CARLSBAD (KGTV) -- A slope in Carlsbad is moving, affecting a senior community on top of it. The question of who is responsible for paying to fix it has the City of Carlsbad battling with those who live in Camino Hills.“It’s been a tremendously stressful experience for everyone,” said Mike Perry, who has lived in Camino Hills since 2001. Joe Matthews has called the Camino Hills community his home for about 19 years. “We have lunch out here, sometimes dinner,” Matthews said, as he showed Team 10 the front patio area where he relaxes with his wife. “The grandkids come visit.”“It’s a really wonderful community,” Mathews added. What he did not know was something was going on beneath the surface. “It came as a real surprise,” Matthews said. According to court documents filed by the Camino Hills Homeowners Association in 2018, the City of Carlsbad noticed damage to the pavement and sidewalk right by Camino Hills Drive back in 2007. In January 2009, a geotechnical firm placed devices in the slope to track the movement. There was more slope movement detected during the El Ni?o rainstorms from 2016 and 2017.To fix the issue, it could cost anywhere from 0,000 to about million, according to Elizabeth French. French represents the Camino Hills Homeowners Association. She said the city did not fix the problem properly in the first place. “The city actually knew that there was an ancient landslide at this location and rather than make the developer make a more expensive repair, they allowed the developer to put in a subsurface buttress made of soil, but in recognition that that wasn’t the best repair,” French said. She said when this community was being built, the City of Carlsbad entered an agreement with the developer of Camino Hills. In the indemnity agreement, French said it required the developer to fix any problems for up to 10 years after the community was built. Camino Hills was built in the mid-1980s and the developer is now out of business. French said the city is now asking the residents of Camino Hills to foot the bill.“There’s nothing in this association’s government documents alerting any of the prospective purchasers that there’s this enormous liability out there, that they could be tasked with addressing down the road and that kind of notice is required in the law,” French said.Joanne Stout’s modular home is right by Camino Hills Drive. “This is it. This is where I’m going to be until they carry me out of here,” Stout said. CAMPO (CNS) - At least one person was fatally injured in a two-vehicle crash Friday evening on Route 94 in Campo, according to the California Highway Patrol.The crash took place on Route 94 -- Campo Road -- at the intersection with Sheridan Road about 7 p.m., the CHP reported.The person's name was withheld pending family notification. There's no word yet on the gender or age of the victim. No information on other injuries was immediately available.At least one dog was also injured in the crash, the CHP said. Three others were transported to a nearby hospital with injuries.Campo Road was temporarily closed at 9:55 p.m. for the crash and death investigation. The roadway was reopened about 11:05 p.m., the CHP said.Campo is a small town in the southeastern portion of San Diego County. 799

Chad Daybell, the husband of a woman whose children have been missing since September, appeared in court on Wednesday after two sets of human remains were found on his property.During Wednesday's court appearance, prosecutor Rob Wood said the remains were those of 7-year-old Joshua "JJ" Vallow and 17-year-old Tylee Ryan, both of whom have been missing since September.Kay Woodcock, JJ's grandmother, also confirmed to East Idaho News that one set of the remains are those of her grandson's.Police have not yet publicly confirmed the identity of the remains.Daybell faces two counts of evidence destruction, alteration or concealment. His bail was set at million. Should Daybell make bail, he will be required to stay in certain parts of Idaho and will wear an ankle monitor. He also cannot have contact with the families of the victims. Daybell was arrested Tuesday shortly after police served a search warrant on his home in Idaho. Two criminal complaints allege Daybell willfully concealed or aided and abetted in the willful concealment of human remains, "knowing that said human remains were about to be produced, used and/or discovered as evidence in a felony proceeding, inquiry and/or investigation authorized by law, with the intent to prevent it from being so produced, used and/or discovered."Daybell is married to Lori Vallow, the mother of JJ and Tylee. She was arrested in Hawaii in connection with her children's disappearance on Feb. 20 and was extradited back to Idaho. She remained jailed despite several attempts to lower her bond.JJ and Tylee went missing in September, shortly after Daybell and Vallow married. Daybell's former wife, Tammy, died of what was believed to be natural causes shortly before Daybell and Vallow married. CARLSBAD (CNS) -- A state appellate court panel reversed the molestation conviction Friday for a former Carlsbad military boarding school administrator who was tried twice on allegations that he molested a cadet at the Army and Navy Academy.Jeffrey Barton, 62, was convicted in 2017 of five felony counts of forcible oral copulation and one felony count of forcible sodomy for allegedly molesting a cadet beginning in 1999, when the alleged victim was 14 years old.Barton was sentenced to 48 years in state prison for the conviction.A three-justice panel from the Fourth District Court of Appeal agreed with Barton's contentions that the trial judge should not have dismissed one of the jurors during the trial.The panel ruled Friday that Barton's trial may very well have concluded differently had the juror not been excused, allegedly for refusing to deliberate with her fellow panelists.The justices wrote in their ruling that the other jurors appeared to disagree with Juror No. 12, but did not provide enough of a showing that she was actively stalling deliberations.The ruling indicates the juror did not appear to find the alleged victim credible."The trial court's error in discharging Juror No. 12 warrants reversal," the panel wrote. "She was the lone holdout juror who consistently held to her belief Barton was not guilty and, had she remained on the jury, it is reasonably probable the case would have ended in a mistrial, a more favorable result for Barton than conviction."The panel wrote that Barton was convicted "within hours" of the juror being discharged.The convictions came in Barton's second trial.In his first trial, almost two years before , a different jury deadlocked on the charges involving the alleged victim.Two other former Army and Navy Academy students testified in the first trial that they were molested by Barton, but the defendant was acquitted on those charges. 1908
