Another federal judge has overruled the Trump administration's efforts to end a popular immigration program -- this time saying the government has to accept new applications.The ruling on the Deferred Action for Childhood Arrivals program, however, won't take immediate effect, with the judge delaying the ruling for 90 days to allow the administration to make its case.Similar to the other rulings, Judge John Bates concluded that the wind-down of DACA was "arbitrary and capricious" because the Department of Homeland Security failed to "adequately explain its conclusion that the program was unlawful." The judge also accused the government of providing "meager legal reasoning" to support its decision.A George W. Bush appointee to the US District Court for the District of Columbia, Bates delayed the effect of his ruling "to allow the agency an opportunity to better explain its rescission."The DACA program, which protects young undocumented immigrants who came to the US as children, has already been resumed after President Donald Trump sought to end it in September, after two federal judges issued nationwide rulings to accept renewals of the two-year permits issued by the program and after the Supreme Court declined to circumvent the appeals process to overturn those decisions.But while the Department of Homeland Security has been processing renewal applications under those rulings, as the appeals make their way through the courts, Tuesday's ruling was the first to order the program to resume accepting new applications -- potentially opening the program to tens of thousands more immigrants than the roughly 700,000 currently protected.In September, the administration defended ending the program by saying it was likely to fall in the courts anyway, arguing a six-month wind-down of the program would be more orderly than a sudden end brought by the courts. An eruption from the Kilauea volcano's summit shot ash and smoke into the air early Thursday on Hawaii's Big Island, and the resulting plume is expected to cover the surrounding area, according to the Hawaiian Volcano Observatory.Nearby residents are being asked to shelter in place if they are in the path of the ash plume, which the wind is carrying to the southeast of the volcano."Driving conditions may be dangerous so if you are driving pull off the road and wait until visibility improves," an alert from the observatory warned.Thursday's eruption is just the latest volcanic activity contributing to the nightmare on the Big Island since the volcano first went off May 3.An ash plume Wednesday rose roughly 12,000 feet into the air, and on Tuesday, the US Geological Survey issued a red alert, which means a major eruption is imminent or underway and ash could affect air traffic.It is not clear if this was a phreatic eruption, which US Geological Survey officials have been saying is capable of sending ash plumes as far as 12 miles away from the summit.These are steam-driven explosions that occur when water beneath the ground or on the surface is heated by magma, lava, hot rocks or new volcanic deposits, the USGS says. The intense heat may cause that water to boil and result in eruptions.The lava lake in the crater has been dropping since May 2, which increases the chances for a phreatic explosion, but it will be difficult to warn residents who may be in the path of such an eruption.Phreatic eruptions are "notoriously hard to forecast, and can occur with little or no warning," Hawaiian Volcano Observatory geologist Janet Babb said.While the ash being launched into the sky is not poisonous, Hawaii County officials have warned residents about toxic sulfur dioxide seeping out of 21 fissures caused by the volcano."Severe conditions may exist such as choking and inability to breathe," the county's Civil Defense Agency said Wednesday. An Ohio woman is filing a lawsuit against the Montgomery County Jail claiming excessive force was used against her.Marsha Pate-Strickland is suing the Montgomery county jail for this video-tapped incident.It happened back in 2015.Pate-Strickland says it all began when she asked a corrections officer at the jail if she could exchange her juice for milk.In the video, you can see the officer grab her and slam her to the floor.Pate-Strickland said she complained that her arm and shoulder were injured. But she refused medical attention.Now she claims she has permanent and debilitating injuries.Officials with the Montgomery County jail have not commented on the lawsuit. 710
