JULIAN, Calif., (KGTV)— Firefighters in Julian are hoping to keep San Diego’s last volunteer fire department alive, despite being voted to shut down last week. The Julian Cuyamaca Fire Protection District is now suing the County, alleging the decision to dissolve the department was made in secret meetings. The court hearing for Wednesday was postponed in Downtown San Diego after a judge recused himself from the case.Two weeks ago, Debbie Mushet voted to have the county take over the Julian Cuyamaca Fire Protection District [JCFPD]. “I definitely voted yes for it, and I thought that was the end of it,” Mushet said. In this special election, 56% of Julian residents voted to have the San Diego County Fire overtake the historic volunteer department. “It’s worked as long as I’ve been up here, but it doesn’t work anymore. There’s a time when things just need to change,” Mushet said. “The volunteers have done a great job ion the past, but it’s just the money wasn’t going to be there.”Despite losing the special election and a unanimous vote by the Local Agency Formation Commission to officially dissolve the department, volunteer firemen are not ready to give up. Attorney Cory Briggs, who represents JCFPD said that decision was made through secret meetings. Therefore, the election results and the commission votes are “null and void.” When the County transition team came to the station on Monday, protestors staged a sit-in, refusing the leave the premises. JCFPD said in a statement, the County sent armed Sheriffs Deputies to “intimidate the unarmed JCFPD personnel who were peaceful truing to secure their facilities and equipment while the new lawsuit works its way through the courts.”“CalFire and the Julian Fire Department that exists now, I don’t understand why we can’t coexist,” Debbie Hickey said. “Every time it’s been really good response times. They knew right where to come.”For years, Hickey has relied on the Julian Fire Department for emergency care for her ill husband. She said she trusts the locals more than an outsider who would be assigned to cover the Julian area. “If I was to call 9-1-1, I don’t know who will come, I don’t know what the response time will be, and that’s a very scary situation to be in,” Hickey said. “My husband is staying down in the city during this time because quite frankly, I’m scared to death to let him come home to Julian.”A volunteer fireman told 10News off camera that since Monday they have not been allowed to respond to emergency incidents. In fact, they said their radios were disconnected. In the meantime, all 9-1-1 calls are being handled by Cal-Fire Station 50, down the street from the JCFPD station.While there is no official sit-in happening now, there are still many volunteers at the station. Volunteer crews have barricaded their engines inside the garage with their SUV’s, to try to stop the county from towing their vehicles. Either way, Mushet said this back and forth is getting out of control. “Let the vote speak for itself, let the count come in, volunteers step back, and it’s over and done,” Mushet said. “This is ridiculous. They asked for the vote they got their vote, and they were not happy with the decision, so they’re refusing to give in and it’s just sad. I’ve never seen this town so divided.”Wednesday’s court hearing scheduled for 8:30 a.m. was delayed after the assigned judge recused himself from the case. No reason was given for his recusal. JUPITER, Fla. - Misdemeanor prostitution charges were dropped Thursday against New England Patriots owner Robert Kraft and 24 other defendants linked to a spa sex sting in Jupiter.The charges stemmed from a police investigation at the Orchids of Asia Day Spa in Jupiter conducted in 2019.Jupiter police claimed Kraft visited the now-defunct spa twice in January 2019, including the morning of the AFC Championship game.Palm Beach County State Attorney Dave Aronberg held a virtual news conference regarding the case.RELATED: How detectives gathered evidence inside Orchids of Asia day spa | Woman accused of performing sex act on Kraft arrestedThe investigation led to the arrests of several men and women, including misdemeanor charges against Kraft.Aronberg said charges were dropped against all 25 defendants accused of misdemeanor charges of soliciting prostitution."It is not a lack of will that caused us to drop the charges in the spa cases," Aronberg said.There are still pending felony charges against the owner and manager of the spa. NEWS CONFERENCE: Palm Beach County State Attorney Dave Aronberg provides update on Orchids of Asia Day Spa case (14 minutes) Earlier this week, the Florida Attorney