BOSTON (AP) — Prosecutors dropped a case Wednesday accusing Kevin Spacey of groping a young man at a resort island bar in 2016, more than a week after the accuser refused to testify about a missing cellphone the defense says contains information that supports the actor's claims of innocence.Spacey was charged with indecent assault and battery last year in the only criminal case that has been brought against the actor since his career collapsed amid a slew of sexual misconduct allegations. The two-time Oscar winner was among the earliest and biggest names to be ensnared in the #MeToo movement against sexual assault and harassment that swept across the entertainment and other industries.Spacey denies groping the man, whose mother first went public with the allegations in 2017.A phone message seeking comment was left with Spacey's lawyer.The actor's accuser was ordered to take the stand earlier this month after he said he lost the cellphone he used the night of the alleged groping. The defense said it needed the phone to recover deleted text messages it says would help Spacey's case.The man denied deleting messages or manipulating screenshots of conversations he provided to investigators. But when he was pressed by the defense about whether he knew that altering evidence is a crime, he invoked his Fifth Amendment right against self-incrimination, and the judge said his testimony would be stricken from the record.The judge then questioned how prosecutors would be able to bring Spacey to trial if the accuser continued to refuse to testify, and prosecutors told the judge they needed time to decide how to proceed.On Wednesday, Cape and Island District Attorney Michael O'Keefe said in court documents that they were dropping the charge "due to an unavailability of the complaining witness."The hearing at which the accuser testified came days after the man abruptly dropped a lawsuit he had just recently filed against the actor that sought damages for "severe and permanent mental distress and emotional injuries." The suit was dismissed "with prejudice," meaning it cannot be refiled.The man did not receive a settlement to drop the civil case, his mother said. His lawyer said he dropped it because he was emotionally overwhelmed and wanted only "one roller coaster ride at a time" and so chose to focus on the criminal case.The man's mother, former Boston TV anchor Heather Unruh, alleged in 2017 that Spacey got her son drunk and sexually assaulted him at the Club Car, a bar on Nantucket where the teen worked as a busboy.The man told police he went over to talk to Spacey after his shift because he wanted to get a picture with the former "House of Cards" star. He said Spacey bought him several drinks and tried to persuade him to come home with him before unzipping the man's pants and groping him for about three minutes.Unruh's son told police he tried to move Spacey's hands, but the groping continued, and he didn't know what to do because he didn't want to get in trouble for drinking because he was underage. The man said he fled when Spacey went to the bathroom.Shortly after Spacey was charged, he posted a video on YouTube in the voice of his "House of Cards" character who was killed off after the sexual misconduct allegations emerged, saying "I'm certainly not going to pay the price for the thing I didn't do."Spacey has faced several other accusations.His first accuser, actor Anthony Rapp, said Spacey climbed on top of him on a bed when Rapp was 14 and Spacey 26. BANGOR, Me. — It’s the time of year to bundle up, pick out a tree, and make time for tradition.Despite everything this year has brought, there are moments worth celebrating, and in some places, life almost seems normal.“Everything has been canceled or changed, or you can't do this, you can't do this that, and the nice thing about our trees here is they're planted at 6 feet apart, coincidentally,” said Mac McCullen, owner of the Piper Mountain Christmas Tree Farm.The Piper Mountain Christmas Tree Farm didn’t plan for a pandemic, but they’re hoping families can find a small escape when they visit.“People could spread out, find their trees, stay safe and enjoy that kind of time together with their family, which is so important, I think, and particularly in a time like this,” McCullen said.After retiring from the Navy, McCullen and his wife took over the farm. “Our favorite part of being on the farm is, quite honestly, just being outside," he said.It’s a joy the McCullens were terrified of losing because of Covid-19.“We weren't sure that people were gonna show up. We were very pleased our first weekend to have probably better than normal weekend. And it's kind of continued to be that way. Even our weekdays, which are typically pretty slow, two or three people here and there, have been fairly steady,” said McCullen.They did everything they could to make their farm safe: putting up sneeze guards and using social distancing in their store.The couple was thankful to see the cars fill their parking lot.“This is one of the best things we come to do, to stay together,” said long-time customer Mike Cassidy.“I haven’t been to get a tree anywhere else since I’ve been born,” said Cassidy’s daughter, Mariah.These simple moments of family fun are making sure the McCullen’s legacy can live on.“It's a huge relief because not only do we have to deal with COVID, but we're a seasonal business. People don't buy Christmas trees year-round, so all of our sales happen in the month of November and December. So, if people didn't show up, oh my gosh, you know, we really would have a hard time surviving," McCullen said.It’s not just at this farm, demand for Christmas trees is skyrocketing across the country, so much so, that some farms are seeing shortages.With that jump in demand, comes a jump in price. The National Christmas Tree Association reported Americans will pay an average of 7 percent more for a tree this year than last year, and 23 percent more than they paid in 2018.But raising prices wasn’t an option at this farm.“With all the difficulties that everybody has gone through and the stress and the strain that is put on everyone, we just didn't want to add another layer to that. So, what we tried to do was stay as consistent as we could to keep our prices the same so that people could come out and know what to expect when they get here,” said McCullen.McCullen and his wife made many of the wreaths themselves. They also made candle holders from fresh fir trees and garland for your home.“I get a little emotional about it because it's just us. For my wife and I, we don't have children, so our workers the people that are here with us that support us are our family. That's what the emotional piece of it just being able to be, you know, in something together and to be able to create, you know, things that we know people enjoy,” said McCullen.For those close enough to visit, taking home a Piper Mountain tree is a tradition they won’t miss.“We love a real Christmas tree,” said Mariah Cassidy. “There’s nothing like it, and coming here always feels like home.”“And this year would be in memory of my mom, Gaila,” said Matthew Cassidy. “She used to love to come here, and she’s the main reason we keep coming here. We lost her about 3 years ago, and it’s the only way to keep her with us because Christmas was her favorite time of year.”And for more families than ever, this reminder of happiness, no matter how big or small, is one way to bring the joy of Christmas past into the present. 4102

BONITA (KGTV) -- Neighbors in Bonita say their street is becoming congested with "toll dodgers" - drivers who are going out of their way to avoid paying the .55 toll on State Route 125.   It's not just the traffic buildup that neighbors find concerning, it's that these drivers are often speeding - right past an elementary school, parks and horse tracks. In a community meeting Tuesday, the City shared plans to fix the issues on Briarwood and San Miguel Ranch roads. RELATED: Drivers dodging tolls on SR 125 cause problems in South Bay neighborhood"There's a lot of concern about people trying to evade the tolls," said Greg  Cox, with the San Diego County Board of Supervisors. As a result, Cox said the City lowered the speed limit on San Miguel Road to 25 mph and placed a stop sign at a popular horse crossing. They also plan to intall a traffic signal at Sunnyside Elementary School. "If the County can secure a grant for the funding, that could be done within the next year," Cox said. John Scott has been in the neighborhood since the mid 1980s. He's noticed the buildup up of traffic over time, and says...he can't fault the drivers for trying to save a buck. "They got as much right to use the road as anybody else has to use the road," he said.  1327
