SAN DIEGO (KGTV) - Southcrest neighbors banned together to file a lawsuit against the City of San Diego, claiming a city park was not designed to properly drain and therefore floods the neighborhood each time it rains.Last December was the breaking point for neighbors near Southcrest Trails Park, at S. 37th Street and a dirt road behind houses situated on Beta Street. They say feet of water flooded into their homes."This actually becomes a sinkhole, this area," said Greg Montoya, who is leading the charge with his hefty binder full of decades of documentation of the problem. Montoya has pictures of his white pickup truck sunken rims-deep into his yard due to saturation.The lawsuit describes it as "a 66-acre, 1.2-mile corridor in the Southcrest neighborhood of San Diego to construct Highway 252, which would connect Interstate 805 and lnterstates 5 and 15."The project never materialized, Montoya says, because St. Jude, thinking of the school, put up a fight."So then the City of San Diego put dirt berms in to keep people from driving back here, to keep people from throwing trash back here, because it became a dump," Montoya said. The park took shape in 2003, according to the lawsuit.Montoya and other neighbors say there was not enough drainage put in, sending water running down the five-foot berm every time it rains.A storm in December 2018 left many stranded, including Ricky Vasquez, who was trying to pick up his one-year-old son."Other cars were stuck in the middle of the street because the water was so high," said Vasquez.Neighbor Pastor Nicolas Martinez said his home flooded, ultimately costing ,000.Montoya was fed up."San Diego's America's Finest City for some but not for all because I've got documentation for over 30 years for asking for help for this situation that they've created and I'm just ignored," said Montoya.He went to attorney Evan Walker, who said his team found one of the two storm drains at the park "is not connected to any sort of system despite the city's own plans to connect them to the system."Montoya hopes the lawsuit causes the city to step up.10News reached out to the City of San Diego who said they could not comment on ongoing litigation. 2211

Cathedral Catholic High School in Carmel Valley announced Friday girls would no longer be allowed to wear skirts. That led to a backlash among students, who signed a petition to reverse the change. “I think that the ban is very sexist,” said student Lana Owad. In a letter sent to parents and students, CCHS said the dress code exists to foster a faith-based environment where students are focused on learning and not outward appearances. CCHS has issued thousands of hours of detention related to the lengths of girls’ skirts. The school dress code posted online indicates girls were allowed to wear skirts or skorts that were not excessively tight or form fitting and were no shorter than 3 inches from the top of the kneecap while standing upright.“We’ve had them tailored in the past because of the restriction on it. We spent money on buying different skirts because they ban other styles for us to wear,” said student Riley Staal. Mimi Cleary said the change was prompted by adults, not students. “No one wants the skirts going, like, literally, no one wants the skirts gone. I think only the principal and teachers want the skirts gone,” said Cleary. Under the new dress code, girls can wear pants, Bermuda shorts, or capri pants. The school said girls aren't the only ones having dress code problems: the administration will also be holding boys more accountable about their facial hair next year. SAN DIEGO (KGTV) - Some San Diego fitness studios and hotels are getting creative by working together.F45 Training San Diego East Village and the Hard Rock Hotel San Diego are partnering to offer outdoor fitness classes this weekend.George Chmiel, the F45 studio owner, said that when they heard about the new public health orders to shut down more indoor spaces, they immediately looked for outdoor space.Meanwhile, the nearby Hard Rock Hotel San Diego has an 8,700 square foot rooftop terrace that's sitting empty. It's typically used for events and parties, but none are happening due to the pandemic. The hotel has allowed F45 to use the space without charge."Two industries that have been hurt by this current situation we're going through, are the hospitality and fitness industries," said Rana Kay, the director of communications at the Hard Rock Hotel San Diego. "We feel the pain at the gyms when they were recently shut down once again.""I think it's a great collaboration of businesses that have just gotten kicked in the face to find a unique way to weather the storm and potentially grow through this," Chmiel said.Chmiel says the plan is to hold one class on Saturdays and Sundays, and two classes on the weekdays.Kay says it could also benefit their guests. They hope people staying at the hotel will eventually take part in the classes as an option because fitness areas in the hotel are currently closed.Hapa Yoga & Fitness in Mission Valley says they have also turned to hotels since their indoor studio space closed. SAN DIEGO (KGTV) -- San Diego State University says 400 students have confirmed and probable cases of coronavirus.The university said Tuesday that, since August 24, 396 students have tested positive for COVID-19. Four other students have probable cases of the virus.The update comes one day after the school extended its stay-at-home order for on-campus residents through September 14.
