WASHINGTON (AP) — A federal appeals court said Thursday it plans to review a decision ordering the dismissal of the Justice Department’s case against former Trump national security adviser Michael Flynn.The action by the U.S. Circuit Court of Appeals for the District of Columbia is likely to prolong the fight over Flynn’s fate and represents yet another dramatic development in a case that has taken unexpected twists and turns over the last year and turned Flynn into something of a cause celebre for President Donald Trump and his supporters.Flynn pleaded guilty in 2017 to lying to FBI agents about his conversations with a Russian diplomat ahead of the inauguration of President Donald Trump.The court set arguments for Aug. 11. It did not offer an explanation for its decision in a brief order posted online, saying only "FURTHER ORDERED that oral argument before the en banc court be heard at 9:30 a.m. on Tuesday, August 11, 2020. The parties should be prepared to address whether there are 'no other adequate means to attain the relief' desired."A three-judge panel of the court ruled 2-1 last month that U.S. District Judge Emmet Sullivan had overstepped his bounds by not granting the Justice Department’s request to dismiss the case against Flynn.The Justice Department in May moved to dismiss the case against Flynn, one of the signature prosecutions of special counsel Robert Mueller’s investigation into Russian election interference.The motion followed a review by a U.S. attorney appointed by Attorney General William Barr to scrutinize the case.But rather than immediately dismiss the case, Sullivan appointed a retired federal judge to argue against the Justice Department’s position and to consider whether Flynn could be held in criminal contempt for perjury. Flynn’s lawyers asked the appeals court to step in and order Sullivan to grant the department’s request. 1894

They decided to take on a project to make desks for CHIP, a child readiness non-profit advocacy program.“They’re going primarily to low-income homes, kids that just need a desk,” said Trish O’Brien, President of CHIP of South Hampton Roads.Machines and manpower are churning out the pieces that will become desks for hundreds of CHIP families.There’s no hardware, no tools, just four pieces that easily interlock in under a minute to create a temporary space that a child can call their own at no cost to mom and dad.“At the end of the day, they can disassemble them, slide them under the couch, stick them in the closet, put them away for the weekend, and then the next day, put them back together and be ready to work,” said Melnyk.Each desk cost .50 to build thanks to employees who are donating their time to keep labor costs at zero.Last Saturday, the crew built 110 desks. WARNING: Some might find the video disturbing due to content and languageDELRAY BEACH, Fla.-- Delray Beach, Florida police officers responded to a call Saturday of a woman and children standing on a roof. When they got there, they say they found a 23-year-old woman who was hallucinating and two small children on the garage ledge on a townhouse. Officer Rob Addea got under the window, ready to catch a child or the woman if necessary, police said.“Just get the kids back inside,” Addea said.Two other officers went upstairs and out a window to the ledge and one grabbed the children's arms while the other tried to reason with the woman, police said.Police eventually were able to rescue all of them.Body camera video recorded the actions of the officers. The woman has been committed to a mental health facility under the Baker Act and might face criminal charges, police said.The Florida Department of Children and Families is investigating and the children are in their custody.  1032

  

VISTA (CNS) - An Oceanside physician who sexually assaulted five female patients referred by the U.S. Department of Veterans Affairs was sentenced Thursday to three years probation and was ordered to register as a sex offender and surrender his medical license.Dr. Edgar Manzanera, 39, could face three years in state prison if he violates the terms of his probation.Manzanera, who was contracted by the VA to review pension disability claims, pleaded guilty last September to one count of sexual exploitation by a physician for acts committed in 2015 and 2016, and admitted a special allegation of committing acts against multiple victims.RELATED: Former doctor pleads guilty to sexual misconductFour counts of sexual penetration with a foreign object were dismissed as part of the plea."The victims placed the defendant in a position of inherent trust and confidence and the defendant betrayed that trust," Deputy District Attorney Claudia Plascencia said when Manzanera pleaded guilty.
