PONTIAC, Mich. (WXYZ) — An Oakland County, Michigan, judge ruled Monday to keep a high school sophomore in detention after violating probation by failing to complete online school work. The Oakland County Children’s Village TAG program provides several forms of therapy, counseling and educational support, but defense attorneys argue it is not an appropriate legal action.Judge Mary Ellen Brennan says she had to consider the actions that placed Grace on probation to begin with. Last fall, arguments between the teen and her mother turned violent. The judge says the mother was the victim and the daughter the aggressor.“How many times does she get to jump her mom before she’s a threat? How many times?” Judge Brennan said.“That is not the question in front of the court,” Defense Attorney Saima Khalil responded.“That’s the question I’m asking you. How many times?” said Judge Brennan.Fifteen-year-old Grace's story has gained national attention. She was placed in juvenile detention in June after violating probation by failing to complete online school assignments in May. The judge says the teen's mother repeatedly called a case worker for help.During court proceedings Monday, the defense pointed out that a lot of students struggled with virtual classwork, but the judge says Grace's mom was the one who made repeated calls to the case worker saying her daughter refused to get out of bed, wouldn't do her school work and needed help.Khalil and fellow defense attorney Jon Beirnet went head-to-head with Judge Brennan, who continued to bring up the original violation for Grace, which included physical altercations with her mother last fall."The probation violation had nothing to do with a violent act. There is no tampering of a GPS tether," a defense lawyer stated.That probation violation put the high school sophomore in juvenile detention during a pandemic.Grace attends Birmingham Groves High School, where she receives support for ADHD. Grace's school closed in March like everything else when Gov. Gretchen Whitmer issued a stay-home order.When classwork was made available online, Grace's attorney says it wasn't required. There was no academic or classroom consequence. Judge Brennan said Grace's mother had repeatedly called the case worker for help.Outside the courtroom, demonstrators demanded Grace's release."We must dismantle the school to prison pipeline," said Tylene Henry with Michigan Liberation Action Fund.The action fund is asking for support, not punishment.In the courtroom, Grace spoke before the judge."Each day I try to be a better person than I was the last," the teen said. "And I’ve been doing that since even before I was in this situation. And I’m getting behind in my actual schooling while here. The schooling here is beneath my level of education."Judge Brennan insisted Grace should continue in the detention program, which offers therapy while her mother takes parenting classes."The goal is you and mom safe healthy and happy in the home, we disagree about what that looks like," The judge said. "To get to that goal... you think you’re ready, I think you’re not. I think you’re exactly where you’re supposed to be; you're blooming there."There was another motion filed by the defense attorneys. PORTLAND, OR (KPTV) -- A man who bit a teen girl at a Green Day concert in Portland pleaded no contest to harassment and was sentenced to one month in jail.Joel Brian Dauncey, 34, of Vancouver, British Columbia, entered his no contest plea in court Monday. An additional charge of third-degree sex abuse was dismissed as part of his plea agreement.Dauncey was arrested last month following the Green Day concert at the Moda Center.Court documents state the 14-year-old victim was with her mother, who was on her left, with Dauncey on her right.The girl said she was dancing when Dauncey leaned over and bit her on her right breast, according to a probable cause affidavit.The affidavit states an employee working at the concert witnessed the bite and said Dauncey had been cut off from buying alcohol due to his behavior.Along with one month in jail, Dauncey was sentenced to 11 months probation and ordered to have no future contact with the victim.The-CNN-Wire 970

Pope Francis has declared that the death penalty is never admissible and that the Catholic Church will work towards its abolition around the world, the Vatican formally announced Thursday.The change, which has been added to the Catechism of the Catholic Church, makes official a position that the Pope has articulated since he became pontiff.The Church now teaches that "the death penalty is inadmissible because it is an attack on the inviolability and dignity of the person" and states that it will "work with determination towards its abolition worldwide," the Vatican said.The Catholic Church's teaching on the death penalty has been slowly evolving since the time of Pope John Paul II, who served from 1978 to 2005.In his Christmas message in 1998, he wished "the world the consensus concerning the need for urgent and adequate measures ... to end the death penalty."His successor Benedict XVI, in a document published in November 2011, called on society's leaders "to make every effort to eliminate the death penalty."Francis then wrote in a letter to the President of the International Commission Against the Death Penalty in March 2015 that "today capital punishment is unacceptable, however serious the condemned's crime may have been."He added that the death penalty "entails cruel, inhumane and degrading treatment" and said it was to be rejected "due to the defective selectivity of the criminal justice system and in the face of the possibility of judicial error."Vatican spokesman Greg Burke told CNN that the change was important but should not come as a surprise."It was expected for a long time starting with John Paul II," he said. President Donald Trump provided an update to the White House’s response to the coronavirus pandemic at a news conference on Wednesday.While coronavirus deaths are on the rise, cases appear to be leveling off. On Tuesday, there were 1,399 coronavirus-related deaths reported, according to Johns Hopkins University figures.While the positivity rate has dropped off slightly in recent days (from 8.6% to 8.3%), some public health experts are baffled by a drop in testing. Data indicates that fewer Americans are being tested for the virus. Part of the reason could be due to delays in getting results.Johns Hopkins University data indicates that 28 states saw a decline in testing. Among the states seeing declines in testing are Florida, Mississippi, Georgia and Arkansas, which are seeing higher positivity rates compared to the rest of the US. Only eight states have ramped up testing, according to the data.Despite the drop in testing, the White House has said that the US has “created the best COVID-19 testing system in the world.”“The United States also has far and away the most robust testing capacity in the world,” Trump said on Tuesday. “Testing has been incredible, what we’ve been able to do. Nobody is even close. Since March 12th, we’ve increased daily testing by 32,000 percent. How’s that?”While public health experts suggest that more tests would lead to a lower positivity rate, America’s positivity rate remains much higher than a number of developed nations, including Canada, Spain, Germany and Italy. President Donald Trump has pardoned prisoner activist Jon Ponder, who spent time in prison for bank robbery. Ponder’s pardon aired during the Republican National Convention Tuesday evening.Ponder has become an activist for prisoners and helping those behind bars return to normal life upon release. Ponder has helmed the Las Vegas-based organization HOPE for Prisoners for the last 15 years.Richard Beasley, a retired FBI agent who arrested Ponder, stood alongside Trump and Ponder during the pardon.Trump has previously been involved with HOPE for Prisoners.
