Candles on Tap in downtown Encinitas is taking the chance."Today is a big, nerve-wracking, exciting day but we are opening to the public," CEO and co-founder Chantel Johnson said. She and CFO and co-founder Marcus Wandell are hopeful about their new venture. "The feature event is the scent bar where you pull up a chair and pour your own blend," said Wandell. Johnson added, "We are a custom scent bar so when people come in, they’re able to hand pour their own soy candles, diffusers, and fragrance sprays and they get to choose from over 90 scents." Wandell says some of his personal favorites in their shop include a scent called "old books" and they also have a "cannabis" smell.The two are well aware of what they’re getting into. "We're opening in the middle of a pandemic and it's a brick and mortar store so what could go wrong, right?" Wandell said jokingly.Yet, they say they see this time as the perfect opportunity. “There's pent up energy and demand to get out and do something as long as it’s safe so we're seizing on that need in the community for folks to find an experience to do with their loved ones and friends,” says Wandell.The pair are not alone. The U.S. Census reports almost 3.3 million business applications have been filed this year which is up 700,000 from this time last year. There were reportedly more than 1.6 million quarterly applications. In California alone, week 43 saw almost 9,000 applications which is a 25% increase from this time last year.“Some of our friends [say we’re] so brave. This is a bold move but everyone's really excited for us,” added Johnson.Candles on Tap is located at 687 S Coast Hwy 101 Unit 155 in Encinitas. It's open Tuesday through Friday from 11 a.m. to 8 p.m., Sunday from `12 p.m. to 5 p.m. and closed on Monday. 1923

"The changes in this rule bring much needed regulatory clarification for the small business owners and their employees about what the law allows and requires. At a time when the restaurant industry is faced with instability, this rule provides renewed sensible regulations on tip-pooling and tip-credit standards.”We spoke to an employment attorney named Louis Pechman who founded WaiterPay.com. He said there may be some clarification in the rule, but that's not the big issue.“Tips traditionally have been viewed by management as kryptonite. Don't touch the tips, servers' tips, stay away. That's my money. Now you have a whole situation where servers, it's my money. The tip was left for me. Why am I paying a cook in the kitchen?” said Pechman.The Economic Policy Institute has estimated the rule would let employers take 0 million from tipped workers each year. That's based on numbers before the industry suffered under the pandemic.As Pechman points out, some local laws are very protective of employee tips and will supersede federal regulations.“So, it's important if you're analyzing the issue, is there a state regulation, is there a city regulation which gives more protection to workers than the FLSA does?” asked Pechman.The rule is set to go into effect in 60 days. I'm not just a doctor, but I'm also a parent to three young boys who are of trick-or-treating age. So, it's certainly a question that gets asked a lot in my wife's pediatric practice, as well,” said Dr. Kenny Banh, an emergency room physician and assistant dean of undergraduate medical education at UCSF-Fresno. “I have to say, I don't want to give a blanket answer, because it really depends on where you are and what the numbers are."Dr. Banh says there are ways to trick-or-treat this Halloween, but you first have to look at your local city and county ordinances."There’s simple things of just maintaining the guidelines. How do you do a mask? There are ways to incorporate masks in a costume and make sure we make or get costumes with masks integrated into them and trying to maintain social distancing,” suggested Dr. Banh. “The good thing about candy is years ago we moved away from homemade candies. Almost all candy is packaged already, so that’s helpful.”Still, limiting the number of people who touch the candy is a good idea along with wiping down the packaging.If you're wanting to pass out candy this Halloween, it's best to do it with a mask on and try to limit the number of trick or treaters handling the candy."Some recommendations are prepackaged candy, give little candy gift bags people can grab as they get by, instead of having kids reach in with their hands and grabbing a bunch of stuff, or you passing out with gloves or getting tongs and just dropping them into or getting a scooper letting kids drop it in," said Dr. Banh.Dr. Banh's biggest concern is with Halloween parties."Having Halloween parties and getting kids from the neighbors or friends all together, that’s really different than you as a nuclear group going as a family going out trick-or-treating and doing it safely,” said Dr. Banh. “Trying to understand that we’re finally making some ground in many states and we can easily go backwards. Labor Day, Halloween all these things sort of letting our guard down on those aspects.”Doctors say it's important to stay vigilant when it comes to protecting yourself from coronavirus so that the only frightening things we're encountering this Halloween are scary costumes and decorations. 2530
