KGTV - The Department of Fair Employment and Housing has filed a civil rights lawsuit on behalf of an Oceanside woman who says her life is threatened by the chemicals the North County Transit District uses for weeds.Judy Kane has multiple chemical sensitivities and says she has trouble breathing along with going outside anytime the NCTD sprays herbicides around the tracks near her house.“I call it shelter in place,” said Kane, “I cannot do my normal day to day activities.”Kane had a reasonable accommodation agreement made roughly 10 years ago via email with NCTD and the agency used to weed wack the four block row near her house instead of using chemicals.However, at the end of 2016 NCTD began spraying again, dissolving their agreement.The lawsuit is asking NCTD to stop using the chemicals in the area around Kane’s home and also pay Kane’s expenses from medical episodes which occurred after the spraying began.NCTD did not return 10News request for comment. 977

KANSAS CITY, Mo. — One of the men indicted for the death of 10-year-old boy on a water slide in 2016 is also facing a bankruptcy in Texas.Jeff Henry, the co-owner of Schlitterbahn water parks in Kansas City, Kansas and Corpus Christi, Texas is scheduled to appear in a Kansas City, Kansas, courtroom next week.The Corpus Christi location is part of an ongoing bankruptcy.According to court records, Jeff Henry and his brother Gary Henry were behind a company called Upper Padre Partners (UPP).Those same records show UPP had more than million in unexplained cost overruns for the Corpus Christi water park.That figure is more than double what it was expected to cost to build the complex, which also includes a nine-hole golf course.Companies the Henrys borrowed money from accuse them of mismanagement and misappropriation of funds.Right now, a court-appointed trustee runs Upper Padre Partners, and submits monthly financial reports to the court.The newest report, for February, was submitted last week.Court records show a company called Axys loaned UPP million in February 2015.By November 2016, three months after 10-year-old Caleb Schwab was killed while riding a slide in the Kansas City park, that million was in default.Axys foreclosed on a piece of property next to the Corpus Christi water park and is attempting to sell it to get some of its money back.An attorney for Axys said UPP still owes the company millions of dollars.Court records show UPP also owes International Bank of Commerce more than million.That bank has put claims known as liens on both the water park and the golf course. 1662

(KGTV) — Coast Boulevard in La Jolla was shut down Thursday, and will remain temporarily closed, as city crews began emergency construction to stabilize a nearby cave.The city closed Coast Blvd. late Thursday to begin an emergency project to stabilize Cook's Crack after geology experts discovered a zone of weakness in the cave, which is located underneath the street.During a press conference, crews said the concern is an outright collapse of the section of road over the cave. Currently, the weakness "is not a slow settlement" and could fail if erosion happens underneath the street. Much of the dense rock had eroded, and now sand and roots were showing through from underneath.As part of the project, sections of Cave St. and Coast Blvd. will be temporarily closed to traffic for about six weeks. The city said it will make accommodations for nearby residents and business affected by the closure.Officials said the discovery came as the city assessed repairs to Coast Blvd."They said there's been some shift in the road itself," David Heine, owner of nearby Brockton Villa Restaurant, said. "The busiest two weeks of summer, literally ... Obviously safety's the number one concern for any city, and we respect that." Heine said crews are allowing pedestrians to continue to walk through the area.The city called in crews from Texas, who drove in overnight to take over the project. Friday, the crews began drilling into the street above to locate some of the weakest points. Eco-friendly polyurethane will be used to shore up those weak points, crews say.Cook's Crack is located in the area between La Jolla Cove and the popular Cave Store.
