A federal court has ruled that President Donald Trump cannot constitutionally block his followers in Twitter.Judge Naomi Reice Buchwald of the US district court in the Southern District of New York ruled that public officials may not block a person from his Twitter account based on the that person's political views — and Trump's position as President had no bearing on the case.The case was brought by Columbia University's Knight First Amendment Institute and filed against President Trump, former White House communications director Hope Hicks, press secretary Sarah Huckabee Sanders and social media director Dan Scavino.More on this as it develops. 677

A man is being charged with assault after fighting with an IHOP manager last week after the manager asked the party to leave a IHOP in Memphis, WREG-TV reported. According to WREG, the IHOP manager asked Malachi O'Kelley's party of five to leave for being loud. A video of the incident shows most of the party leaving when O'Kelley allegedly attacked the manager. One of the members of the party threw a chair at the manager during the scuffle. Other members of the party also threw plates at IHOP employee. The manager responded by throwing a chair at one of the members of the party.WREG reported the manager received multiple stitches to the back of his head, above the eye and near the eyebrow. No other people have been charged in connection to last week's incident. The manager is reportedly back to work, and is looking at increasing security at the restaurant.  Note: Viewers may find video of incident disturbing 984

A COVID-19 vaccine candidate being produced by biotech company Moderna has shown to be 94.5% effective in Phase 3 clinical trials, the company said Monday.The news means that the company is on track to request Emergency Use Authorization status for the drug in the coming weeks. The vaccine is already being mass-produced and thousands of doses will be ready to ship following authorization.Moderna's vaccine is closely tied with "Operation Warp Speed," a Trump administration program that provided nearly billion in government funding for research and support, and placed the vaccine on an FDA fast-track.On Aug. 11, the Department of Health and Human Services announced it was paying .5 billion ".5 billion in funds to support the large-scale manufacturing and delivery" for 100 million doses of Moderna's vaccine candidate.Moderna said Monday that 20 million doses of its vaccine will be available to ship by the end of 2020, and is on track to produce between 500 million and 1 billion doses in 2021.Health experts believe that a vaccine will be available to some people by the end of 2020, and will be widely available in spring 2021. Though it's unclear who specifically will qualify to receive the drug first, doses will need to be rationed for several months before vaccines are widely available.The release comes a week after Pfizer announced its own vaccine candidate was also on track for mass distribution after showing 90% effectiveness in Phase 3 trials.Moderna's announcement comes as welcome news to the U.S., where COVID-19 is currently spreading at a rate unseen since the pandemic first hit. More than 1 million people have been diagnosed with the virus in the last week, and at least 100,000 people are confirmed to have contracted the virus each day for the last 13 days. 1808

A former University of Airzona athlete was the first witness today in the trial of a coach accused of choking her.Baillie Gibson was a shot put and discus thrower at Arizona. She says former track coach Craig Carter choked her and threatened to slash her with a box cutter when she tried to end a two-year sexual relationship.In opening statements, prosecutor Jonathan Mosher read the jury a series of texts between Gibson and Carter where he became more and more threatening as she said she planned to leave Tucson after graduating.She went to his office in McKale Center, the university's basketball arena and training center. That's where Carter allegedly choked her and threatened to slash her with a box cutter.Cater confessed to a University of Arizona Police officer. Carter's attorney, Dan Cooper, read the jury many of the same texts but said they show Carter's attack was the result of a momentary loss of control and was not the sort of deliberate attack required for a conviction.Prosecutors expect a short trial.The rest of their witness list only includes two police officers and a friend of Baillie Gibson. 1144

A father and son are accused of slaughtering a female black bear and her two cubs as they rested in their den in April.Andrew Renner, 41, and Owen Renner, 18, of Palmer, Alaska face several felony and misdemeanor charges related to illegal hunting. It is against the law to shoot a black bear with cubs in Alaska.Alaska Wildlife Troopers, which announced the charges on Monday, said the act was caught on a motion-activated camera set up inside the den to monitor the bears as part of a study being conducted by the US Forest Service and the Alaska Department of Fish and Game. The camera produced both video and audio of the encounter."In this case numerous crimes, including felonies, are believed to have been committed," trooper Col. Steve Smith said. Smith said the truck and boat used to transport the Renners to and from the bears' den have been seized.The father and son were out skiing together on April 14 when they approached the inhabited den, troopers said in a statement.The video captures Owen Renner firing two rounds at the adult bear inside her den, the troopers said. Andrew Renner then killed the "shrieking" newborn cubs and discarded their bodies outside the den, the statement said.Court documents obtained by CNN affiliate KTVA say that Andrew Renner is captured on video saying: "It doesn't matter. Bear down."The men also removed the adult bear's tracking collar."They'll never be able to link it to us," Owen Renner said, according to the court documents.Two days later, the men were captured on video returning to the den to pick up shells casings and dispose of the bear cubs, troopers said.Two weeks later, on April 30, Andrew Renner brought the adult bear's skin and tracking collar to officials at the Alaska Department of Fish and Game, saying that he realized after shooting it that it was a nursing bear and had not seen any cubs.The men have been charged with unlawfully taking a female bear with cubs, unlawfully taking a bear cub and possessing and transporting illegally taken game.