General's office announced that it won't appeal a court decision blocking video that allegedly showed Kraft paying for sex at the massage parlor.A Florida appeals court ruled in August that police violated Kraft's rights and others when they secretly video recorded them paying for massage parlor sex acts.The state attorney called the appellate court's decision "disappointing.""The Orchids of Asia Day Spa was a notorious brothel in a family shopping center, right next to a game room that attracted children," Aronberg said.Secret video recordings allegedly captured a woman at the spa performing a sex act on Kraft and him paying in cash, according to police."Without these videos, we cannot move forward with our prosecutions, and thus we are ethically compelled to drop the cases against all the defendants," Aronberg said. "Despite the setback today, our office will continue our work to make our community safer by holding accountable those who engage in criminal activity including sex crimes." WPTV The Orchids of Asia Spa in Jupiter was raided in February 2019. The state attorney said he disagreed with the ruling that threw out the video evidence for all 25 defendants. "The Jupiter Police Department did the right thing in pursuing the investigation," Aronberg said. "I stand behind the decision to file the cases."Aronberg said four other individuals, besides Kraft, were recorded and received legitimate non-sexual massages. Two of those four were women, and the court said that the police should have never recorded the women, and thus every other video must be discarded. The state attorney said they could not prove human trafficking without a reasonable doubt, but there was evidence of human trafficking "in the overall investigation." None of the defendants charged with soliciting prostitution were ever accused of human trafficking.Kraft's attorneys want the video destroyed.Jupiter police said Kraft made two visits to the spa in January 2019.The Associated Press contributed to this report. JACKSONVILLE, Fla. – A boater who had been missing since Friday was rescued about 86 miles off the coast of Florida on Sunday.The U.S. Coast Guard says 62-year-old Stuart Bee was found alive on the bow of his 32-foot Sea Ray, which had capsized.Bee departed Cape Marina in Port Canaveral on Friday and didn’t return, according to the Coast Guard.Watchstanders in Jacksonville learned of the disappearance Saturday morning and were told Bee wouldn’t typically stay out on his boat overnight.An aircrew was dispatched the area and other boaters were advised to be on the lookout for Bee’s vessel.Luckily, the Coast Guard says Bee was spotted clinging to his boat at about 11 a.m. Sunday and was then transported to shore."Saving lives at sea is our highest calling. JULIAN, Calif. (KGTV)-- This was the first weekend San Diegans were able to enjoy the snow-packed mountains. But morning road closures made traveling uphill from San Diego difficult. By early afternoon, most road restrictions were lifted, and thousands of people made their way to the tourist towns. To Teak Nichols, Julian is just home. But he knows it is a special place. "It's been really magical the last few days. So I can understand why people would want to be a part of that," Nichols said. With its old-world charm and snow-packed roofs, Julian is an escape from the daily grind. "We wanted to get away from the city," San Diegan Sandra Aguiar said. She brought her husband's family from Tijuana to experience the allure of the small town. But she said it was not an easy ride. "It took about an hour and 45 minutes," Aguiar said. "Then two miles from here, it was bumper to bumper."Until 1 p.m. Saturday, California Highway Patrol officers slowed down drivers to enforce chain controls along State Route 79 at Cuyamaca Rancho State Park. Many parts of Sunrise Highway were also shut down due to icy conditions. "In some parts, it was kind of scary. We were sliding a little bit," Aguiar said. Even after they finally made it into town, the waiting continued. Aguilar's main reason for coming up the hill was to get a bite of Nichol's mother's famous dessert at Mom's Pies. "I've tried Julian pies before, but these are the best," Aguiar said. Nichols said it is a recipe that has been kept a secret since 1984. It is a seasonal favorite that sells out, every time it snows."It's gotten busier as the day has gone on," Nichols said. "Apparently, the road opened up, so we got a little bit busier after that."Snow days may slow down traffic and clog up parking, but customers said it is all worthwhile."It's homemade, and it makes it better because we're with family," Aguiar said.
