation and deceit,''Elliott said. ``While San Diego will long deal with the destructive consequences of their greed, we intend to hold them accountable for funding drug treatment and education programs that will protect the health and safety of San Diegans.''Elliott's office plans to prosecute the pharmaceutical companies and the Sackler family for allegedly violating the state's ``unfair competition''law and for violating the federal Racketeer Influenced and Corrupt Organizations Act. SAN DIEGO (CNS) - San Diego-based medical technology company Phamatech and its CEO have agreed to pay more than million to resolve allegations that they submitted false claims to Medicare and received government reimbursements for unnecessary lab testing, the U.S. Attorney's Office said Friday.Prosecutors allege the company paid kickbacks to a medical clinic, which in return ordered Phamatech lab testing for its patients enrolled in Medicare.Over the course of about two years, Phamatech, which manufactures diagnostic devices and provides lab testing services such as drug and alcohol tests, paid a per-specimen fee to Imperial Valley Wellness in exchange for referrals of urine samples from Medicare beneficiaries, according to the U.S. Attorney's Office.Many of the samples referred to Phamatech were not necessary and thus ineligible for Medicare reimbursement, prosecutors said.The company, along with its CEO and founder Tuan Pham, agreed to pay ,043,484 to settle allegations that Phamatech violated the federal Anti- Kickback Statute and the False Claims Act.The U.S. Attorney's Office said the allegations were originally brought in a lawsuit filed by former Phamatech employee John Polanco, who will receive 7,392 from the settlement proceeds. 1273

SAN DIEGO (CNS) - The San Diego City Council voted 5-4 today to extend the rent repayment period for commercial and residential renters to Dec. 30, giving renters who have lost income due to the COVID-19 pandemic a few extra months to repay back rent.Council President Georgette Gomez's initial motion Tuesday would have extended the repayment period for the eviction moratorium to March 31, 2021. Councilwoman Jennifer Campbell amended the motion to the December date as a compromise.On March 25, the council voted unanimously to begin an emergency eviction moratorium for renters. The moratorium requires renters to demonstrate through documentation that the pandemic has caused ``substantial loss of income,'' according to city staff. Renters are also required to follow rules in leases, but landlords cannot evict a tenant for nonpayment due to COVID-19.The moratorium expires Sept. 30. If tenants are in good standing with landlords, they can work out a repayment plan for back rent through Dec. 30, but otherwise things could get dicey for tenants.``We are all in it together,'' Gomez said before discussion of the motion. ``The economy is not fully restored. This is not an ideal policy, but it's a necessity for what we are dealing with.''Gomez represents District 9, which encompasses Southcrest, City Heights, Rolando and the College area. It has also been one of the most impacted areas during the pandemic.According to a member of Gomez' staff -- which gave the presentation on the topic -- the city had started 15,659 rental relief applications using federal Coronavirus Aid, Relief, and Economic Security Act funds. Disbursements from that pool of relief money are scheduled to be handed out in late August or early September. Those funds will go directly to landlords, however, and not renters.Council President Pro Tem Barbara Bry voted no on the motion Tuesday, not because she didn't agree that people needed help paying rent, but because the arbitrary nature of the rental relief program could leave the city open for lawsuits, she said. She added that not enough renters know the impact of not paying rent.``It's a cruel hoax,'' she said. Bry said that by not paying rent on time, tenants could be destroying their credit and leaving themselves with mountains of debt and no place to turn once the moratorium ends.In a public comment period, several dozen San Diegans called in, many urging the council to extend the moratorium -- which was not the motion in front of council -- and many to forgive rent and mortgages outright. About an equal number of landlords called in to urge the council to allow for evictions again, as many said they were paying two mortgages and not receiving income.The repayment plan extension to December will pass a critical few months, including local, state and national elections. On Nov. 3, San Diego voters will select a new mayor and five new members of its City Council -- something that could cause significant shakeup in how the city is run.``I think in three more months we will be able to tell better what the future holds,'' Campbell said. Councilmembers Chris Cate and Scott Sherman were opposed to the extension on legal grounds, as the gap between when the moratorium was passed to the date proposed in Tuesday's initial motion would have been more than a year. They claimed this could cause trouble for landlords trying to evict delinquent tenants or to collect back rent.Because the repayment extension passed with just five votes, it is susceptible to a possible veto by Mayor Kevin Faulconer. Scott Peters, D-San Diego, Friday called on the federal government to determine and commit to an interim and long-term plan for nuclear waste storage.Peters challenged the rest of the federal government to find a storage solution during a meeting of the House of Representatives Energy and Commerce Committee's Environment and Climate Change Subcommittee.The subcommittee, on which Peters sits, held a hearing on three bills that would establish a process to send spent nuclear fuel rods from decommissioned plants to designated storage areas around the country. To do so, Peters said the government should invoke the Constitution's supremacy clause, which requires states to follow federal law if they have conflicting statutes.``There's not a lot of enthusiasm among the states to accept any defined or undefined amount of nuclear waste. There just isn't,'' Peters said.``To me ... the magic of federalism is the supremacy clause and the ability of the federal government to ... (say) in this geology, per this engineering, (and) through this licensing process that this risk is lower.''Two of the bills the subcommittee considered -- the Spent Fuel Prioritization Act and the Storage and Transportation of Residual and Excess Nuclear Fuel Act -- would directly affect San Diego County by relocating spent nuclear fuel from the defunct San Onofre Nuclear Generating Station to designated storage sites like Yucca Mountain in the Nevada desert.The plant shut down in 2012, but nearly four million pounds of spent fuel cells remain buried under the plant in a temporary storage facility about 100 feet from the Pacific Ocean. The plant sits approximately 60 miles or less from both San Diego and Los Angeles and the storage facility continues to be susceptible to a major earthquake or significant sea level rise.The bills remain in limbo due to pushback from legislators who represent the districts in which spent fuel rods would be stored.However, Peters' office hopes the bills could get a vote out of the committee by the end of the year. 2073
SAN DIEGO (CNS) - The San Diego County Board of Supervisors Wednesday gave final approval to a measure to reduce light pollution in two rural communities.The amendment to the county's Light Pollution Chapter ordinance covers the Julian and Borrego Springs Community Planning Areas. Both will now be considered "Zone C" to receive a Dark Sky Community designation, which limits the total amount of light per acre and has more restrictive standards for signage or nighttime sports.During their regular meeting on Oct. 28, supervisors approved the ordinance amendment on first reading, and also found it to be exempt from the state's Environmental Quality Act, as it does not affect land use or density.Taking effect in January, the ordinance will support Julian in becoming an International Dark Sky Community and update Borrego Springs' light pollution standards.According to the county, changes willinclude new lighting standards (for color type, levels and shielding) and sign illumination. The county will give existing developments 10-year grace period to come into compliance.Dark skies are important to astronomers for better viewing in rural communities, along with businesses that benefit from related tourism.
