SAN DIEGO (KGTV) -- The 21-year-old killed while driving across the trolley tracks near Encanto has been identified.The San Diego County Medical Examiner says Alex Garza, 21, was believed to be distracted, possibly on the phone, when he reportedly tried to drive his Toyota Prius across the tracks just before midnight at 60th Street and Imperial Avenue. The vehicle was struck by a trolley before it became pinned against a poll.San Diego Police and fire units responded to the scene where Garza was pronounced dead. 525

SAN DIEGO (KGTV) - Thanksgiving with the Salvation Army will be different in 2020 because of the coronavirus pandemic."We knew that we were going to do something," says Captain Sean Kelsley, who oversees the Salvation Army East County Operations. "The question was, what would it look like?"For the past 30 years, the Salvation Army held large, family-style gatherings to feed people experiencing homelessness, the disabled, and families in need at Golden Hall for Thanksgiving. They plan for 1,800 people, plus volunteers.But a gathering of 2,000+ people is strictly forbidden under California and San Diego County COVID-19 guidelines.In its place, the Salvation Army will offer "grab-and-go" style meals at four locations around the county."We're just glad to be able to be here," says Captain Kelsey. SAN DIEGO (KGTV) - The California Appeals Court put a stay on the release of a sexually violent predator known as "Bolder than Most" rapist. Back in June 2019, a San Diego County Superior Court judge ruled in favor of conditional release for a sexually violent predator. Judge David M. Gill made the controversial decision for Alvin Ray Quarles, 56.Mary Taylor is a survivor and says she's hopeful with the appeals court stepping in, "we've been hopeful in the past, but this is actually a court saying wait a minute lets look at this." Up until this week, things were moving forward as the search for a place to release Quarles in San Diego County continued. Monday afternoon, Taylor got a call from the deputy district attorney saying they filed for a writ and it had been approved. A writ is similar to an appeal. The California Appeals Court issued a stay. Now, all progress towards finding Quarles a location has stopped and cannot continue again until the courts resolve the appeal. In the meantime, Quarles will stay at the Coalinga State Hospital getting treatment through a program for sexually violent predators. 1131

SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) -- The Hillcrest Business Association is making some changes to the Pride kickoff party this year they hope will make the event more inclusive. According to Benjamin Nicholls, the association’s Executive Director, entry to the event won’t be limited to those 21 and up this year. “We just felt it was a little odd to say ‘oh under 21 you can’t come,’ so we took down the fences and made it all ages,” Benjamin said. On top of taking down the fence that normally surrounds the event, entry will also be donation based. “What we want to do is we want to take down the barriers to entry and that means physically taking down the fences and also charging nothing for folks to get in,” Nicholls added. Nicholls says he hopes the changes will get more people involved. Pride this year will be held on July 12, 13 and 14. 840
