Lawyers for CNN and the Trump administration are awaiting an initial ruling on the network's federal lawsuit over press access to the White House.And they're going to have to wait a little while longer.Judge Timothy J. Kelly heard nearly two hours of oral arguments about CNN's request for a temporary restraining order and preliminary injunction on Wednesday. Then he said court would reconvene Thursday at 3 p.m.But on Thursday afternoon, he rescheduled the next hearing for Friday at 10 a.m.If Kelly grants CNN's requests on Friday, CNN chief White House correspondent Jim Acosta would get his press pass back for a short period of time. If it's denied, Acosta's pass will remain suspended.Either way, this is just round one. By filing for a temporary restraining order, CNN is seeking what's known as "emergency relief." CNN is arguing that Acosta's First Amendment rights are being violated every day he is banned from White House grounds.CNN is also asking for "permanent relief," meaning a declaration from the judge that Trump's revocation of Acosta's press pass was unconstitutional. This legal conclusion could protect other reporters from retaliation by the administration.But the judge will not be ruling on that yet. Kelly is only expected to weigh in on the temporary status of Acosta's press pass.Further hearings are likely to take place in the next few weeks, according to CNN's lawyers.The lawsuit alleges violations of the First and Fifth Amendments.Kelly, a Trump appointee, has been on the federal bench just more than a year now. He was very inquisitive at Wednesday's hearing, asking tough questions of both sides, drilling particularly deep into some of CNN's arguments.A Justice Department lawyer, James Burnham, argued that the Trump White House has the legal right to kick out any reporter at any time for any reason.Burnham, who's been tasked with defending President Trump and several White House aides from CNN and Jim Acosta's lawsuit, was responding to a hypothetical from Kelly. Burnham said that it would be perfectly legal for the White House to revoke a journalist's press pass if it didn't agree with their reporting. "As a matter of law... yes," he said.Burnham's comment in court made the stakes of CNN v. Trump crystal clear.Attorney Theodore Boutrous, representing CNN in court, called Trump's move to revoke Acosta's hard pass "the definition of arbitrariness and capriciousness.""What are the standards?" Boutrous asked. "Rudeness is not a standard. If it were, no one could have gone to the press conference."Boutrous also commented that Trump is "the most aggressive, dare I say rude, person in the room" at press conferences.Burnham said CNN had made an "odd First Amendment injury" claim and suggested that Acosta could do his job "just as effectively" watching the president's appearances piped into a studio on CNN. In response, Boutrous said the DOJ had a "fundamental misconception of journalism." 2971

LINCOLN PARK (KGTV) - For the first time, a member of the drill team at Lincoln High School recalls the moments she was called the N-word at Friday night's football game in San Clemente. Lillian Mixon is a sophomore at Lincoln High School and she tells 10News, "A group of us were walking to the bathroom during halftime and a little boy asked me if I do flag or twirl, and I told him no, I dance, I do drill, and he responded with the N-word." Mixon says it happened again on her way back from the restroom, "I was confused and I was like did she say the N-word to me because this is a grown woman." Immediately, Mixon says, she told two security guards at the game about what happened, "I told the security guard that they were saying racial things to us and the guy looked at me and didn’t respond he just looked and turned away." Meanwhile, Orange County Sheriffs Department released a statement on social media that reads in part, "At the game an individual told deputies that the San Clemente Middle School students were on the visitor side being rowdy and obnoxious and deputies removed them from the area." They went on to say there was no mention of inappropriate language or hate speech. After the game, following normal protocal, Lincoln High athletes and coaches were escorted back to their buses. Mixon says when she got back to the bus she felt awful, "I felt awful after the game and I had to keep it together. After the game I told myself things like this happen but they never happen to me." Both school districts are continuing their investigation into the allegations. 1598

