LOS ANGELES (CNS) - A Los Angeles police officer who fatally shot a developmentally disabled man and wounded his parents during a confrontation that erupted while the lawman was off-duty and shopping at a Corona Costco will not face criminal charges, Riverside County's top prosecutor said Wednesday. ``For all of us who handled this case, it's a horrific, tragic situation that occurred,'' District Attorney Mike Hestrin said during a news briefing at the D.A.'s headquarters in downtown Riverside. ``But we had to put our passions and emotions aside and marry the facts with the law. We don't pay attention to public outcries or social media rants.''According to Hestrin, evidence collected from the June 14 shooting at the Costco on North McKinley Street, where 32-year-old Kenneth French was killed, was presented to a 19-member criminal grand jury on Sept. 9. After the jury completed its inquiry, the panel voted against indicting LAPD Officer Salvador Sanchez. The jury's decision was submitted to the D.A.'s office Tuesday.Hestrin said he did not know how jurors voted. There must be at least 12 affirmative votes for an indictment. Hestrin said he will abide by the panel's decision and not independently file a criminal complaint against Sanchez.``This was a fact-driven decision,'' the D.A. said. ``I would file charges if I thought there was a problem with the process. All the evidence we had was presented to the grand jury. I respect and stand by their decision. They did a great job gathering facts. They did what they were supposed to do.''Dale Galipo, the attorney representing the dead man's parents, Russell and Paola French, has repeatedly stated his belief that the Corona Police Department and the D.A.'s office were treating Sanchez deferentially because he's a law enforcement officer, and if anyone other than an off-duty policeman had done the shooting, that person would have been charged at the outset.``I categorically deny the officer has gotten special treatment,'' Hestrin said. ``This is viewed as an officer-involved shooting. Police officers have to respond (to an attack) as if they're on duty. ... The officer believed his life was in danger. He thought he was shot and was looking around for blood, feeling the back of his head.''Hestrin said he was compelled to turn the case over to a grand jury because there were uncooperative witnesses, leaving the D.A.'s office without a complete picture of events, and he believed 19 members of the public impaneled to vet the evidence would come up with the appropriate decision.Galipo has scheduled a news conference in Corona Thursday in response to the D.A.'s and grand jury's actions. The attorney released a statement saying the outcome ``highlights the unequal treatment of police officers compared to other citizens when they shoot people.''``I am confident that we will get justice for Kenneth and his family in the federal civil rights action that will be filed in the near future,'' he said.Corona police Chief George Johnstone said the shooting has ``weighed heavily on the community'' and his sympathies were with the French family. But after his detectives conducted a 12-day investigation, they could not come up with conclusive findings, other than Sanchez believed he was ``acting in self- defense.'' The case was submitted to the D.A.'s office on June 27.Russell and Paola French, along with Galipo, spoke to the media on Aug. 26, urging the D.A.'s office to come to a decision. Russell French told reporters he ``begged (Sanchez) not to shoot,'' telling him ``our son is sick.''Galipo said the parents and son were moving away from the off-duty cop when he opened fire. According to Johnstone, Kenneth French was shot once in the shoulder and twice in the back. Paola French was shot in the back, and her husband was shot in the abdomen, resulting in the loss of a kidney.According to Galipo, the trio had been shopping for a half-hour when they stopped at a food sample booth in the store to nibble on sausages. Why Kenneth French turned physical with Sanchez, shoving him to the floor while the off-duty officer held his 18-month-old son, is unclear, Galipo acknowledged.He said the decedent was a diagnosed schizophrenic and nonverbal, with no history of aggression.Conflicting stories have emerged over the circumstances, with the officer's attorney, David Winslow, insisting his client responded appropriately.Hestrin played a security surveillance videotape from the Costco that partially captured the deadly 7:45 p.m. confrontation. The clips mainly revealed the tail-end of the encounter between French and Sanchez, with the former appearing to be the aggressor, and Sanchez falling somewhere out of frame. Russell French is clearly visible, standing in front of his son to turn him back, at which point both men are struck by gunfire and collapse to the floor of the store.Johnstone said 10 shots were fired by the off-duty lawman. According to Winslow, Sanchez was knocked down and briefly lost consciousness. When he awoke, he found his son next to him, screaming. The attorney said his client ``had no choice but to use deadly force'' in self- defense.Hestrin said there was no evidence that Sanchez ever lost consciousness. The lawman was not hospitalized, and his son was not injured. LOS ANGELES (CNS and KGTV) - Amid whipping winds and dangerously low humidity, fire crews continued efforts to snuff to the Getty Fire in the Sepulveda Pass Wednesday, fearful