SAN DIEGO (KGTV) - A Point Loma family is trying to raise awareness of what they call a “dangerous” intersection, after cars have slammed into their house.The home the Cohen family began renting this year sits at the intersection of Nimitz Blvd. and Evergreen St., and has been hit twice since they moved in.According to San Diego Police, officers have responded to collisions at that intersection at least twelve times in the last five years.“I went to go wake up my mom and told her that we should probably get out of here because there's a car going into our kitchen,” said 12-year-old Max Cohen, speaking about a crash that happened the week the family moved in back in January. “You look out the window and see cars speeding down the road and not stopping at all on this turn.”Before they started renting, the Cohen’s weren’t notified that the home had a certain reputation for being hit. 10News reached out to the homeowner, who says that information was also not disclosed to him before he purchased the house this year. The City of San Diego tells 10News it is aware of the history of the intersection. Over the years, many cars have slammed into the house on Nimitz Blvd, sometimes resulting in serious injuries to the occupants in the home.A City spokesperson said upgrades to improve safety have been made, based on studies and evaluations by the City’s traffic engineering division.The following statement from the City of San Diego outlines the safety upgrades:“In the recent history, the City has evaluated the area and updated the intersection to include guardrails, a flashing beacon with a “curve” warning sign and a dedicated bike lane. The approaching lanes have been reduced from to one lane from two lanes and the signal at the approaching intersection has been modified to remain red between midnight and 4 a.m. to direct vehicles to stop before the intersection –- In other words the light remains red during the hours of 12 a.m. to 4 a.m. until a vehicle is detected.”But, the Cohen family said these changes are clearly not working.“It might not hit the house as much as it could, but it still does, which it shouldn’t at all,” said McKensey Cohen, whose bedroom was hit by a car in October. “Since then we've just been on edge about everything. We can hear the street for miles.”The family said they have contacted the City’s code enforcement department to come check the stability of the home, specifically McKensey’s bedroom, but they have not received a visit.The family hoped to move out the day of the last crash, but they had to postpone the move. SAN DIEGO (KGTV) - A new California law aims to help thousands of low-income Californians gain access to fresh and healthy food.Seniors in California who receive Supplemental Security Income (SSI) benefits will also be able to apply for CalFresh food benefits, formerly known as food stamps.SSI recipients are either over age 65, disabled, or blind. Up until recently, they couldn't apply for CalFresh benefits because they receive money for food in their check; however, it's just a month. "One of the challenges seniors face is the high cost of living, we can hardly make it with what we get," said Gwendolyn Joseph, a San Diegan who lives on a fixed income.Joseph just turned 76 and can finally apply for CalFresh benefits, despite receiving SSI benefits. The average CalFresh recipient receives 0 per month to purchase food."We are striving so hard in California to restore these kinds of safety net programs to our most vulnerable Californians, look around this room, these are people who've worked their entire lives, they deserve it, they've earned it, and they need our support now," said Senator Toni Atkins, who represents California Senate District 39.Feeding San Diego, in partnership with Serving Seniors, 211 San Diego, and the County of San Diego Health and Human Services, is working to spread the word and encourage SSI recipients to apply for CalFresh benefits. "The nutritional gap that we're seeing in San Diego in terms of people having calories to eat, but not having healthy and nutritious foods to eat, is a real serious and growing problem, and it impacts seniors disproportionately," said Vince Hall, CEO of Feeding San Diego. SAN DIEGO (KGTV) - A Los Angeles area man says the San Diego County District Attorney's office charged him with a crime he didn't commit.Angel Galvan says the mistake cost him money, time and when you search his name at the courthouse a court file."For me to go through all of this, it hurt a lot," said Angel Galvan.Galvan says in July of this year, he received a letter from the San Diego County District Attorney saying he'd been charged with Grand Theft of Personal Property from Go Wireless. He thought it was a mail scam."What is PC 487," Galvan said.It was no scam.Galvan says the district attorney's office claimed he and other people were using stolen credit cards to buy merchandise from a Go