(KGTV) - One of the witnesses to Sunday's fatal drive-by shooting in La Jolla happened to be a trauma expert."I did see people at that point running all over the place," neighbor Michelle Carcel said. Steps from the crime scene, Carcel recounted what she saw hours prior. One woman was killed, and three men were shot on a sleepy street in La Jolla. San Diego Police said all victims were outside a house party on Draper Avenue when the shooting happened. RELATED: 1 dead in shooting at party in La Jolla"By 9 o'clock everything is shut down, so when we hear kids having a party and stuff, we often say it is a very nice thing. It is a quiet calm thing. So to have this occur is completely out of the ordinary," Carcel said. The scene was so foreign to neighbors in this area but all too familiar for Carcel. As a clinical psychologist, Dr. Carcel often deals with and speaks about gun violence and trauma. "I've talked about Parkland shooting. I've talked about the Orlando shooting. And to have it happen here, to have it happen here so close to home, is still so jarring and so rattling and really brings the message that it can happen anywhere," Dr. Carcel said. Carcel now wears both the witness hat and the clinical psychologist hat. She is giving advice to everyone involved. "This is going to have acute side effects," Dr. Carcel said. "You're going to have post-traumatic stress that could occur within a period of time. Just monitoring and making sure that they are getting the counseling and support that they need."She hopes for the end of senseless shootings, even if it means she may be out of a job. "Our children are dying," Dr. Carcel said. "Innocent people are dying, I don't know what the solution is, but I hope we come together as a community to figure it out."Dr. Carcel said she will conduct a trauma healing circle for her neighbors at a later time. 1900

  

LAS VEGAS, Nevada — In the era of the "Me Too" movement and against a backdrop of sexual misconduct in the school district, a YouTube video has some wondering whether a candidate for the Board of Trustees is sending the wrong message on social media. Her video is called "How to Be Sexy."It's been viewed more than a million times, but now it's getting serious scrutiny as the self-described non-traditional candidate is running for school board trustee. Watch the full interview with Danielle Ford in the video player at the end of this story."I initially searched for the videos because I started hearing other employees discussing it and saying they were kind of concerned," said Elena Rodriguez, CCSD Student Services Division. Elena Rodriguez has worked for the district for decades. She's an outspoken advocate for change and accountability and regularly attends and speaks at school board meetings."As difficult as it is for women to climb the ladder of administration and so forth, and the issues that we've had in the past with employees being accused of sexual harassment and discrimination and so forth, I think it sends the wrong message," Rodriguez said.Danielle Ford isn't shying away from her videos, but she does want to explain them. "As far as that particular video and the messaging of sexiness, I very much believe in empowering women to love their bodies and to be proud of who they are."Danielle dropped out of high school when she became pregnant at age 17 and got her G.E.D. She says this video and others posted on her Young Moms Club website are designed to reach out to other teen moms who face the same stigma and challenges she did when she was a CCSD student.Getting that message out is a serious effort for Ford. Drawing from her own personal experience she takes on the meaning of teen motherhood in the TedX talk from 2013."If we can offer support and encouragement to these girls rather than criticism and judgment, then we can all positively affect the lives of over 10 million people."Drawing from her marketing experience, Danielle says she has to be creative to ensure teen moms get her message. "And although I wouldn't use that same tagline and picture if I'm talking to different people, it worked!  Because that video itself has over a million views.  And it brought you here," Ford added.Danielle's message to feel confident and powerful at any age as a woman is strong. But the context of that video ("How to Be Sexy") is how to get and keep a man. Some are questioning if that's a good message to send to young girls. According to Ford, "Girls do want that! We all do! We all want a partner."Though she posted these videos years before knowing she'd run for public office, she stands behind them all. Including a video entitled "Why I Let My 10-Year-Old Daughter Date." But as you'll hear in the video below, that "date" was really just a family outing to Chuck E. Cheese.Ford said, "I feel like it's a really good thing to teach her now what a date is and how to be treated by boys."She also has a video on "How to Get a Boyfriend... It's Seriously Just Like Shopping.""When you watch the videos, the common theme is that we need to empower kids instead of criticizing them for having thoughts or whatever it is," Ford added.But Rodriguez says there's a better way to empower young women. "For example, towards education--higher education--technical schools. There are many other ways to empower women versus just talking about how you can be sexy."Long-time Trustee Carolyn Edwards, who's terming out of the spot Ford is running for, says trustees must live up to a higher standard and that includes social media.Regarding her "How to Be Sexy" video, Danielle told us, "I wouldn't make that video--based on what I've heard--again, but I'm also not going to take it down."In fact, she's got a link to her Young Moms Club videos on her candidate website. (KGTV) -- If you don’t believe cats actually get stuck in trees, just ask the Lakeside Fire Department.The cat somehow managed to climb a tall palm tree Sunday morning in Lakeside but wasn’t able to get back down. Fire crews used an engine and a 65-foot tall ladder to rescue the stranded pet. “This rare incident is an example of our firefighters out in the community doing what needs to be done,” the department said in a post on social media. 471
