SAN DIEGO (KGTV) -- An exclusive ABC 10News/San Diego Union-Tribune poll shows many City of San Diego voters are still undecided on some important races this November.The poll was conducted by SurveyUSA from Aug. 28-31, five weeks before mail-in voting begins.According to the poll, one of the closest races is for San Diego mayor, as both Democratic candidates -- City Councilwoman Barbara Bry and Assemblyman Todd Gloria -- are within a few percentage points of each other.The poll shows Bry ahead of Gloria 37 percent to 34 percent, with 29 percent undecided.Political analyst Kyra Greene told ABC 10News, “At this point in an election cycle, you would fully expect there would be more differentiation between the two candidates, but I think it’s a tough year because campaigns aren’t able to get out, talk to voters, so there are just a lot more people who are undecided.”Gloria’s campaign representatives said of the poll: “Our campaign has completed two polls recently and both show Todd with a double-digit lead. We are confident in their accuracy and will continue to run a campaign that focuses on finding solutions to the big issues facing San Diego."Bry’s campaign responded: “These results illustrate the dramatic shift in momentum since the March primary, when Assemblyman Gloria received 41 percent of the vote compared to Councilmember Bry's 23 percent.”In the race for San Diego City Attorney, the latest poll shows at least half of San Diego voters are undecided, but incumbent Mara Elliott leads challenger Cory Briggs by 10 percent.Several key ballot measures are set to be decided on Nov. 3, including Measure E and Measure B.Measure E would change the existing height limit on buildings in San Diego’s Midway District.The latest poll numbers are close -- 31 percent in favor of the measure -- but Greene said past voter trends could be an indicator.“The most common thing if people are not sure is they vote against the measure, which makes sense. SAN DIEGO (KGTV) - Across the state of California, there were more than 10,000 sexual harassment offenses, as defined by California education code that resulted in suspension, expulsion or disciplinary diversion.A San Diego mother says her daughter was bullied and sexually harassed at school.“She said that he would take her pencils from her,” said Myiesha Jackson. “If she tried to get them back he would stick them down his pants."Jackson claims the male student didn’t stop there. She claims he took Play-Doh, made it into the shape of a penis and rubbed it on her daughter while making inappropriate sounds."I consider that sexual harassment,” said Jackson. An investigation report Jackson gave to Team 10 says the accused student admitted to rolling up the Play-Doh and holding it up while singing an inappropriate song that was sexual in nature, and the Play-Doh represented a male genitalia part, but the other student denied touching her with it.At the end of the report, it lists an action play, basically separating both students at all points of the day so they wouldn’t come into contact with each other.Jackson says that’s not what happened."The very day I brought her back she was in lunch, the line to get lunch, and they let him out of the office apparently, and he went and stood directly behind her,” she said.Magnolia Science Academy- San Diego denied 10News’ request for an interview.In an emailed statement an attorney for Magnolia Public Schools wrote:“State and federal student confidentiality laws and our organization's policy prohibit MSA-SD from commenting on specific students or incidents in which they may be involved. SAN DIEGO (KGTV) - An off-ramp drivers have used for decades to exit the northbound state Route 163 onto Friars Road is gone for good.On Wednesday, Caltrans permanently closed the off-ramp that leads from northbound SR-163 to eastbound Friars Road. The exit provides direct access onto eastbound Friars Road, with a straight shot to SDCCU stadium and the thousands of homes being built that direction. It also gets drivers away from the traffic heading toward the Fashion Valley Mall. 493

SAN DIEGO (KGTV) -- A well-known San Diego restaurant plans to close for good this July. Gordon Biersch Brewery Restaurant will close its Mission Valley restaurant on July 16, 2019, according to paperwork filed by the company. Although no reason was given for the closure, 79 employees are expected to lose their jobs. The layoff notice was filed by the company on June 5 and says, in part, that the company will “continue the employment of all employees through the sixtieth day after the date of this notice, and all employees will be paid your regular wages and benefits through that date.”The brewery and restaurant first opened in 1988 in Palo Alto before expanding in 1999. Gordon Biersch currently operates 35 restaurants in the U.S., though it’s unclear if any other locations plan to close. 808

SAN DIEGO (KGTV) -- A San Diego-based financial investment advisor is being accused of running a Ponzi scheme targeting mostly elderly victims who planning for retirement, and taking more than million, according to bankruptcy court records.Sharon and David Vega said they started working with Christopher Dougherty about 17 years ago. A few years ago, Sharon Vega said that he recommended to take money “out of the TD Ameritrade and place it in private placement in farm subsidy accounts.”The Vegas trusted him and placed approximately ,000 in these new accounts. They said they continued to receive statements showing how their money was doing, but they started to see red flags. Sharon Vega said when checks bounced, Dougherty gave various excuses.She showed Team 10 one bounced check where Dougherty claimed “there was a mix-up at the bank.” They decided to sever ties and asked for their money back.“He said no problem, he would start on it right away,” Sharon Vega said. However, she said that did not happen. She showed Team 10 several text messages from Dougherty late August into early September promising their money. One message said the transfer was “already in motion. Should see it shortly.”“We have not received any funds back. He filed bankruptcy and he’s trying to have ours discharged with many other people’s,” Vega said. She said the ,000 was money they had been saving to try and help their grandchildren with college.In bankruptcy court documents, the United States Trustee wrote Dougherty’s “deception is the basis of a Ponzi scheme.”“[Their] practice of using new investment money to pay existing investors dividends and principal gave the false impression that the payments received by investors came from earnings and profits or from a return of their principal,” the documents said. “It’s devastating,” said Jerry, another former client of Dougherty. He and his wife declined to use their last name.Jerry and his wife Diane told Team 10 they invested more than million with Dougherty over the years. At first, it was with traditional accounts. They said he later convinced them to invest in an Alpine farm. They thought they were diversifying their retirement money, but what they know now is everything they saved for is gone and what happened to their funds is unclear. Like Sharon and David Vega, they said Dougherty kept sending them statements.“We rely upon our children now,” Jerry said. “We can’t even afford a burial plot.”In 2011, Dougherty was charged for stealing money from a youth baseball league. He was ultimately sentenced to three years summary probation, according to the District Attorney’s Office. Team 10 attempted to contact Dougherty and his wife, Nereida, who is also named in the bankruptcy documents. They did not respond. An attorney for the Doughertys also did not respond to Team 10’s inquiries. Investigator Melissa Mecija visited the Alpine ranch connected to the couple, where a tenant said his power has been shut off three times in the last several months. It was a bill he said the Doughertys were supposed to pay. Sharon Vega said she tries to stay strong as she deals with multiple setbacks, including her husband’s larynx cancer. “He was diagnosed… when all of this happened,” she said. Lt. Kevin Menzies with the Sheriff’s Department confirmed there is an open investigation, with ten alleged victims currently identified.The Securities and Exchange Commission also has an open investigation into Dougherty. 3493
