LEMON GROVE, Calif. (KGTV) — One man was shot and injured while using an East County ATM machine during an attempted robbery Wednesday.The man had just finished using an ATM machine at the Union Bank location at 3285 Lemon Grove Ave. when an unidentified suspect approached and tried to rob him just after 12 p.m., according to San Diego County Sheriff's Department.During the robbery, the man, described as a black man in his 40s, was shot in the leg. His condition was not immediately known. It's not clear how much was stolen from the man.The suspect was not immediately identified or reported in custody. He was described as having black hair and wearing an orange shirt. His face was covered during the robbery.10News is monitoring this breaking news story. 770

LA MESA, Calif (KGTV) - According to the California Department of Public Health, seven deficiencies were issued after an investigation of Sharp Grossmont Hospital. In April state investigators conducted a survey consisting of 14 closed medical records. According to the investigator's findings documented in a statement of deficiencies and plan of correction report, "Hospital leadership did not provide notification of a potential investigation and the use of video recording during medical treatment without patient's consent." Investigators also noted deficiencies with regulations related to medical staff accountability, patient's rights, and use of restraint or seclusion. According to the state document, "The patient has the right to personal privacy. This Statute is not met as evidenced by: Based on interview and record review, the hospital failed to ensure the privacy of all patients undergoing medical treatment in the WHC (women's health center) ORs (operating rooms) when the hospital's Admission Agreement for Inpatient and Outpatient Services was utilized as consent to allow video recording during medical treatment. Also, the Admission Agreement did not allow the patients' the option to acknowledge and/or decline video recording. As a result, the hospital leadership allowed video recording of patients undergoing medical treatment without knowledge or consent." The deficiencies listed fall under violations to conditions of participation for a hospital as listed in title 42 of the federal code of regulations.   A deficiency is a violation of a federal or state law or regulation that the California Department of Public Health cites during a survey or investigation.Officials with the California Department of Public Health tell 10News issuing deficiencies is a form of enforcement action. It requires the facility to submit a Plans of Correction to fix any violations. According to Sharp officials, in 2012 they were alerted that beginning in 2011, potentially powerful drugs and equipment were missing from the anesthesia cart in each of Sharp Grossmont Hospital's three Women's Center operating rooms. The hospital installed a computer monitor with a motion-activated camera in each of the three Women's Center operating rooms. Between July 2012 and June 2013, the videos were recorded. The hospital says the cameras were intended to record only individuals in front of the anesthesia carts. In a statement to 10News, a spokesperson for Sharp wrote:"In their survey, the California Department of Public Health (CDPH) identified areas where opportunities for improvement existed. The hospital addressed each area of concern and created a plan of correction for those findings. Both CDPH and the Centers for Medicare & Medicaid Services (CMS) accepted Sharp Grossmont’s plan of correction, as confirmed in a follow-up survey. The hospital’s plan of correction provides that:The specific techniques used in the 2012-13 investigation have not been used since and will not be used for any future investigations.Any potential future investigations are required to strictly adhere to Sharp’s policies and procedures;Medical staff will be kept informed of any similar future investigations that may occur;Patients will receive full disclosure of any future investigations that may affect their privacy;The patient grievance practices have been strengthened to ensure patient complaints and grievances are appropriately and efficiently managed; andAdditional measures are in place to safeguard against the inadvertent release of patient information to third parties. Staff and clinicians have been educated on the hospital’s plan of correction and policies. While we are pleased that CDPH and CMS accepted our plan of correction, we regret that the investigation inadvertently recorded patients and may have caused distress to those we serve."More than 400 women who claim they were secretly recorded are suing the hospital.Court records show a hearing is scheduled in September. 4026

