SAN DIEGO (KGTV) - The San Diego City Council voted 6-3 Monday on an option for regulating marijuana use in San Diego, now that it is legal.Council members chose between two options. The first would have allowed testing of marijuana and marijuana products in labs in industrial and commercial zones that prohibit residential use.The second option, which passed, will allow testing plus cultivation, distribution and production of marijuana with a permit.  The activities will be allowed in light and heavy industrial zones.San Diego Police Chief Shelley Zimmerman urged the council to enforce option one with the strictest of controls.  The Chief cited the 11 current dispensaries as a public safety concern."We've fielded 273 radio calls from those establishments so far this year, everything from violent robberies to a shooting and those calls will increase," Zimmerman said. 911

SAN DIEGO (KGTV) - The San Diego City Council unanimously voted Tuesday to give final approval to place a measure on the November ballot that would change the city's police oversight structure.The current version is the Community Review Board; the ballot measure would replace it with a Committee on Police Practices."It is so desperately what the community wants and needs, so that we can build trust between the police department and the community," said Andrea St. Julian, co-chair of San Diegans for Justice, the group that wrote the ballot measure.The new committee would be appointed by the City Council, as opposed to the old board which was appointed by the mayor. The new committee would also have an independent lawyer and oversight from city staff not associated with the mayor's office or San Diego Police Department.St. Julian said these changes will help avoid conflicts of interest that the old board dealt with, especially because the CRB's lawyer was the City Attorney, who also acted as the lawyer for the police department.The new committee would also have broader power for investigations. It would be required to investigate any police shooting, as well as any time someone died while in police custody or while interacting with police.The committee could also investigate any other complaints against an officer and review all disciplinary action taken within the department."When a full investigation can be done by community members or at the direction of community members, people feel much more comfortable with the results," said St. Julian.Mayor Kevin Faulconer and County District Attorney Summer Stephan have both said they support the measure. SAN DIEGO (KGTV) - The trial started Wednesday for two San Diego County Sheriff’s deputies facing criminal charges after an arrest in Vista. Deputies Nicholas Morgan and Joshua Nahan are charged with assault for what District Attorney Summer Stephan calls illegal actions during the encounter. Gerardo Martinez Jr. and his father were taken into custody last May after the deputies responded to a domestic violence call. Part of the 911 call was played for jurors during opening statements Tuesday. The panel also saw cell phone video of the arrest recorded by a neighbor. The now-viral video shows Deputy Nahan push Martinez Sr. into a fence while handcuffed. Martinez Jr. was repeatedly struck in the head by Deputy Morgan while on a concrete sidewalk. “Law enforcement officers hold a position of trust in our community and are required to abide by the rules in the exercise of their powers. The evidence on which the charges are based shows the force used by the two deputies exceeded the legal line, violating that public trust. For justice to thrive, it is important that no one is above the law,” Stephan said in November. SAN DIEGO (KGTV) -- This year, the Drug Enforcement Administration is adding vaping products to the list of what they’ll accept on National Prescription Drug Take Back Day. The agency will be accepting prescriptions and vaping products on October 26 from 10 a.m. to 2 p.m. According to the agency, nearly 10 million Americans misused controlled prescription drugs in 2018. The Centers for Disease Control and Prevention reports that there have been 33 deaths in 24 states and nearly 1,500 lung injuries from vaping in 2019.The agency is treating the events like an outbreak, saying the best advice is to avoid using all forms of E-Cigarettes. The DEA decided to add vaping products to their drug take back event to make sure they're safely removed."If people throw them away, if people dump them down the toilet, if people store them in a drawer, they're still not safe," says DEA Special Agent in Charge Colin Roane."
