(CNN) -- A Michigan lottery winner must share the million windfall with his ex-wife, even though they were in the process of divorcing when he bought the ticket.Richard Zelasko won an million Mega Millions jackpot in July 2013 -- after taxes and fees his prize was ,873,628, according to an opinion issued last week by the Michigan Court of Appeals.The suburban Detroit man and his then-wife, Mary Elizabeth Zelasko, filed for divorce in late 2011. The case had gone to arbitration, and they were waiting for the arbitrator's opinion when Richard Zelasko won the prize.The couple were married in 2004 and have three children.The arbitrator ruled that the ticket was part of the couple's marital assets and awarded million to the wife and divided the rest of their assets, according to the opinion. He said that the "marital property includes all property acquired from the date of marriage until the date of entry of the divorce decree," including property acquired during a separation.The court also cited the arbitrator's opinion that the winning lottery ticket was probably not the first that Richard Zelesko had purchased during the marriage and that "(a)s losses throughout the marriage were incurred jointly, so should winnings be shared jointly."It's true that Zelasko spent to buy the winning ticket; however, "the dollar spent was arguably marital money and, as such, a joint investment," the arbitrator said.The appellate court said it found no errors that would require it to change the award."It's very difficult to overturn an arbitration," said Michael Robbins, who's represented Richard Zelasko since 2015.Robbins told CNN that the couple had been separated since 2009.An attorney for Mary Elizabeth Zelasko told CNN that he would not comment on the case because it is confidential.The couple's divorce was finalized in 2018.Robbins said his client can appeal the ruling and is "considering his options." 1945

 OCEANSIDE (CNS) - An electronic device that can bring down drone aircraft, presumably as they interfere with emergency firefighting planes and police helicopters, has been obtained by Oceanside police, it was reported Saturday.Oceanside police and the Los Angeles County Sheriff's Department were among the first police agencies to acquire a "Drone Killer" from IXI Technology, a Yorba Linda company that supplies electronic equipment to the U.S. armed forces, the San Diego Union-Tribune reported Saturday. Deputies deployed the anti-drone device at the 2017 Rose Parade.IXI Technology agreed to donate the ,000 drone-incapacitating weapon to Oceanside police and made a presentation to the Oceanside City Council on March 28, the Union-Tribune reported."The purpose is primarily for emergency situations," Oceanside police Lt. Aaron Doyle told the newspaper. "It won't be used when someone complains about a neighbor flying a drone. It's pretty much for a life-or-death situation, to save lives."Drones can force authorities to ground air operations to avoid collisions. That's what happened in December during the Lilac fire, when aerial firefighting had to be called off for more than an hour due to a drone in the area.The device can be pointed at a drone in the air and will cut off communication between it and its operator, the Union-Tribune reported. A drone targeted by the device will either hover in place, return to the place it was launched or simply land, depending on its programming.The device can disable most drone models, IXI Technology's Andy Morabe told the Union-Tribune. When the drone killer encounter's a drone it can't stop, the company plans to rewrite software to remedy the problem within days, Morabe said. 1754

 SAN DIEGO (CNS) - Years of drought and a significant build-up of grass from last winter's rains has created dangerous wildfire conditions in San Diego and surrounding areas of the county, San Diego Fire-Rescue Department Chief Brian Fennessy said Monday.In a report delivered to the City Council's Public Safety and Livable Neighborhoods Committee, the chief said people think the winter rains will ease the fire threat this fall."Well, it did, in the green-up period in the spring, but all that new growth dies," Fennessy said.RELATED: It's Wildfire Season! The conditions have led to a large amount of small roadside fires this year, often caused by malfunctioning catalytic converters in vehicles, he said."On top of the five years of drought we experienced, we've got vast accumulations of dead fuel mixed in with this dried, light fuel type," Fennessy said. "I've been doing this nearly 40 years, and I don't know that I've seen the fuels as stricken and as in dire need of moisture as it is now."His report said the weather forecast calls for little to no rainfall this fall.Geologist Dr. Pat Abbott walked the trailhead at the base of Cowles Mountain with 10News.  "You see all the classic elements; the drying out of flat-top buckwheat, a lot of dried grasses. All the rains we've had this year, a lot of grasses have burned; they don't have a lot of fuel but they burn so fast they're almost like wicks to the denser chaparral. The five-year average for the same time period is nearly 4,000 blazes and 198,000 acres, according to data from Cal Fire, which provides fire protection outside major cities.While the conditions for wildfires could be risky, the department is adequately staffed and equipped to respond to blazes that break out, Fennessy said. He said the SDFRD has a dozen brush engines, two water-dropping helicopters and access to the San Diego Gas & Electric heli-tanker.City crews have also been inspecting properties along canyon rims for overgrown brush, he said. 2624
