SAN DIEGO (CNS) - The onetime head of a South Bay parent-teacher association was sentenced today to three years probation for embezzling around ,000 from the organization.Kaitlyn Faith Birchman, the former president of the Imperial Beach Charter School PTA, pleaded guilty in February to a felony forgery count. Had she gone to trial and been convicted of forgery and grand theft, she would have faced a potential three-year, eight-month prison sentence, according to the prosecution.Per the terms of her probation, Birchman will have to complete 15 public work service days and make ,000 in restitution to the PTA. If she pays the ,000, her forgery conviction will be reduced to a misdemeanor, according to prosecutors.Birchman, 30, was taken into custody in early January at her Temecula home on an arrest warrant issued in November. She cooperated with investigators, according to Sgt. Karl Miller, who said the thefts occurred over a roughly year-long period. SAN DIEGO (CNS) - The San Diego County Board of Supervisors voted unanimously Tuesday to discuss the reorganization of the county's fire protection and emergency medical services into two separate agencies at its July 7 meeting.The reorganization would allow more flexibility for, and accountability of, dependent fire and medical services in the county's unincorporated areas, Supervisor Jim Desmond said.One of the agencies would be the Fire Protection District, which would provide fire services to the jurisdictions within the current service area. The other would be the Fire Authority, which would continue focusing on public safety radio communications.The supervisors formed the San Diego County Fire Authority in 2008 and developed a plan to cover and consolidate 1.5 million acres. The authority is currently part of County Service Area 135, which provides the government structure to organize and fund fire protection and emergency medical services in the unincorporated area.Since the creation of the authority, the board has invested more than 0 million to boost fire and emergency services capabilities. Currently, the Fire Authority contracts with the California Department of Forestry and Fire Protection to provide services. Collectively, the services are known as County Fire.According to a staff report, County Fire has more than doubled in size in the past five years. The proposed reorganization of the agency was proposed by Supervisor Dianne Jacob, who described its evolution as like a "baby" growing into an adult.If the board agrees to separate the two functions "to better meet current and future demands," using Jacob's recommendations, it would divest County Service Area 135 of its fire protection and emergency services powers and subsequently create the San Diego County Fire Protection District, which would be a committed county function. SAN DIEGO (CNS) - The caregiver for a 74-year-old man who died in her care and another senior who were both involuntarily locked away at her various San Diego residences was sentenced Friday to 13 years in state prison.Shirley Montano, 53, pleaded guilty earlier this year to charges of voluntary manslaughter, false imprisonment of a dependent adult and perjury.A murder charge stemming from the death of Robert Chagas was dropped under the plea agreement.RELATED: Woman to stand trial for senior's death, abuse of elderly womanProsecutors alleged the defendant withheld food from Chagas and Josefina Kellogg, 61, causing their health to deteriorate over the course of several years, during which she moved often and relocated them, as well.Chagas died Oct. 7, 2016, at Sharp Memorial Hospital of pneumonia, which prosecutors argued was exacerbated by severe malnutrition he suffered under Montano's care.While the victims lived with Montano, she used their social security checks and other government benefits to buy herself a truck, among other personal purchases, and gambled away their money at local casinos, according to prosecutors.Testimony from Montano's 2019 preliminary hearing indicated Chagas and Kellogg were kept isolated from others and were confined to their respective bedrooms. Montano's niece, who stayed with her for about a year, testified that for the first month she lived at her aunt's apartment, she was not even aware Kellogg existed because the woman would hardly ever emerge from her bedroom.RELATED: La Jolla man arrested for assaulting elderly woman in Morro Bay, police sayOthers who resided at Montano's apartment or visited were offered various explanations for the presence of the victims, according to testimony.Kellogg testified that she stayed in her bedroom for several hours each day and feared angering Montano, who would hit her if she did not obey the rules of the house.Chagas was "emaciated" when he was brought into the hospital, where he died five days later, prosecutors said.RELATED: Woman sentenced for defrauding 86-year-old auntAt the hospital, Montano posed as Chagas' niece and told medical personnel that he did not wish to be resuscitated, according to testimony. Chagas' family members were only notified of his hospitalization after his death, they testified.Montano's attorney, Shannon Sebeckis, argued at the preliminary hearing there was no evidence that Chagas' malnutrition was caused by her client, and instead was the natural result of aging.Sebeckis reiterated the testimony of San Diego County Chief Medical Examiner Glenn Wagner, who declined to classify Chagas' death as a homicide. Wagner said Chagas was not getting sufficient food, but could not opine as to why, only that it appeared to be due to non-medical factors.No calls were made by family or medical professionals to Adult Protective Services in Chagas' case, which also contributed to Wagner's opinion not to classify his death as a homicide, the doctor said.While evidence was presented that Chagas once told a doctor that his weight loss was due to not having enough money for food, Sebeckis said that was not proof that Montano was taking his money or withholding food, especially in light of Chagas' issues with handling his own finances.Chagas' family members testified that an accident that occurred at childbirth had left him "slow," as his brother Richard described it, and that throughout his adult life, Chagas was susceptible to being scammed and had lost exorbitant amounts of money to fraudsters, leading family members to take an active role in assisting him with taxes and paying bills.Sebeckis argued there was little direct evidence that Montano didn't feed the seniors, as past roommates said they had seen her providing food for Chagas and Kellogg. The attorney also said Chagas was not confined at all, and regularly left the apartment each day for his janitorial job at Sea World, which he attended with a sack lunch prepared by Montano each day.The defense attorney also said it was "pure speculation and conjecture" that Montano didn't use the seniors' funds to pay for their basic needs. 4151

