On video captured by witnesses, Lushchinskaya can be heard calling the woman a racial slur.Lushchinskaya was apprehended at the 36th Street Station and arrested, the NYPD said.CNN could not reach Lushchinskaya or her attorneys for comment Friday.Lushchinskaya was arraigned in Kings County Criminal Court following the incident, according to Brooklyn District Attorney spokesperson Oren Yaniv. She pleaded not guilty and posted ,000 cash bond, according to court records.She is due back in court January 22.The victim suffered cuts to her face, the NYPD said. She told CNN affiliate WABC, which said she wanted to remain anonymous, that she was grateful people intervened.A 30-year old good Samaritan suffered scratches when he intervened, the NYPD said.Several subway riders captured the tirade on video. The incident has since been viewed by millions of people on social media.The video shows the woman yelling profanities at the victim and calling another rider "retarded.""F*** off," Lushchinskaya allegedly said several times before striking the victim with her hand.She then took off her sunglasses and gloves, pulled her hair back and took her umbrella and keys from her bag, according to the video. Then, she began kicking the woman, who defended herself.Passengers intervened, trying to restrain Lushchinskaya, and told her to stop. One person threatened to call the police.The video shows Lushchinskaya striking the woman several times with her umbrella and her keys and again kicking her."She's not even fighting you back," one person is heard saying.At least two subway riders tried to wrestle the umbrella away.Lushchinskaya is seen spitting in the direction of the victim before yelling more profanity and a racial slur.Juan Ayala, who was filming the incident, said he decided to intervene, but Lushchinskaya lashed out at him. A video posted by another user shows Ayala talking to Lushchinskaya."Do not spit at me," Ayala says in the video, to which Lushchinskaya replies, "What are you, her attorney? F***ing Mohammed."The subway car erupts in a gasp and Ayala gives his reply: "What? B****, I'm Dominican!"Fellow subway riders protested. "Your white privilege ain't working over here," one man is heard saying.The victim told WABC she felt lucky the woman didn't have a weapon like a gun or a knife "because it could have got a lot worse.""I'm lucky that people were on the train who were helping me, especially the first Asian guy who stood in front of me right away because he wasn't recording. He just stood in front of me to help me, because I know other people were recording, but their recording didn't do anything until later on when it escalated," she said.This is Lushchinskaya's second arrest this year for a subway altercation -- both took place at the 36th Street Station in Brooklyn. In June, she was arrested for allegedly pepper spraying a man and woman, according to DCPI detective Sophia Mason. Both were Hispanic. A body found in Costa Rica has been identified as a Florida woman who went missing while she was on vacation, according to her family. The father and brother of Carla Stefaniak identified the body as the 36-year-old Tuesday night.During an exclusive interview with ABC Action News, Stefaniak's father, Carlos, said his heart shattered when he saw her body.Costa Rica's Judicial Investigation Agency (OIJ) said an autopsy performed on her body showed that she had stab wounds around the neck and extremities and blunt-force trauma to the head.Family friend, Greg Zwolinsky, who is with them in Costa Rica, said he wants everyone to remember Stefaniak based on the radiance of her personality that is portrayed in pictures of her smiling.On Monday, a spokesperson for the OIJ confirmed that remains were found. The body was found in a wooded area as investigators combed through the region, roughly 1,000 feet away from where Miami resident and Tampa native, Carla Stefaniak, spent what was supposed to be her final night in Costa Rica last week, Judicial Investigator Director Walter Espinoza said in a press conference. On Monday night around 11 p.m., OIJ officials detained a security guard at the apartment complex, 32-year-old Bismarck Espinoza Martínez. Martínez has been in Costa Rica since June 2018.After Stefaniak was reported missing, agents began to investigate where she was last seen. Officials say that Martínez had the time and space to commit this crime and became a suspect because of the investigation. Specifically, his statements did not match video surveillance in and around the area at that time.In addition, fluids found in the apartment where Stefaniak was staying have the consistency of blood, OIJ officials said.Stefaniak traveled to Costa Rica to celebrate her 36th birthday, according to the family. She left for Costa Rica on Thanksgiving Day but had not been heard from since Tuesday, her brother, Carlos Caicedo, told ABC Action News.Meanwhile, the lawyer representing the complex that houses the Airbnb told ABC Action News they were "deeply saddened and devastated by the tragic events that occurred last week" and said that the owners were cooperating with authorities. He said the rental had been temporarily closed while officials conduct the investigation. The lawyer released the following statement:"Since 2013, Villa Le Mas has operated a small vacation rental facility located at San Antonio, Escazu, Costa Rica. We have received over a thousand guests with wonderful reviews about the property and our service.We are deeply saddened and devastated by the tragic events that occurred last week. The owners are fully cooperating with the authorities in the investigation and we hope that once the facts are determined, the perpetrator is brought to justice.Our deepest sympathies are with the family of the victim of this horrible crime.While the investigation is ongoing, and since the focus of the owners is the comfort of our guests, the facility has been temporarily closed."Now that Stefaniak has been identified by her family, they say they will continue to press Costa Rican officials for more information on who killed her.  3301

  

A driver was killed on Interstate 24 when a piece of concrete went through his windshield. Police said the object was likely thrown. The incident happened around 5 a.m. Tuesday near Shelby Avenue. Officials with Metro Nashville police said 54-year-old Joe C. A chicken processing plant in central California will close for about a week starting Tuesday for deep cleaning and to test every employee for COVID-19 after at least eight employees have died from the virus.The Foster Farms Livingston Poultry Complex in Merced County was declared an outbreak site at the end of June, and county health officials have been working with the company to implement safety measures before the shutdown was ordered.In addition to the eight employees who have died, 392 have tested positive for COVID-19.“We agree that the best approach to ensuring the future safety of our Livingston plant workers is to begin anew with a clean slate,” a statement from the company reads. The plant will close Tuesday, September 1 and reopen September 7.“During this downtime, the company will complete two rounds of deep cleaning and two rounds of COVID-19 testing covering all 1,400 plant employees,” the company states.The plant was originally ordered to shut down last week, but after conversations with the US Department of Agriculture and county health officials, the closure was moved to September 1, according to local media reports.“MCDPH allowed Foster Farms additional time before closure due to the massive coordination efforts required to prepare the facility for appropriate disinfection and safe removal of poultry,” the county said in a press release.Merced County Department of Health says all employees will need to test negative twice within seven days in order to return to work at the plant.In addition, the health department says Foster Farms needs to make changes to their social distancing of employees on-the-job, expanded break areas, proper personal protection equipment for employees and “other hygiene measures.”“We further agree with the Merced Public Health Department that opportunities exist to enhance social distancing, add to professional healthcare staffing that will oversee COVID-19 programs, and improve COVID-19 related employee communication,” Foster Farms stated. 2025
