SAN DIEGO (KGTV) - "It's not fair and it's not right," says Warren Peters of Spring Valley. He says he's been watching his son, Jahmes, spend several months fighting for his federal tax return. "People need this money. People have worked for this money. People have earned this money," says 24 year-old Jahmes. The young man tells Team 10 that he filed online in February and received his state refund, but not his federal refund. It's now been more than 7 months. A return summary shows he's owed almost ,200 from the IRS.Jahmes says he's between jobs and burning through his savings. His father tries to help but says he's retired and on a fixed income, so his means are limited."It doesn't feel too good depending on your dad at 24-years-old," Jahmes tells Team 10. Jahmes says he has repeatedly called, emailed and written to the IRS. He adds he was once asked to appear in-person to verify identity, which he says he completed. However, he says his efforts didn't yield clear answers from the IRS.On the IRS website, he showed us what he says is his filing status. "Your tax return is still being processed," is what it reads. "If the circumstances were different, [the IRS] would be knocking on [our] door looking for their money," says Warren Peters. "The IRS is just understaffed and overworked," says tax attorney Ronson Shamoun, CEO of Downtown San Diego's RJS Law Firm. He says long delays are not uncommon. "Yet, after it's been so long, there should be some indication as to what's going on or some sort of game plan as to what you can do."Shamoun says the best route to take is contacting the Taxpayer Advocate Service, which was created by Congress to facilitate aid for taxpayers dealing with related issues. The IRS website reports that most refunds are issued in less than 21 calendar days, but explains there are a number of reasons for delays, including possible errors, incomplete returns, and concerns about identity theft or fraud. The IRS says it cannot respond to media inquiries about specific cases."He does have a right to be upset. He definitely does," says Shamoun. SAN DIEGO (KGTV) - 36,000 pounds of cocaine seized in the Eastern Pacific Ocean will be offloaded Tuesday from the U.S. Coast Guard Cutter Bertholf onto San Diego’s B Street Pier. The contraband is from 17 busts on smuggling vessels off the coasts of Central and South America, officials said. Five Coast Guard cutters were involved in the seizures between early February and early March.Rear Adm. Todd Sokalzuk, the 11th Coast Guard District commander who oversees the law enforcement phase of counter-smuggling operations in the Eastern Pacific region, said the Coast Guard is seizing record amounts of cocaine for the third year in a row.“I’m proud of the hard work and dedication of my crew, as well as the crews of Coast Guard Cutters Bear, Diligence, Harriet Lane, Venturous and the joint and interagency personnel who work hand-in-hand to secure our nation,” said Capt. John Driscoll, the Bertholf’s commanding officer. “These crews worked around-the-clock to seize this load of contraband that denies traffickers about half a billion dollars’ worth of illicit proceeds that would have gone to fund the nefarious work of transnational criminal organizations, helps prevent a great deal of human suffering and will likely save hundreds of lives that would have been lost to these illegal drugs.” 1314

SAN DIEGO (KGTV) - A family wants the Governor of California to keep the man who murdered three San Diego State professors behind bars. Frederick Davidson was sent to prison in 1997 for three consecutive life sentences without parole after he gunned down his three engineering professors Chen Liang, Preston Lowry, and Constantinos Lyrintzis. The San Diego County District Attorney’s Office recently notified the victims’ families that Davidson applied for executive clemency.“Just asking for clemency? Out of what? On what grounds?” asked a distraught Esther Alonso, Lyrintzis’ sister-in-law. Lyrintzis was married to her sister, Deana Alonso, and the couple had a young daughter.A District Attorney’s Office spokesman said the DA’s office already filed a letter opposing Davidson’s request.Alonso told 10News she could not believe Davidson would request clemency. Alonso said the family agreed to not seek the death penalty in 1997 if Davidson agreed to plead guilty and go to prison for life without parole.“How can they tell them 20 years later that the deaths of their husbands and their fathers…that this guy has more rights than they do?” asked Alonso, a professor at Southwestern College. “I don’t understand a system where that is even possible.”Alonso created a Change.org petition directed at Governor Jerry Brown asking him to deny Davidson’s request. The DA’s spokesman said their office opposed more than 50 clemency requests last year and none of those requests were granted. The spokesman added there is no deadline for Governor Brown to respond or send it to a hearing. 1627