that the extreme weather conditions ignite new flames. At 5 p.m., mandatory evacuation orders and warnings were lifted in all areas with the exception of an area bordered by Kenter Ave., Sunset Blvd., Mountain Gate Ave., and a section near Sepulveda Blvd. and the 405 freeway. As of Wednesday evening, the fire was listed at 745 acres, with 27% containment. But forecasters said the area could be blasted with winds ranging from 30 to 50 mph, along with occasional gusts of up to 70 mph. RELATED: MAP: SoCal Fires burn in Santa Ana conditions``Adverse weather conditions will be the biggest challenge for firefighters,'' according to the Los Angeles Fire Department. ``In anticipation of the extreme Santa Ana wind event, the LAFD has recalled and staffed additional resources for any emergency that may arise over the next 24 hours. These resources will be strategically placed in key locations that have a history of being prone to wildfire.'' The National Weather Service issued what it deemed an ``extreme red flag warning,'' which went into effect at 11 p.m. Tuesday, amid predictions some mountain areas could be blasted with gusts of up to 80 mph. The warning covers the bulk of Los Angeles County and will remain in effect until 6 p.m. Thursday. ``The peak of the event is expected to be Wednesday when damaging wind gusts between 50 and 70 mph will be likely for the wind-prone areas of Los Angeles and Ventura counties, with isolated gusts to 80 mph in the mountains,'' according to the weather service. ``This Santa Ana wind event will likely be the strongest we have seen so far this season. These strong winds combined with a long duration of single- digit humidities and dry fuels will likely bring very critical fire weather conditions, making this an extreme red flag warning event.'' As of Wednesday, the Getty Fire, which broke out around 1:30 a.m. Monday morning alongside the San Diego (405) freeway near Getty Center Drive, had destroyed 12 homes and damaged five others. One firefighter sustained a minor injury. About 760 firefighters were battling the blaze. Despite the attention focused on the Getty Fire, the Los Angeles Fire Department dispatched three strike teams to Ventura County Wednesday morning to help fight the Easy Fire that erupted in Simi Valley, forcing evacuations and threatening the Ronald Reagan Presidential Library and Museum. The agency also sent crews to help knock down a small brush fire in Calabasas. The Los Angeles County Sheriff's Department also noted that it was monitoring the Easy Fire, but it had not moved toward Los Angeles County as of Wednesday afternoon. The Los Angeles County Fire Department sent Firehawk water dropping helicopters and two strike teams to Simi Valley as part of its mutual aid agreement. Locally, however, attention was focused on the Getty Fire. LAFD Chief Ralph Terrazas noted Tuesday that it would take ``one ember, just one ember downwind, to start another brush fire.'' At the fire's height, evacuation orders were issued affecting 10,000 structures, both residential and commercial, in an area between the 405 Freeway and Temescal Canyon Road, from Sunset Boulevard north to Mulholland Drive. Evacuation orders were lifted Monday night for the Mountaingate community south of Mulholland. Evacuation centers remain open at the Westwood Recreation Center at 1350 S. Sepulveda Blvd., near Wilshire Boulevard, and the Palisades Recreation Center, 851 Alma Real Drive. Evacuation centers for animals were established at the West Valley Animal Shelter at 20655 Plummer St., the West Los Angeles Animal Shelter at 11361 Pico Blvd. Hansen Dam Recreation Center at 11770 Foothill Blvd. in Lake View Terrace was opened to receive large animals. Authorities confirmed Tuesday afternoon the Getty Fire was caused by gusting winds that severed a tree branch and blew it into a Department of Water and Power electrical line, causing sparks that fell onto the brush below. ``This was, simply put, ... an act of God,'' Garcetti said. Marty Adams, general manager of the Department of Water & Power, told reporters the agency had just completed a brush-clearing operation in the area in July, trimming 248 trees ``in excess of what the state requires.'' He noted that the branch in question came from a tree ``outside of our clearance zone'' but was carried by the wind into the power line. Adams said the power line itself remained intact and is still delivering electricity to the area. The San Diego Freeway, a southbound stretch of which was closed for much of the day Monday, was open through the Sepulveda Pass, but exit ramps between the Ventura (101) Freeway in Sherman Oaks to Sunset Boulevard were blocked. LOS ANGELES (AP) -- Court documents show that a Los Angeles police officer accused of fondling a dead woman has been sued by her family.The lawsuit was filed Tuesday by the family of 34-year-old Elizabeth Baggett. The lawsuit accuses Officer David Rojas of fondling Elizabeth Baggett's breasts and "feeling her nipples, without limitation," as well as showing the body camera video of it to others.The alleged incident happened in October 2019. Officers were called to a home in response to a report of a body discovery.Rojas, who has been on the force for four years, remains employed by the Los Angeles Police Department.Rojas has been suspended, and he has pleaded not guilty in a criminal case.Rojas' lawyer could not immediately be reached by The Associated Press for comment. 789
