In a letter sent to 950 patients, University Hospitals Fertility Center blames human error for the loss of 4,000 eggs and embryos, twice the number initially reported.The letter says the Cleveland hospital is “heartbroken” to inform patients it is “unlikely” any of the eggs and embryos are viable.The letter says a remote alarm system on the storage tank containing the eggs and embryos, which was designed to alert a UH employee to temperature fluctuations, was turned off.It is unclear when the remote alarm was turned off, but an alert to an employee as the temperature inside the tank began to rise Saturday night was not sent or received, according to the letter.It is also unclear who turned off the alarm and how long the alarm was turned off.The lab was not staffed March 3, the night of the malfunction. There was also a history of malfunctions involving the storage tank.In the letter, UH said the storage tank in question “needed preventative maintenance.”For weeks prior to the malfunction on March 3, “we experienced difficulty with what is called the liquid nitrogen automatic fill” and were working with the manufacturer to correct the problem.“My clients’ lives and future aspirations were crushed and destroyed. Finding out how simple of a matter it would have been to prevent this tragedy shakes my faith in the medical profession to the core,” said Brian Taubman, an attorney representing patients affected by the malfunction, in a statement to Scripps station WEWS in Cleveland. “My clients trusted UH with their future family, never doubting that those lives were safeguarded and with the flip of a switch their lives and potential lives were changed forever,” said Taubman.The hospital also says it takes responsibility for the failures and apologized several times to the affected patients. Ice pops shipped to multiple states were recalled Monday because of concerns they may be contaminated with listeria.According to the FDA, approximately 3,000 cases of Budget $aver Cherry Pineapple Monster Pops and Sugar Free Twin Pops, produced by the Ziegenfelder Company of Wheeling, W. Va., are part of a voluntary recall.The ice pops were distributed to grocery stores and distributors in the following states: Florida, Alabama, Arkansas, Maine, Missouri, Nebraska, Nevada, New Mexico, New York, Ohio, Oklahoma, Texas, Utah, Washington and Wyoming.The product was delivered from April 5 through April 19, 2018.No illnesses or incidents involving the product have been reported.The frozen products were sold 12 to a package under the brand names Budget $aver Cherry Pineapple Monster Pops and Sugar Free Twin Pops.The Cherry Pineapple Monster Pops carry the UPC code 0-74534-84200-9, and have lot codes D09418A through D10018B.The Sugar Free Pops carry the UPC code 0-74534-75642-9, and have lot codes D09318A through D10018B. The voluntary recall was the result of a routine state inspection of the company’s Denver production facility which found listeria in samples collected by the inspector.The FDA said that Ziegenfelder Company has stopped the production and distribution at the plant as the state of Colorado and the company continue to investigate the problem.Consumers who have purchased the affected ice pops are urged to return them to the place of purchase for a full refund. Hurricane Delta has made landfall near Creole, Louisiana, as a Category 2 hurricane, but as it's moved inland, it has weakened to a Category 1 storm.WATCH LIVE: According to the National Hurricane Center, the storm made landfall at 6 p.m. CT with maximum sustained winds of 100 mph.A Florida Coastal Monitoring Tower near Lake Arthur, Louisiana, sustained wind of 77 mph and a gust to 96 mph, the NHC said.
