(KGTV) -- The man caught on video being arrested outside a La Mesa trolley stop has filed a lawsuit against the City of La Mesa.The lawsuit was filed by Amaurie Johnson against the City of La Mesa, Matt Dages, and six John Does.The lawsuit alleges arrest without a probable cause, negligence, excessive force, and violence because of race.The suit comes after viral video showed Johnson’s controversial arrest outside a La Mesa trolley stop in June. In the video, an officer is seen pushing Johnson into a sitting position on a bench. Eventually, Johnson is handcuffed and told he is being arrested for assaulting an officer.RELATED: VIDEO: Incident between La Mesa officer, man at trolley station surfacesLa Mesa demonstration highlights several anti-police brutality ralliesThe La Mesa Police Department announced later in June that it had dropped charges against Johnson.“After a full review of all of the evidence in the criminal investigation" against Johnson, the police department will not seek prosecution "on any of the alleged misdemeanor charges,” La Mesa Chief of Police Walt Vasquez said."We do believe that the officer should be investigated for potential criminal liability, but there is also a civil aspect to this. Mr. Johnson and I are discussing our options as far as moving forward with a complaint with the city of la mesa and potentially taking this to state or federal court," Johnson's attorney Troy Owens said in a previous news release. Troy Owens, Johnson's attorney, told ABC 10News, "Mr. Johnson does not feel that his situation or his experience is unique. And we're seeing a pattern of behavior specifically coming from the City of La Mesa and the La Mesa police department, and that is upsetting to everyone."Owens added, "The City of La Mesa pledged transparency and pledged accountability, and we are seeing the exact opposite of that. We're seeing closed investigations. We're seeing no action being taken we're not being given any information, and it's upsetting ... It appears as though law enforcement in the City of La Mesa is not calming down, it appears as though they escalated instead of de-escalating situations, and that is concerning.""We're being given the runaround, and we're tired of that. Lawyers for CNN and the Trump administration are awaiting an initial ruling on the network's federal lawsuit over press access to the White House.And they're going to have to wait a little while longer.Judge Timothy J. Kelly heard nearly two hours of oral arguments about CNN's request for a temporary restraining order and preliminary injunction on Wednesday. Then he said court would reconvene Thursday at 3 p.m.But on Thursday afternoon, he rescheduled the next hearing for Friday at 10 a.m.If Kelly grants CNN's requests on Friday, CNN chief White House correspondent Jim Acosta would get his press pass back for a short period of time. If it's denied, Acosta's pass will remain suspended.Either way, this is just round one. By filing for a temporary restraining order, CNN is seeking what's known as "emergency relief." CNN is arguing that Acosta's First Amendment rights are being violated every day he is banned from White House grounds.CNN is also asking for "permanent relief," meaning a declaration from the judge that Trump's revocation of Acosta's press pass was unconstitutional. This legal conclusion could protect other reporters from retaliation by the administration.But the judge will not be ruling on that yet. Kelly is only expected to weigh in on the temporary status of Acosta's press pass.Further hearings are likely to take place in the next few weeks, according to CNN's lawyers.The lawsuit alleges violations of the First and Fifth Amendments.Kelly, a Trump appointee, has been on the federal bench just more than a year now. He was very inquisitive at Wednesday's hearing, asking tough questions of both sides, drilling particularly deep into some of CNN's arguments.A Justice Department lawyer, James Burnham, argued that the Trump White House has the legal right to kick out any reporter at any time for any reason.Burnham, who's been tasked with defending President Trump and several White House aides from CNN and Jim Acosta's lawsuit, was responding to a hypothetical from Kelly. Burnham said that it would be perfectly legal for the White House to revoke a journalist's press pass if it didn't agree with their reporting. "As a matter of law... yes," he said.Burnham's comment in court made the stakes of CNN v. Trump crystal clear.Attorney Theodore Boutrous, representing CNN in court, called Trump's move to revoke Acosta's hard pass "the definition of arbitrariness and capriciousness.""What are the standards?" Boutrous asked. "Rudeness is not a standard. If it were, no one could have gone to the press conference."Boutrous also commented that Trump is "the most aggressive, dare I say rude, person in the room" at press conferences.Burnham said CNN had made an "odd First Amendment injury" claim and suggested that Acosta could do his job "just as effectively" watching the president's appearances piped into a studio on CNN. LA MESA, Calif. (KGTV) -- At least three people were hospitalized Wednesday morning after a multi-vehicle collision on a La Mesa-area freeway caused by a wrong-way driver.At around 4:30 a.m., the California Highway Patrol received reports of a gray Honda According traveling the wrong way on northbound state Route 125 near Grossmont Boulevard.The CHP said the Accord collided with a Toyota SUV, disabling both vehicles. According to the CHP, the wrong-way driver ditched his damaged vehicle in the middle lanes and then left the scene on foot.Moments later, several other vehicles crashed into the Accord-Toyota wreckage.ABC 10News learned at least three people in the second crash were taken to the hospital with injuries of unknown severity.The incident forced the closure of all northbound SR-125 lanes at Lemon Avenue at around 4:50 a.m. Lanes were expected to reopen by 6 a.m.A description of the wrong-way driver was not immediately available. 958

  

LAKELAND, Fla. -- A 90-year-old Florida man who dressed in full protective gear to say goodbye to his wife, has died of COVID-19.In a Facebook post, Sam Reck's son-in-law shared the news that Sam has died.JoAnn Reck, Sam's wife of 30 years, died a few weeks earlier after battling COVID-19. She was 86 years old and Sam was 90.Sam Reck had been separated from his wife JoAnn Reck during the pandemic after the state placed a ban on visitors at nursing homes. JoAnn lived in a nursing home and suffered from dementia, and Sam lived in an apartment nearby.Family members said the couple would schedule socially-distant visits once Sam couldn't visit the home any more.
