SAN DIEGO (CNS) - A man was slashed in the face with a knife by a family member during a fight at Ski Beach Sunday, police said.The family was gathered at the beach when an uninvited family member showed up about 2:35 p.m. Sunday, according to Officer S. Foster of the San Diego Police Department.A 31-year-old man got into a fight with another family member, who pulled a knife and slashed him below his right eye, Foster said.The victim was taken to a hospital with non-life-threatening injuries, the officer said. SAN DIEGO (CNS) - A transient who allegedly overpowered a woman in the East Village, dragged her into some bushes and sexually assaulted her before running away pleaded not guilty Tuesday to three felony charges, including assault with intent to commit rape.Gary Ryan Cushinberry, 51, who is on felony probation for robbery and failing to appear in court, was ordered held without bail.Late on the evening of Nov. 5, Cushinberry allegedly grabbed a 26-year-old pedestrian walking by herself in the 400 block of 13th Street, pulled her off the sidewalk and assaulted her before fleeing.Detectives identified Cushinberry -- a recent transplant from Indiana who has been living on the streets of San Diego -- as the alleged perpetrator by means of ``several tips and leads,'' Lt. Jason Weeden said.Cushinberry was arrested last Friday about 6:45 a.m. in the 200 block of 17th Street.When Judge Jay Bloom ordered the defendant to stay away from the alleged victim, Cushinberry said ``I don't know the woman,'' according to Deputy District Attorney Martin Doyle.The prosecutor said Cushinberry has a criminal past from Indiana that is still being looked into.Cushinberry -- who is also charged with two counts of digital penetration by a foreign object, faces 21 years in prison if convicted, Doyle said.A readiness conference was set for Dec. 3 and a preliminary hearing for Dec. 5. 1391

SAN DIEGO (CNS) - A pick-up truck drove through a highway center divider today near Alpine, overturned and caught fire, authorities said.The crash happened at 7:26 a.m. when a Ford truck lost its brakes going eastbound on Interstate 8, overturned on westbound I-8, landed on the right shoulder and became fully engulfed, the California Highway Patrol said.The wreck started a minor brush fire. All westbound lanes of I-8 were shut down from West Willows Road to East Willows Road until 8:23 a.m., where one westbound lane was reopened, the CHP said.It was not immediately known how many people were in the truck or whether there were any injuries. 655

  

SAN DIEGO (CNS) - A man whose altercation with four off-duty San Diego police officers in the parking lot of a Grantville bar drew attention from local activists alleging excessive force was sentenced Thursday to a three year probation term in connection with cocaine and firearm possession, which includes 90 days in jail and nine months to be served in a work furlough program.Jonathan Felix, 29, pleaded guilty last month to possession of a loaded firearm and cocaine, in connection with the Nov. 7, 2018, altercation outside McGregor's Grill and Ale House just before 2 a.m.The case generated substantial public interest regarding the use of police force rather than for the felony case, in which Felix was accused but never charged with pointing the gun at the officers, prompting them to tackle him to the ground and strike him several times until they were able to seize the pistol, according to prosecutors.RELATED: San Diego man says off-duty SDPD officers assaulted himThe blows rendered Felix unconscious, and left him with a fractured pelvis, fractured hand and cuts and bruising to his head, while one of the officers testified that he broke his hand punching the defendant.In addition to possessing cocaine, Felix was prohibited from possessing a firearm due to theft and drug-related convictions out of Arizona, according to Deputy District Attorney Michael Runyon.Following his 90 days in custody, Felix will continue working during the day at Greystone Prime Steakhouse & Seafood in the Gaslamp Quarter, where he was employed at the time of his arrest. San Diego Superior Court Judge Polly H. Shamoon imposed a suspended four-year prison sentence, meaning Felix could head to prison if he violates the terms of his probation.At a preliminary hearing in February, Officer Anthony Duncan testified that after he and other officers departed McGregor's, they noticed Felix leaving the premises and returning to the parking lot on several separate occasions, both in his Dodge Durango and on a bicycle. He said the officers were concerned that Felix was "casing" vehicles, possibly to break into or steal cars.Felix was exhibiting "odd behavior" and "something didn't feel right (about him)," Duncan said.Officer Jose Rodriguez, who was at the bar with the other men but left before the altercation with Felix, testified that he also felt Felix was looking into vehicles parked in the lot.Despite their concerns, none of the officers called for assistance from on-duty law enforcement until after they restrained Felix, according to Duncan.Duncan said that he approached Felix, at which point the defendant produced a semi-automatic handgun from his waistband and pointed it at him, prompting all four officers to draw firearms on Felix.Surveillance footage from the parking lot of the business captured the physical altercation between the men, but not the purported standoff, which was blocked from view by a parked car. The defendant, who was sitting on his bicycle at the time, backpedaled away from the men, who followed and tackled him to the ground, according to surveillance footage.Felix told investigators after being arrested that he believed the group of men, who he said never identified themselves as law enforcement officers that night, may have been casing his Durango or looking to start trouble.Defense attorney Alicia Freeze argued that her client drew his gun out of concern for his safety, but denied that he ever pointed the weapon at the group. Speaking with reporters outside court following the sentencing hearing, she said she felt the officers used "unlawful force" in subduing Felix.Runyon reiterated outside court that Felix pointed a gun at the officers, "ignored several commands" to drop his gun, and "did not give up the gun immediately" even after being taken to the ground.Along with Duncan, the altercation included fellow San Diego officers Nicholas Dabbaghian, Frank Bigler and Ross Bainbridge. 3956

  

SAN DIEGO (CNS) - Nearly half of San Diego County's 1.95 million voters have cast their ballots in the Nov. 3 election, the Registrar of Voters reported Thursday.More than 937,000 ballots had been received as of Thursday, according to the registrar's office.Mail-in ballots were sent to all registered voters in the county on Oct. 5, even those who had not requested one.Ballots received by the registrar's office this week should be processed in time for the first release of election night results to be posted shortly after 8 p.m. Tuesday.Voters can return their marked ballot in the pre-paid postage envelope to any U.S. Postal Service office or collection box. The Registrar of Voters office in Kearny Mesa is open for early voting from 8 a.m. to 5 p.m. on weekdays for those preferring to vote in person.Voters additionally have the option to drop off their ballot at one of 126 drop-off locations around the county -- including dozens of libraries, YMCAs, county offices and The Old Globe Theater in Balboa Park.Voters also can also cast their ballots at their assigned polling place, 8 a.m. to 5 p.m., from Saturday through next Monday. All polling places will again be open on Election Day, when the voting hours change to 7 a.m. to 8 p.m.An in-person voting location tool can be found on the county's voting website, SDvote.com.Due to the COVID-19 pandemic, the registrar's office encourages older adults and people with underlying medical conditions to avoid long lines and crowded polling places by voting early.Registrar Michael Vu said his office is working with county public health services to ensure the health and safety of election workers and voters. Personal protective equipment and sanitation supplies will be provided to staffers so they can conduct the election process safely.Voters casting ballots in person are instructed to bring a face mask and plan to maintain social distance."We encourage voters to act early and make voting decisions from the comfort and safety of their home," Vu said. "Mark your ballot, sign, seal and return your mail ballot to a trusted source. The sooner we receive your ballot, the sooner we can start processing it so it will be counted right when the polls close at 8 p.m. on Nov. 3."Locations of vote centers were chosen and configured to allow for queuing and voting while maintaining six feet of social distance. Masks will be required inside, but residents unable or unwilling to wear them will be allowed to vote curbside.Officials noted that the need to social distance may create longer lines than usual at in-person locations. 2601
