CINCINNATI – Mary Lee Tracy says she trusted Larry Nassar like she would her father or her brother, but she was fooled by a ”master manipulator.”Tracy said on Thursday she feels she is the right person to fill her new appointment with US Gymnastics and wants to keep the job. But Tracy also said she would resign if what she calls “cyber bullying” toward her doesn’t stop.Speaking at her Fairfield, Ohio gym, the owner and coach of Cincinnati Gymnastics Academy strongly condemned Nassar and didn’t deny the positive comments she made about the since-convicted sexual abuser to Scripps affiliate WCPO in Cincinnati in December 2016. Tracy’s two-year-old comment sparked a controversy this week when Aly Raisman, an Olympic champion and Nassar survivor, went on Twitter and protested Tracy’s new national post as Elite Development Coordinator.As much as Tracy said she wanted the job, she also said she has received three “fairly threatening emails” and one that said she “should be in a jail cell next to Larry Nassar.” She has also been vilified on social media to the point that she has already told US Gymnastics she would not keep job if it means hurting her family.“What I feel I need to say is that when I saw Aly putting out some things about something I said two years ago as this was all coming out, that was my truth,” Tracy said about her 2016 comments about Nassar, the former national team doctor now accused of sexually assaulting up to 250 women and girls and serving up to 165 years in prison.“Larry had been treating my athletes for well over 25 years and had served them very well and had helped me and my athletes return to action," she said Thursday.  "He had been someone that we all unfortunately had trusted and depended on, so when I was asked about my experience with him, that’s what I said. So I’m not denying that I said that.“Would I say that anymore? Absolutely not … The man is a monster.  But at that moment, I looked at him like I would my dad or my brother. That was the level of trust I had.“But as we all find out, these people are that good. They are master manipulators. CHULA VISTA (CNS) - A Chula Vista church that challenged California's COVID-19 restrictions in a legal fight that went before the U.S. Supreme Court has filed an amended complaint in its bid to see churches reopened during the pandemic.South Bay United Pentecostal Church and its pastor, Arthur Hodges III, filed the new complaint last week in San Diego federal court, nearly two months after the U.S. Supreme Court ruled 5-4 to uphold COVID-19 restrictions placed on religious gatherings by Gov. Gavin Newsom.At the time, the church accused the state of arbitrarily allowing certain sectors considered essential to stay open, while discriminating against religious institutions, a move they claimed "intentionally denigrated California churches and pastors and people of faith by relegating them to third- class citizenship."California imposed restrictions this month on a number of indoor activities due to a spike in COVID-19 cases, and the church is seeking an injunction that will allow it to open under the same standards as other sectors when those businesses are allowed to reopen.This time, the church renews its objections while also taking aim at alleged favoritism toward the police protests that began in late May following the Memorial Day Minneapolis death of George Floyd."When the public sentiment began to favor race-based political protest instead of compliance with the pandemic restrictions, public officials were all too eager to grant a de facto exception for those favored protestors," the complaint states. "This favoritism has caused amazing harm in the form of a general loss of confidence by the American people in the merits of the pandemic restrictions at all."The church again says that a number of secular industries were allowed to reopen, while alleging they may have presented more of an infection risk than places of worship.It also takes issue with restrictions Newsom placed on churches when they were allowed to reopen, including attendance caps of 100 people or 25% occupancy, and prohibitions against singing indoors. The injunction South Bay United seeks would also prevent California from banning singing or chanting during worship services, or issuing any other "allegedly neutral ban...that clearly targets worship."As in its earlier filings, the church states that indoor services are needed for proper worship and that tele-conferenced or outdoor services are "inadequate substitutes."In the amended complaint, the church states its preference that "the entire congregation meet at once" and that placing capacity restrictions on services "would be like holding a family reunion in three sessions."In its allegations of discriminatory practices, the church alleges "ordering that `worshippers may not gather' is not different than -- and equally repugnant as -- ordering that `African-Americans may not gather' or `Chinese may not gather,"' in addition to comparing the restrictions on worship to "providing specific (mandatory) guidance for heterosexuals, homosexuals and other sexual minorities."The complaint also alleges the state's shutdown orders are too restrictive in the face of a "generally non-lethal disease."South Bay United's attorneys allege that death rates from COVID-19 are declining and that California's death rate "has largely stabilized."While California recently overtook New York as the state with the highest number of COVID-19 cases nationwide, and ranks fourth in total deaths, the church states California has the 30th-highest death rate in the nation, while also alleging that death rates in San Diego County have been low."In a society hostile to religion, banning worship might be justified to prevent deaths, but not common, flu-like symptoms," the complaint states.Both a San Diego federal judge and the U.S. 9th Circuit Court of Appeals rejected the church's challenges, leading to the U.S. Supreme Court's rejection in late May in a 5-4 decision.Chief Justice John G. Roberts wrote in an opinion denying the request that "Although California's guidelines place restrictions on places of worship, those restrictions appear consistent with the Free Exercise Clause of the First Amendment. Similar or more severe restrictions apply to comparable secular gatherings, including lectures, concerts, movie showings, spectator sports and theatrical performances, where large groups of people gather in close proximity for extended periods of time. And the order exempts or treats more leniently only dissimilar activities, such as operating grocery stores, banks and laundromats, in which people neither congregate in large groups nor remain in close proximity for extended periods."The majority opinion noted: "The precise question of when restrictions on particular social activities should be lifted during the pandemic is a dynamic and fact-intensive matter subject to reasonable disagreement. Our Constitution principally entrusts `[t]he safety and the health of the people' to the politically accountable officials of the states to guard and protect."Justice Brett M. Kavanaugh wrote the dissenting opinion joined by Justices Clarence Thomas and Neil M. Gorsuch."I would grant the church's requested temporary injunction because California's latest safety guidelines discriminate against places of worship and in favor of comparable secular businesses. Such discrimination violates the First Amendment," according to the opinion, which also noted that "comparable secular businesses" were not subject to occupancy caps. 5507

CHULA VISTA, Calif. (KGTV) — Four students at Montgomery High School were arrested Halloween Day during a state-mandated lockdown drill at school. The arrest is causing controversy, and many are now questioning the decision to carry out real arrests during a drill. It was a short 15-minute drill. No one in, no one out. “The whole school was on lockdown and everyone was in their classes. And we had to stay inside because cops came,” student Ernesto Miranda said. Police presence during a lock down is protocol. However, this time, four students were taken away in cuffs. Some are now criticizing San Diego Police officers’ unusual arrest strategy, accusing the department of suing the drill as a ruse to arrest the students under investigation. “It shouldn’t be, like use the lockdown as an excuse to OK, bust down these kids,” student Derek Uribe said. 10News spoke to Sweetwater Union High School District spokesman, Manny Rubio, who told us over the phone, this is the first time the district has ever agreed to cooperate in this kind of arrest. Montgomery High School’s state-mandated lockdown drill was planned for Tuesday, Nov. 13. But on Oct. 29, Rubio said SDPD requested the district to move the drill up sooner, because they urgently needed to make an arrest on campus. The school agreed. They immediately notified students and parents that there would be a drill sometime that week, before noon. Two days later, Rubio said the school carried out the drill. During the 15-minute drill, school stage brought each student in question into the office, where they were arrested by San Diego Police. Rubio said the school made sure to minimize the effects onto the 1,800 students and 100 staff, making the arrests away from classrooms. "I want to be a cop so I think it's smart to not make it a big deal and come in and everything. Just [during] a lockdown drill,” Miranda said. The police department, the school district, nor the District Attorney’s office would specify the exact charges the students face. But Rubio said they allegedly committed multiple violent crimes throughout the county that were, “incredibly severe in nature.”10News asked SDPD a number of questions, including why the students were not arrested at their homes, and why they waited two days before arresting them. (KGTV) -- Chula Vista’s next city manager will be the first Hispanic and first woman to serve in that role.Maria Kachadoorian, who has worked for the City of Chula Vista for 22 years, will move from her position as Assistant City Manager and take over for the retiring Gary Halbert.Halbert has served as the City Manager since 2014, and he has been with the city since 2008. He is set to retire on June 19.As the City Manager, Kachadoorian will be in charge of overseeing and maintaining the city’s budget. She will also “advance the Chula Vista Bayfront development, launch Ambulance Transport Services, and foster initiatives that better connect the City’s diverse communities.”In a statement, Chula Vista Mayor Mary Casillas Salas said of Kachadoorian: “Maria has the knowledge, skills and vision we need to move the City forward during these unprecedented times.