LA MESA (KGTV) -- It was a frustrating flight for one mother in La Mesa, who said an airline would not allow her to sit next to her toddler without forking over extra cash.Aliss, who declined to use her last name, said she chose seats together when she booked her ticket through a third-party website. Aliss and her son, Kai, were travelling from Providence, Rhode Island back to San Diego with a layover in Minneapolis. When she got to the airport in Providence, her seat on her Sun Country Airlines flight was not next to her child.“I would have never booked a flight where we couldn’t sit together,” Aliss said. She said her options were limited and that the representative with the airline said she could charge her a fee.“I can’t pay that. What else can we do? And she said, well for I can move you guys in a row front and back of each other. I said that doesn’t help my problem. He’s still not sitting next to me,” Aliss said. She said she told the airline representative not to charge her the money, but she was charged anyway. She said she did not get help from anyone with the airline, including the flight attendant. “She said no, you’re on your own. You’ll just have to argue with people,” Aliss said. Fortunately, a grandmother ended up giving up her seat so Aliss could sit with Kai. That was only the beginning of her problems. From Minneapolis to San Diego, Aliss’ flight was delayed. At first, it was only three hours.“No big deal,” she said. She tried keeping Kai entertained and saw many other parents in a similar situation. The three hour delay became much longer with passengers unclear on when they were going to leave. “It was confusing, frustrating,” Aliss said. She said they were promised 0 vouchers for the long delay. Aliss said their 3:10 p.m. flight finally left around 12:30 a.m. Team 10 contacted Sun Country Airlines, who apologized for what happened. In a statement, a spokesperson told Team 10: “This was not the level of service we aim to provide, as it is our policy that children always be seated with an adult on the itinerary at no cost. We have followed up with our airport staff on this error to ensure our policy is being carried out correctly. We have issued a full refund to the passenger for the fees incurred at the counter related to the seat assignment. We were also able to ensure two seats were assigned next to one another on her return flight. Our team has resent the 0 vouchers from the flight delay to the email we have on file, and we are adding an additional 0 voucher for the inconvenience.”Aliss said it was a lesson for her to be prepared and to, “be wise with who you spend your money with.” A few years ago, Congress passed the Families Flying Together act, which was supposed to keep parents and children together on planes. LA JOLLA, Calif. (KGTV) - A woman who says she was drugged and raped by Daniel Dorado while on a job interview at his La Jolla Restaurant nearly three years ago, is sharing her story only with 10News.Dorado was arrested Wednesday on 18 counts, including rape. RELATED: La Jolla restaurant owner arrested on 18 charges, including rapeThe woman, who requested her identity be protected, said the alleged assault happened at Voce Del Mare on the night of April 27, 2015."I went in there for a job interview, I would never have imagined going through a sexual assault and not knowing how it happened," the accuser said. She tells 10News it began when she answered an ad on Craigslist for a hostess position. She recalls arriving around 9:30 p.m. for an interview with Dorado, who at one point offered her a glass of wine, which she accepted. What happened next is unclear."What I do recall is waking up around four in the morning and I did not have any clothes on...he had nothing on," she said.The people who had been at the restaurant when she arrived were gone, and she said she was locked in, alone with Dorado. It was then that she remembers the phone ringing. On the other end was her mother, wondering where she was. "Honestly I feel because my mother called the restaurant around four something in the morning is what made him let me leave, knowing that somebody knew I was there," she said. The accuser said she knew she'd been assaulted because of how her body felt. "I had vaginal discomfort," she said. "I felt as if there must have been penetration at some point, bruises around my chest, I was in great pain."Although she filed a police report, she was ultimately told there was not enough evidence to charge Dorado, until now. "Knowing that I'm not the only one, I want justice and I hope that if there's anybody out there who knows this individual, who was a victim, that they come forward so there can be justice," she said.  2006

  

LINCOLN, Neb. (AP) — The owner of a pharmacy that provided drugs to Nebraska for use in a 2018 execution is expressing remorse for making the sale, but acknowledging that he knew that prison officials wanted them for a lethal injection.Public records released late Thursday show that Community Pharmacy Services, a pharmacy in Gretna, Nebraska, agreed to sell the drugs to the Nebraska Department of Correctional Services for two payments totaling ,500.State officials had refused to identify their supplier until the Nebraska Supreme Court ruled in May that they cannot withhold that information.Pharmacy owner Kyle Janssen says the drugs supplied to the Nebraska Department of Corrections were used in the August 2018 execution of Carey Dean Moore, the first death by lethal injection in the state. Moore was convicted of murdering two cab drivers in Omaha.In a statement obtained by The Associated Press, Janssen said his pharmacy has not supplied drugs to any department of corrections since the sale and will never again.“I regretted the decision as it does not align with our company’s values to provide the best patient care and customer service to the long-term care industry,” said Janssen. 1210
