SAN DIEGO (KGTV) - The former Navy sailor accused of killing four people by driving his truck off the Coronado Bridge and onto a crowd attended a motions hearing Friday.Richard Sepolio faces four counts of gross vehicular manslaughter and DUI. His defense team argued to throw out the DUI charge, as well as crucial evidence, including initial conversations between Sepolio and his arresting officers. The judge concluded that both issues would be allowed in the upcoming trial.The nephew of two of the victims wants answers. He believed Sepolio was attempting to fake the test by only pretending to breathe small amounts of air into the device. Officer Jimenez remembered that Sepolio’s speech was indeed slurred and that he was complaining of back pain. SAN DIEGO (KGTV) - The Barrio Logan College Institute is moving into a newer, bigger location, thanks to the generosity of an area businessman.Nicholas Aguilera, who's father started Diego and Son Printing in 1972, is letting the BLCI lease the company's old building for 20 years, with an option to buy."I think it's awesome, it's fantastic," Aguilera says. "I think my dad would be very, very happy and proud."Aguilera says his father always wanted the business to be part of the community. Turning it's original location into an educational site fits with Diego's vision and passion for improving the Barrio."I see a future for our students," says BLCI Interim CEO Barbara Ybarra.The Institute works with kids from the 3rd grade through high school. It helps mentor them as they try to become the first person in their family to go to college. Ybarra says 100% of the students that complete the program go to college.The new building will allow the BLCI to serve even more students."These upgrades are going to help them compete technologically with the other students they're competing against to get into college," says Ybarra.She also says there's symmetry in taking over the old printing building."Diego used to print notebooks and pads of paper for the students to use and take to school," she says. SAN DIEGO (KGTV) - The federal watchdog agency that aims to protect consumers from unfair, deceptive, or abusive practices is suing a San Diego-based company.On Tuesday, the Consumer Financial Protection Bureau (CFPB) sued Encore Capital Group and its subsidiaries, claiming they violated the terms of a 2015 legal agreement.The CFPB claims, “Since September 2015, Encore and its subsidiaries violated the consent order by suing consumers without possessing required documentation, using law firms and an internal legal department to engage in collection efforts without providing required disclosures, and failing to provide consumers with required loan documentation after consumers requested it.”The lawsuit says after the effective date of the consent order, “Encore filed more than 100 lawsuits to collect consumer debts after the applicable statutes of limitations had expired."The lawsuit also claims Encore failed to disclose that consumers might incur international-transaction fees.In response to the lawsuit, the company's Executive Vice President, General Counsel, and Chief Administrative Officer Greg Call said Encore is built on a foundation of treating their consumers fairly and respectfully."We are disappointed that the CFPB has chosen to file this lawsuit on outdated issues, but we will continue to engage with the CFPB and work to ensure that we maintain policies and practices that fully comply with all applicable legal requirements. We believe that there will be no material operational impact as a result of the suit," said Call. SAN DIEGO (KGTV) — The man accused of fatally stabbing a motorist seven times in the South Bay during a road rage dispute was convicted of second-degree murder Friday.Jurors found Rickey Vernon Smith, 60, guilty after only one day of deliberations in the Nov. 27, 2018, slaying of 36-year-old Horace Williams Jr.Smith is set to be sentenced on Dec. 11.RELATED: Local man brings families light in times of needThe road rage confrontation between Smith and Williams came to a head near Chula Vista Golf Course, after the two argued along several roadways last November. Williams reportedly threw a soda cup at Smith's vehicle before Smith struck Williams' minivan.Prosecutors say Smith then got out of his truck after cutting Williams off, walked over to his driver's side window, punched Williams in the face and walked away, until walking back and stabbing Williams several times with a knife.Witnesses said Williams got out of his van and collapsed in the roadway, bleeding heavily. During a 911 call after the stabbing, Smith told a dispatcher Williams had cut him off and threw a drink at his truck.
