President Donald Trump is expected to grant new authority to US troops on the Southwest border with Mexico to protect Customs and Border Protection personnel from migrants if they engage in violence, according to two defense officials and another US official directly familiar with the plans. An additional administration official tells CNN that the authority will also authorize protection of federal property.Currently troops do not have any authorities that would allow them to intervene if CBP personnel came under attack unless they need to act in their own self-defense.There are 5,800 to 5,900 troops assigned to the border mission.The move could be announced as soon as Monday evening, officials said. The mission will be characterized solely as "protection of CBP" personnel, according to the administration official.This comes as Department of Homeland Security officials said Monday that they had started to get information from "multiple sources including individuals in the Mexican government" of potential waves or groups of individuals who were discussing an incursion into legal ports of entry in California by attempting to pass through vehicle lanes.Any potential use of force by US troops to protect CBP personnel must be "proportional," the official said.It is expected the Pentagon and US Northern Command will amend the current document detailing the rules governing the "use of force" on the border mission.All three officials are adamant that the change is not abfut troops firing weapons at migrants crossing the border. Instead the new rules will be aimed at providing the basic authorities to allow for protective measures. Previously troops did not have any authorities that would allow them to intervene if CBP personnel came attack.The Pentagon has been working for the last several days on options for how troops can protect CBP.The defense officials are also emphasizing that National Guard forces activated by governors, as well as state and local civilian law enforcement authorities in a given area, should be relied upon as much as possible.DHS spokesperson Katie Waldman told CNN, "As Secretary Nielsen has said, we will not allow our frontline personnel to be in harm's way. We will do everything we can to protect those who defend our nation's sovereignty and secure our border. We appreciate the Department of Defense stepping in to assist the Department of Homeland Security as needed."The White House did not immediately respond to CNN's request for comment.Last week while visiting troops along the Texas border, Secretary of Defense Jim Mattis said CBP is doing "all the work, but we're standing behind them as a confidence builder," referring to the request from the Department of Homeland Security to provide support.More than 2,000 Central American migrants arrived in the border city of Tijuana in recent days, and about 3,000 more migrants are estimated to be in Mexicali, Mexico, another border city about 100 miles away, a United Nations High Commissioner for Refugees spokeswoman told CNN.As CNN has previously reported, the Department of Homeland Security originally asked the Pentagon to provide protection for CBP but that request was turned down by Mattis because it was deemed by the Pentagon to be asking troops to perform law enforcement duties that needed to be directly approved by President Trump. At the time of the original request, the Defense Department said that if Homeland Security officials still wanted troops to perform a protection role, they should ask the White House to formally grant the Pentagon the authorities to perform those additional functions.At the outset the troops were assigned to provide assistance to Customs and Border Protection including engineering support with building temporary barriers, barricades and fencing, providing aviation support to move US Customs and Border Protection personnel, providing medical teams to triage, treat and prepare for commercial transport of patients and constructing temporary housing and personal protective equipment for CBP personnel.Last week CNN reported that the US troops on the Texas border with Mexico were close to finishing their assigned task of reinforcing border crossing points, largely with concertina wire. 4260

President Donald Trump gave his final Thanksgiving address to troops before President-elect Joe Biden takes office in January. After addressing service members, Trump answered questions for the first time since his November 3 election defeat, saying that it would be a “mistake” if the Electoral College votes for Biden next month.“This election was a fraud,” Trump claimed.Two weeks ago, a joint statement released by federal and state officials described the presidential election as the “most secure in American history.”The letter was signed by leaders of the Department of Homeland Security’s Cybersecurity and Infrastructure Security Agency, the U.S. Election Assistance Commission and the National Association of State Election Directors, among others. The Cybersecurity and Infrastructure Security Agency was established two years ago as a branch of Homeland Security during the Trump administration.In bold, the authors of the statement wrote, “There is no evidence that any voting system deleted or lost votes, changed votes, or was in any way compromised.” This statement matches those from secretaries of state and boards of election throughout the US.In response to the letter, Trump fired US election security head Chris Krebs.Biden is slated to send 306 electors on his behalf to state capitols on December 4, 36 more than the 270 needed to become president on January 20. Trump has been trying to stop Biden’s electors from casting a vote by whatever means possible. After more than three dozen failed legal challenges since the election, Trump has been meeting with state legislative leaders, most recently on Wednesday with Republican members of the Pennsylvania legislature.“I know one thing, Joe Biden did not get 80 million votes,” Trump claimed, even though the overwhelming majority of his legal team’s lawsuits have been thrown out.Trump again expressed frustration over “dumps” of votes. The result was Trump built up massive leads based off those who voted Election Day, but the overwhelmingly Democratic mail-in votes, which were processed in the days after the election, were enough to tilt the two key states in Biden’s favor.Another state Trump is contesting the results of is Georgia, which elected a Democratic nominee for the first time since Bill Clinton. Trump said he is going to hold a rally in Georgia on Saturday night, but the details of where are still unknown.Trump was asked if he would attend Biden’s inauguration. He said he knew the answer but would not say whether he would or not. It has been a long-standing tradition that the incoming and outgoing president meet at the White House and travel to the Capitol together before the inauguration.Trump said, “certainly I will, you know that,” when asked if he would leave the White House on January 20.The president criticized Biden for beginning to fill out his prospective cabinet before taking office. But Trump as president-elect had named his UN ambassador and secretary of education nominees on the day before Thanksgiving in 2016. President Donald Trump plans to announce his Supreme Court nominee on Saturday. He has said it will be a woman and she will be conservative.If the nominee goes through, it would give conservative justices a 6-3 majority over their more liberal counterparts.That sets up talk about abortion, but the Roe v. Wade debate isn't all about the Supreme Court.“Enough lower courts have not decided what they think about this,” said Carol Sanger, a professor at the Columbia law school. “We, the Supreme Court, doesn't like to lead on a particular issue until the lower courts who have trials and so on have thought about it.”Under a conservative majority, the Supreme Court has ruled on an abortion case. Conservative Chief Justice John Roberts sided with a ruling that kept abortion clinics open by not requiring abortion doctors to have nearby hospital admitting privileges.The high court already ruled on a similar case out of Texas.“There is a special doctrine called stare decisis, which means when you have a case and it’s like a previous case, look to that previous case and say how did that come out,” said Sanger. “And unless there is a very, very strong reason to change that decision, you follow precedent, you follow what happened the last time this issue came up.”Sanger says enough lower courts have to rule and be split on the decision to make it to the Supreme Court.The Supreme Court would need to decide it wants to take up Roe v. Wade before courts before them. Sanger believes that's unlikely to happen.“It seems pretty clear that he doesn't want to be known as the guy who had Roe knocked out under his chief justice-ship,” said Sanger.Both Justices Kavanaugh and Gorsuch said they accepted Roe v. Wade as the law of the land during their nomination hearings.Sanger says just because the justices on the court change, it doesn't mean they change laws all over again. 1887