Wireless location in the San Diego area."I hope you realize I live in the valley (San Fernando) like I don't live nowhere near San Diego," Galvan said.Galvan lives in Panorama City, that's in Los Angeles County, about two and a half hours from San Diego.Galvan says he did work at a Go Wireless store near his home, but for only two months, and that was back in 2017. The alleged crime happened in March of 2018."Every day I got home, I was stressed," Galvan said. "I couldn't believe it," he said.According to a claim, Galvan filed with the County of San Diego, "It turns out that another individual named Angel Galvan worked at Go Wireless, but worked in San Diego, committing crimes."Team 10 obtained an email sent by a San Diego County Deputy District Attorney in August of 2019 to Galvan's criminal attorney acknowledging he was not the correct Angel Galvan.The email stated, "HR at Go Wireless mixed him up with another Angel Galvan. I will calendar a dismissal asap. Sorry for the mix-up.""No one called him, no one looked to see if it was the right person, no one checked his address no one checked his work records," said Galvan's civil attorney Alex Ozols.Ozols claims the District Attorney's office did not do any further investigation after receiving Galvan's information from Go Wireless, and that's a problem."A lot of time, they do get it right, and we appreciate that they are representing the state of California," Ozols said. "However, when they get it wrong, the repercussions are just so bad when they do, and in this case, they did."Galvan tells 10News he had to sell his truck to pay the legal fees. He also had to drive to San Diego for an arraignment where he was order to do a book and release. He says he was fingerprinted and had his DNA taken.According to the claim, "He will/does have this listed on his Department of Justice print out, he is still in the police system, an arrest records still exists, and his DNA was taken against his 4th amendment constitutional right because he was charged with a felony."Galvan says he lived in constant fear he'd go to jail, and his son would grow up without a father."I work 50-60-hour weeks. I barely even see my son now, and the last thing I wanted to do was go to jail and not be able to see him at all," Galvan said.Galvan said when the case was finally dismissed there was a wave of emotion."It hurts a lot because of everything I went through," he said.Both the San Diego County District Attorney's office and Go Wireless said they couldn't comment on pending litigation.Galvan's attorney tells 10News the County of San Diego rejected the legal claim, and they do plan to file a lawsuit.Court records show there is an ongoing court case involving another person named Angel Galvan. 10News tried to track that person down was unable to speak with anyone. 3540
SAN DIEGO (KGTV) - A judge decided Wednesday not to order a second trial for the man accused in the disappearance and murder of his stepson.Tieray Jones cried after the decision was made in the downtown courthouse.Jones was charged with killing 2-year-old Jahi Turner. Jahi was last seen at a park near Balboa Park in April 2002. Jones reported the boy missing, telling police Jahi wandered off.A mistrial was declared in for Jones on March 16.Jones was facing several charges including second-degree murder and involuntary manslaughter. Two jurors found Jones guilty of murder while 10 did not. 10 jurors found Jones guilty of involuntary manslaughter and two did not.During the trial, the judge asked if jurors would be able to reach a verdict if given more time to deliberate. They responded by saying no. RELATED: Mistrial declared for Tieray?Jones, stepfather of Jahi TurnerJahi was in Jones’ care while the boy's mother was on deployment. After Jahi disappeared, a countywide search followed. Thousands of people looked for the boy in the park and Golden Hill neighborhood. SAN DIEGO (KGTV) -- A new study by Zillow shows that homebuyers with lower credit scored pay more for the same homes than buyers with excellent credit scores.According to Zillow, borrowers with excellent credit scores could get a mortgage with a 4.5 percent annual percentage rate.Borrowers with a fair credit score could get a 5.1 percent rate. Over the lifetime of a 30-year mortgage, that means a buyer with a fair credit score may end up paying an additional ,000 over the lifetime of the loan.In San Diego, where the median home value in March of 2018 was 5,300, Zillow estimates that homebuyers with fair credit will pay ,000 for the same home.The difference is only amplified in more expensive markets, Zillow says. In addition, the penalty for lower credit scores tends to be higher."When you buy a home, your financial history determines your financial future," said Zillow senior economist Aaron Terrazas. "Homebuyers with weaker credit end up paying substantially higher costs over the lifetime of a home loan.
