SAN DIEGO (KGTV) - Cesar Rivera thought he'd achieved the American Dream when he and his wife bought a house just north of Mission Valley. "I moved in, I loved the area, I loved my neighbors," he says. "I want my boys to have this house when we grow old."But whether Rivera's family will last in long enough in the area remains to be seen. These days, Rivera is on anxiety medication. He says it's because of the home next door that became a vacation rental shortly after he moved in. He says it can rage any night of the week. "They go on arguing and yelling, and they're out there for hours," Rivera said. "They don't stop. He also says the owner, Lael Volage, is not responsive: a claim she vehemently disputes. At any rate, it's exactly the situation the City Council aimed to avoid when it passed strict regulations in 2018. The rules would have limited vacation rentals to primary homes and structures on the same parcel. The rules also would have required many hosts to pay a 5 fee to fund a new enforcement division that would have worked evenings and weekends. But Airbnb led a successful referendum, and the council rescinded the law. "It's a free-for-all," said Volage. "Nobody wants a party at their house. We try to regulate it. Clients' temperatures are taken. Their hands are sanitized. Their personal effects are placed in a bag. In another bag is everything needed for their appointment, from combs to scissors."So they can feel comfortable that when they sit down, everything has been sanitized for them," said Gila Rut President Keri Davis-Duffy.Inside the salon: masks, social distancing, and capes disposed of after each appointment. The owners are intent on protecting clients, staff and also, the business. A day head of an appointment, clients are emailed a waiver."They have to sign a waiver releasing Gila Rut of any liability should anybody contract COVID-19," said David-Duffy.Davis-Duffy is hardly alone. At the Point Loma Sports Club, set to open Friday, a liability waiver is also required before you can enter. Across the county and country, at salons, gyms, offices and even the New York Stock Exchange, waivers are quietly becoming the new normal. It's unclear how much they're really needed. Attorneys tell us it would be hard to prove a business caused an illness. and the waivers don't protect a business against 'gross neglience.'"If someone signs a waiver, that means they agree not to hold someone else responsible for any damages. What we're seeing here are businesses trying to avoid liability when a patron is exposed to covid-19 at their place of business. Waivers are not, however, ironclad. For a business to be protected, the business must show that such a waiver was signed and that it covers the potential claim. Even if a business shows that, a waiver is invalid if the business was grossly negligent or reckless. Also, a person could challenge a waiver by claiming it was signed under duress or that it was unconscionable," said attorney Evan Walker.For Davis-Duffy, the waiver is simply another precaution."We're in a vulnerable business ... SAN DIEGO (KGTV) -- County health officials are notifying people who may have been exposed to tuberculosis at locations throughout San Diego County. According to County News Center, three unrelated cases of the disease were reported in San Diego County between August 20 and October 18. Two of the cases were reported at San Diego County Sheriff’s detention facilities. Investigators believe the individual arrived in San Diego after leaving a Long Beach hospital without permission. He's worried hospitals could be overwhelmed if we don't stop the rapid spread of the virus."This rapid rate of rise could be even higher if we don't act soon," Dr. Erica Pan, state epidemiologist and deputy director of the California Department of Public Health Center for Infectious Diseases, said.Pan added that we could have a higher spike than we saw over the summer.Many are taking their words to heart and stocked up to stay home. San Diegans saw empty shelves and product limits this week across the county, but officials urge consumers not to worry."We didn't put limits on early enough.
