ENCINITAS, Calif. (KGTV) -- The San Diego Sheriff's Office is investigating an incident involving Phil Graham, a candidate to represent the 76th district in the California Assembly. Niki Burgan filed the battery case with the Sheriff's Office Sunday, May 20. She accuses Graham of forcibly kissing her at an Encinitas Bar. Burgan told 10News that it happened at 1st Street Bar on S. Coast Hwy 101 on the evening of Sunday, May 13, into the early morning of Monday, May 14 as the bar was closing. She said that Graham had initially been flirting, even mentioning that he was running for office and asked whether she would vote for him. After finding out that he was a Republican candidate she said, no she was a Democrat. At some point, she says his talk turned into aggression and Graham grabbed her hair, pulled her in, and started to kiss her. She said she had to push him off. Burgan also said she remembers that Graham had so much to drink that night that she had to help him sign his tab. The next morning Burgan says she learned that he was related to former Governor Pete Wilson and she was worried about repercussions. That's why she didn't file right charges right away. 1259

FALLBROOK, Calif. (KGTV) - A motorcyclist suffered life-threatening injuries Friday when a tree fell on him during a period of high winds in Fallbrook.The tree that injured the motorcycle rider fell on South Mission Road and West Elder Street, according to North County Fire. The unidentified man was flown to Palomar Hospital. Another tree fell at De Luz Road and Patton Oaks Friday afternoon, shutting down De Luz for about two hours. San Diego County Roads crews assisted firefighters in clearing the street. Faculty members at Lehigh University have voted overwhelmingly in favor of rescinding President Donald Trump's honorary degree.Trump was presented with the honorary degree in 1988, when he was chosen by the graduating class as commencement speaker. It was standard for all commencement speakers to be given honorary diplomas at that time, Lehigh spokesperson Lori Friedman told CNN.More than 80% of voting-eligible faculty affirmed the?motion asking that the Pennsylvania college's Board of Trustees revoke the honor. Only 14% voted against the motion. It will now be conveyed to the board, according to Faculty Steering Committee Chair Doug Mahoney.Dr. Michael Raposa, who helped to draft the motion, told CNN that it was intended to reflect that faculty members "don't want Lehigh to be identified with the kind of sexist, racist, and Islamophobic utterances" he says the President has made. The motion was not meant to serve as a comment on Trump's political views or positions, he said."We did not want this to be a debate about politics," he said.Raposa told CNN he felt the results of the vote represented the "clearly articulated voice of the faculty."The faculty motion was preceded by two petitions, including an online one?that garnered more than 30,000 signatures. FALLBROOK, Calif. (KGTV) -- A tortoise is recovering after falling 10 feet from a wall Sunday, cracking its shell.The tortoise was found by a good Samaritan after falling from a 10-foot wall while being chased by a dog, according to the County News Center.The 70-pound tortoise was taken to a veterinary hospital where animal services were called.Officials say that’s when they learned it would cost several thousand dollars to fix the 35 to 40-year-old tortoise.“We have a donor-driven Spirit fund that we can use for severe medical cases such as this one,” said County Animal Services Director Dan DeSousa. “This tortoise will get the extensive, aggressive care and long-term observation that he needs to regain his health and hopefully live to a great, old age.”The tortoise underwent surgery Tuesday, where veterinarians put screws into the shell then used ties on the screws to hold the broken pieces together.Veterinarians then used the same paste material that dentures are made from to seal the cracks.For more information or to donate to the Spirit fund, click here. 1098
