A New York appeals court has denied a motion by President Donald Trump's attorney to stay the Summer Zervos defamation case pending appeal, meaning the gathering of evidence known as "discovery" can move forward as both parties await a ruling on the appeal.Zervos, a former "Apprentice" contestant, filed a lawsuit against Trump in January 2017 in which she alleged that Trump defamed her in 2016 after she said he sexually assaulted her in 2007.Trump's lawyer, Marc Kasowitz, is appealing the March 20 ruling by New York Supreme Court Justice Jennifer Schecter, who allowed the case to go forward. He wants the appellate court to revisit the matter of whether the Constitution's Supremacy Clause bars a state court from hearing an action against a sitting president -- what would be considered immunity, because it would make the President immune from suit. Schecter ruled it does not. Kasowitz also argues that Schecter erred in denying the President's motion to dismiss or delay the case on First Amendment grounds.Kasowitz said his motion should be granted on the grounds that New York and federal law both mandate a stay pending appeal, that proceeding with the case could irreparably harm Trump, and that the temporary suspension being sought was not designed to delay the case. But the Appellate Division of the New York Supreme Court denied his motion in a one-page ruling."We look forward to proving Ms. Zervos's claim that defendant lied when he maliciously attacked her for reporting his sexually abusive behavior," said Zervos' attorney, Mariann Meier Wang. Kasowitz did not immediately respond to a request for comment on the ruling.Earlier this month, Zervos' team issued subpoenas to Metro-Goldwyn-Mayer and the Beverly Hills Hotel as part of their effort to prove that Trump lied "when he falsely denigrated Ms. Zervos and denied sexually assaulting her," Wang said. She set a May 31 deadline for both companies to comply with the subpoena for the material requested.MGM owns the archives of "The Apprentice" and Wang wants the company to hand over all documents, video or audio that feature Zervos or Trump talking about Zervos and any recording in which Trump speaks of women in a sexual or inappropriate manner. Wang also wants to depose an MGM representative to inquire about how recordings of "The Apprentice" are stored and maintained, who has access to them, and when, if ever, they were transferred or destroyed.The subpoena asks for "(a)ll video and audio recordings that include Donald J. Trump talking or commenting on the female candidates or female potential candidates of any season of The Apprentice in any sexual or inappropriate manner, including without limitation any statements or comments by Donald J. A video of a woman who was allegedly resisting arrest while being beaten by police officers on a New Jersey beach on Saturday has been shared 1,000s of times since being published. Emily Weinman, a resident of Philadelphia, claimed that officers questioned her about underage drinking while she was on a beach in Wildwood, New Jersey. Weinman claimed that she was given an alcohol breath test, which came back negative. Weinman added in a Facebook post that the officers from the Wildwood, New Jersey Police were going to let her go, but when she asked officers why they were enforcing underage drinking rather than more serious crimes, that is when the officers had a change of heart. Weinman said that officers asked for her to identify herself, which she refused to do. Weinman claims an officer said, "I was gonna let you go but now I'll write you up." 894

A police officer in Columbus, Ohio, was arrested on Thursday on two child pornography related counts, Franklin County Prosecutor Ron O’Brien said.Officer Raymond Rose, 29, was arrested on two second degree felony counts of illegal use of a minor in nudity related material and for pandering obscene material involving a minor. Rose is accused by O’Brien’s office of illegally filming a nude minor on July 20, 2020 inside a Columbus residence.O’Brien said that Rose was a member of the police’s patrol division for five years.WCMH-TV confirmed that Rose was placed on administrative leave and does not have arrest power during his leave.“When criminal activity is discovered, our duty is to investigate and pursue the appropriate action based on the evidence,” Columbus Division of Police Chief Tom Quinlan said in a statement to WCMH. “The fact that it involves one of our own does not change that. The protection of children demands the highest level of priority and investigation. Regardless of who the accused is, we support every effort to ensure justice is done.” 1076

A new rule change will allow parents to get their children vaccinated at pharmacies in all 50 states.“Her pediatrician wanted her to have a pneumonia vaccine because of what’s going on with COVID. Unfortunately, the pediatrician doesn’t stock it, it’s expensive to order,” said Theresa Tolle, who owns a pharmacy in Florida.She was recalling a story involving one of her customers who needed to get her daughter a vaccine.“The Health Department didn’t have it and the mom was losing her mind. Calling everywhere and nobody, no pharmacy can give it because of the laws in our state,” said Tolle.It’s a story a lot of parents can relate to, especially around back-to-school time. Because of the laws in Florida and many states, Tolle, who is licensed to administer vaccines to adults, wasn’t able to do the same for this young girl.“Ultimately, what I ended up doing is ordering it for mom, ran it through her insurance, she picked it up, had it taken to the pediatrician to administer,” said Tolle.For many busy parents, making an additional appointment and taking time off to get their kids a shot can be a headache.But the Department of Health and Human Services just made a rule change that might make things easier. It allows for pharmacies in every state to administer vaccines to kids aged three to 18.According to the Centers for Disease Control and Prevention, after kids turn three, they should still get major immunizations like second doses of the measles, mumps, rubella, polio, tetanus, diphtheria and others. And don’t forget to add an annual flu shot.“As long as it increases vaccination rates, I think it’s fantastic,” said Dr. Malcolm Anderson.Anderson works in the Pediatric ICU at the Rocky Mountain Hospital for Children in Colorado. He’s very supportive of the rule change.“In the pediatric ICU, we only see the children that don’t get vaccinated and then when they get one of the illnesses they would have been protected against. That’s when we see them. So, I think anything that would help them get one of those bad illnesses would be amazing and help the parent avoid the stress and hardship of going through an ICU admission and seeing their kid very ill,” said Anderson.Before the rule change, 30 states had restrictions on vaccines being administered by pharmacies. Three states, including Florida, did not allow it at all.But now, pharmacies in all states can give flu shots to kids and adults.“This fall, they are heavily trying to promote flu shots to try and help protect all patients, all ages,” said Tolle.“If you’re at the pharmacy refilling your meds every three months or every month, then it’s nice to be like, oh, you’re offering flu shots here, I’m already getting my meds,” said Anderson.Theresa says she thinks that the rule change could also get the country ready for mass distribution of a COVID-19 vaccine.“Just COVID vaccine coming. We know little about that right now, but this order in theory would prepare pharmacists to be able to do that,” said Tolle.Until a COVID-19 vaccine comes, Tolle says she’s just happy to be able to give kids the immunizations they need to stay healthy. 3137

A Rikers Island inmate is back in police custody in New York after attempting to escape on Thursday, officials said.Around 12:30 p.m., the detainee climbed a recreation yard fence and ran to the shoreline, Deputy Commissioner of Public Information Peter Thorne said.The detainee was apprehended by K-9 Correction Officers Larry McCardle and Gregory Braska, Correction Officers' Benevolent Association President Elias Husamudeen said."These two brave officers immediately jumped into action to bring the inmate back into custody without any regards for their own safety," Husamudeen said.
