SAN DIEGO (KGTV) -- A San Diego family is hoping to make their way home from Mexico on Thursday after having to ride out Hurricane Delta at the hotel where they were staying. Victor Lopez is a local restaurant owner of El Pollo Grill. Lopez's family traveled to Playa Del Carmen, Mexico last week. As Hurricane Delta was approaching, they booked a flight to leave the region, but their flight was canceled as they were heading to the airport. As the hurricane was approaching, the family was moved to a hotel ballroom where they spent the night as the hurricane passed. Lopez says there were no windows in the ballroom so they could only hear the heavy rain and strong winds. Lopez admits that the ballroom was crowded and there was some concern of COVID-19, but he said the hotel staff was disinfecting constantly and everyone was wearing masks. The hurricane did little damage to the resort in Playa Del Carmen, but just 45 minutes away in Cancun's hotel zone, debris and palm fronds were scattered all over the streets. Lopez and his family are hoping to return to San Diego on Thursday afternoon. Hurricane Delta is expected to make landfall in Louisiana on Friday afternoon. 1188

SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) -- A major crash on state Route 94 in San Diego’s Webster area sent several people to the hospital and caused traffic backups early Monday morning.According to California Highway Patrol, at around 12: 10 a.m., a black sedan traveling on southbound Euclid Avenue somehow veered off the roadway, went down an embankment and onto westbound SR-94.The crash caused a chain reaction of vehicles slamming into the back of the black sedan while the driver was trapped inside.To prevent the pile-up from getting worse, witnesses sprang into action using a light to wave down the traffic.When fire crews arrived, they had to use the jaws of life to remove the driver from her car. She was taken to a hospital with major injuries.Several other drivers were also transported to a hospital with minor injuries.CHP is investigating what caused the black car to lose control and crash. 895

SAN DIEGO (KGTV) — A Malayasian national faces voyeurism charges after a video camera was discovered in the bathroom of a San Diego flight last May.Choon Ping Lee was arrested this week and charged with video voyeurism within the special maritime and territorial jurisdiction of the United States, ABC-affiliate KTRK reported.Court documents revealed on May 5, a passenger on United Airlines flight 646 from San Diego to Houston discovered a blue light flashing in a first-class bathroom. The woman took the device to the flight crew, who in turn brought it to officials at George Bush International Airport.Security at the airport confirmed the device was a video recording device, KTRK reported. Officials reviewed the device's footage to discover it recorded a man installing it in the bathroom, documents say. Airport surveillance connected the man's clothing with footage of him boarding the plane on departure and leaving when it arrived in Texas.Investigators said they also found footage on the device from another flight, where at least two women were captured on camera aboard an Emirates flight.Lee also works for Halliburton, which provided FBI investigators with Lee's travel itinerary and footage of him wearing the same jewelry as seen in surveillance video as well, documents revealed.The company issued a statement to KTRK, reading: "Halliburton is aware of the situation and is cooperating with the FBI and U.S. Attorney's office in their investigation. SAN DIEGO (KGTV) -- A Montgomery High School student wearing a gorilla costume was hospitalized on Halloween after being hit by a golf cart in Otay Mesa West. According to San Diego Police, the student reportedly cracked an egg on the assistant principal's head before running across the street to a nearby park. Police say staff members at the school chased the student in a golf cart. During the chase, police say there was some sort of fight between the staff members and student before there was “some type of contact” between the student and golf cart. The student was taken to the hospital with unknown injuries.