  

SAN DIEGO (CNS) - The San Diego City Council's Active Transportation and Infrastructure Committee unanimously voted Wednesday to send a set of proposed additions to the city's regulations on dockless scooters and bicycles to the full council for further consideration.The committee approved a handful of amendments to the ordinance at the behest of the mayor's office. The suggested changes include a rider curfew from midnight to 5 a.m., usage of one device per government ID, a fine structure and punitive actions for companies that violate city regulations and the elimination of the original ordinance's provision allowing for temporary fleet spikes during large events like Comic-Con.The amendments would also authorize the city to take actions like reducing a company's fleet size if it poses a public safety hazard or suspending a company outright for multiple violations and requiring the eventual use of geofencing technology to keep riders from traversing the city's sidewalks.RELATED: San Diego scooter ridership drops off dramaticallyThe council approved the original regulatory package in April after more than a year of complaints from residents about the need for oversight. The city sought to improve public safety while also keeping dockless mobility companies in the region as an affordable transportation alternative.The regulatory ordinance included limiting scooter speeds and parking in heavily trafficked areas of the city, operator permits and fees for scooter companies like Bird and Lime, documenting of scooter fleet size and data sharing requirements between scooter companies and the city.The city also introduced a webpage, sandiego.gov/bicycling/bicycle-and- scooter-sharing, giving residents the ability to view which companies operate in San Diego and contact information for each of them. "We want to stay in San Diego, especially with the new technologies that we are eager to test here that furthers public safety and education."RELATED: San Diego makes designated dockless scooter and bike spacesOne scooter company, Jump, left the San Diego market earlier this year due to its belief that the city could not effectively enforce its regulations and encourage good behavior by riders.Representatives from multiple companies, including Jump, and City Councilman Chris Cate suggested the establishment of a dynamic fleet cap that would limit companies that repeatedly violate the city's ordinance."In other cities, such as Santa Monica, that employ this kind of performance-based system, operators are focused on going above and beyond to demonstrate to city officials that they have earned the right to deploy more devices," Jump's Senior Operations Manager in San Diego Zach Williams said.City officials are expected to review the amendment package's legality before it comes before the full council. With only four meetings left before the council takes its winter holiday legislative recess, the council could wait to consider the ordinance until early next year. 3681

  

SAN DIEGO (CNS) - Plans to replace an aging terminal at San Diego International Airport cleared a hurdle Thursday, with the Airport Authority Board's unanimous approval of the Environmental Impact Report for its major redevelopment plan.The new Terminal 1 would replace the current 53-year-old terminal, and offer 11 additional gates and upgraded amenities for passengers, including new restaurants, seating, shops and additional security checkpoints.Officials are hoping to break ground on the terminal sometime next year, with the first phase of gates anticipated to open in 2024.RELATED: Travel website ranks San Diego International as best airport in the US"Today, we took an important vote that will help ensure our airport can accommodate expected passenger growth well into the future and ensure our customers and their families are treated to a better airport experience than today's Terminal 1 can provide," said April Bolind, Airport Authority Board Chairman. "The plan will also ensure the airport can continue to function as an economic engine for the region for decades to come."The new terminal is part of a redevelopment plan that includes roadway and transportation projects that airport officials say will ease access into San Diego International, including plans for an "all-electric shuttle fleet" set to launch later this year, which would carry riders to and from the Old Town Transit Center.Airport officials say the new terminal and streamlined transportation to and from the airport will help accommodate a growing number of passengers, with around 25 million traveling through the airport last year.The next steps for the project include federal environmental review and approval from the California Coastal Commission. 1752
