SAN DIEGO (KGTV) -- Police Tuesday identified the two men shot and killed near Mountain View Park Sunday.Police say 33-year-old Tony Jackson and 37-year-old Robert Brown were shot near South 40th Street and Ocean View Boulevard. Both men were taken to the hospital where they later died.According to police, the victims were standing near the Mountain View Community Center when they were shot around 1:20 p.m. Sunday.RELATED: Two dead after Mountain View shooting  The suspect was described only as a black man wearing dark clothing. SAN DIEGO (KGTV)- A trip to a dog park in Ocean Beach ended in a hospital visit for one San Diego couple.“I want her to go to jail, she assaulted my husband, and I’m angry about it,” said Ash O’Brien.O'Brien said she and her husband were at Dusty Rhodes Dog Park in Ocean Beach Thursday afternoon with their three-month-old puppy. They sat at a picnic table and began enjoying a meal when a woman reportedly confronted them for not wearing facial coverings and eating at the park where there is a no food policy.The confrontation ended with O’Brien’s husband being pepper-sprayed by the woman.“If we knew there was a no food policy, we wouldn’t have brought it into the park,” said O’Brien. “The lady who maced him automatically started saying stuff about us not wearing a mask when we were social distancing; there was no one near us.”O’Brien said that after exchanging words, the woman walked away from the picnic table but returned after a few minutes and did the unexpected.“She just came up without saying anything and just stuck the mace can right in front of my face,” said O’Brien.“My husband, being a good guy, walked in front of her and was like ‘hey calm down please don’t do this’ and then she grabbed him and just starting macing him, she used the entire can on him.”“We drove to the hospital, he got treated and everything,” said O’Brien.O’Brien said the pepper spray got on her arms and started to burn, while her husband was sprayed in the face.A witness captured part of the incident on camera and told ABC 10News she was shocked at what she was seeing. She recorded the woman’s license plate number.The couple filed a police report with the San Diego Police Department. The department confirmed they took a misdemeanor battery report but could not immediately provide further details.O’Brien was thankful none of the dogs at the park were injured by the pepper spray and wants the woman to be held accountable for the incident.“People don’t need to be getting assaulted for not wearing a mask in a public outdoor area,” she said. 2055

SAN DIEGO (KGTV) -- With a shortened and fanless baseball season underway, there is still confusion and legal challenges over refunds for tickets.Sydnie Gallegos lives in San Diego, but she is a loyal Dodgers fan. Every year, she and moe than a dozen of her family members see a game live at Dodgers Stadium. “We do it once a year, every year, for the last six years,” Gallegos said.Gallegos, like so many others, were left in the dark wondering what to do about tickets they bought.Her family bought tickets to a July 4th game back in March. “It was for 15 of me and my family members. That’s over ,400 just in tickets,” Gallegos said.Although Major League Baseball announced refund policies in April, Gallegos said they didn’t hear anything until July. They received an email from the Dodgers, offering ticketholders “with an account credit for all 2020 tickets and parking (plus applicable fees).”The team also added a 10 percent bonus credit, which could be applied for the 2021 season. A spokesperson for the Padres also said they’re also offering fans a refund or use their credit towards the 2021 season.Despite refunds now being issued to fans, a class action lawsuit over the issue continues. Several ticket buyers sued Major League Baseball, the teams, as well as StubHub, Ticketmaster, and Live Nation. The attorneys for the plaintiffs said they are still moving forward with the lawsuit because they “continue to pursue their claims so that each ticket purchaser for the MLB 2020 season will receive a full refund as soon as possible.”“As the season will have no fan attendance, Defendants have no reason to keep any of the ticket purchasers’ money,” attorney Blake Yagman wrote to Team 10. 1712

SAN DIEGO (KGTV) - Two San Diego area residents are asking the area's top two prosecutors to investigate and prosecute Assemblymember Todd Gloria for alleged violations of the Political Reform Act. According to a letter sent to San Diego County District Attorney Summer Stephan and San Diego City Attorney Mara Elliot, Kathryn Burton and Mat Wahlstrom allege Gloria "repeatedly violated PRA section 85200 by soliciting and receiving multiple contributions to his Assembly 2020 Committee before filing a statement of intent to run for the Assembly in 2020." The letter says, "without filing that statement, the FPPC's manual makes clear, he could not lawfully receive any funds into his Assembly 2020 Committee." The letter goes on to read, "my clients have reason to believe that there is a conspiracy to launder campaign money from an illegal campaign committee controlled by Mr. Gloria to the San Diego County Democratic Party, to a candidate to replace Mr. Gloria in the Assembly, and to several sitting members of the Assembly." According to the California Secretary of State's website, before raising any campaign funds, state candidates file "Statements of Intention" to run for a specific office. Candidates can file Statements of Intention for more than one office. Team 10 obtained Gloria's signed statement of intention, which shows the state received it on August 13, 2019. That's after the campaign committee was opened and filed a Recipient Committee Campaign Statement. Officials with the California Fair Political Practices Commission tell 10News the Assemblymember called FPPC Enforcement earlier this week and self-reported. Enforcement is determining the appropriate action moving forward. Team 10 reached out to Gloria's campaign, but as of this writing has not heard back.In a Tweet sent Wednesday Gloria wrote, "Some news reports have suggested that I am seeking re-election to the Assembly. I want to be very clear: I am not running for the Assembly, I am running for Mayor. My Assembly committee remains open to fulfill my responsibilities as a Member of the State Assembly until the end of my current term. The form filed by my committee yesterday (August 13th) simply corrected and administrative oversight that occurred when the original paperwork was filed months ago." A spokesperson for the District Attorney says they have received the letter but cannot confirm the existence of any potential investigation that may result. A spokesperson for the City Attorney tells 10News their office has received the letter from attorney David Kenney and is reviewing it. The allegations were first reported by La Prensa. 2777
