SAN MARCOS, Calif. (KGTV) - The San Diego County Sheriff’s Department is investigating a crash that sent a child to the hospital Monday. The accident happened about 2:30 p.m. at Woodland Parkway and Rock Springs Road. "Witnesses observed two 12 year old male Woodland Parkway Middle School students run westbound into a marked crosswalk against a solid red signal light and red crosswalk signal," deputies said.The 38-year-old male driver of a white Nissan could not avoid hitting the first boy, while the second narrowly avoided being struck, according to deputies. Check 10News Traffic"We have spoken with the parents, and the student is currently in fair condition, receiving medical care, and with his family," said Assistant Principal Jennifer Gutierrez in a statement sent to families. "Parents, please take this time to talk with your child about obeying traffic signals and wearing helmets when riding bikes or skateboards. Drivers are reminded to follow the 25 MPH speed limit when in proximity to the schools."The driver stopped at the scene. Alcohol and drugs were not factors in the crash. 1109

Seattle police have moved in to break up the Capitol Hill Occupied Protest (CHOP) after Mayor Jenny Durkan issued an executive order early Wednesday morning declaring the gathering illegal.According to the Seattle Times and KOMO-TV, about a dozen protesters were arrested Wednesday morning as police ordered those present to leave the area.Demonstrators have occupied the Capitol Hill neighborhood of Seattle for about three weeks. The protesters moved in earlier this month after police abandoned the department's East Precinct — which is located in the neighborhood — over fears of riots.While the occupation was largely peaceful for several weeks, the area has seen four shootings since June 20, some of them deadly.The protests began in the wake of the death of George Floyd, and were part of a nationwide protest movement against systemic racism and police brutality.Last month, CHOP leadership released a list of demands calling for the abolishment of the Seattle Police Department, a retrial for all people of color serving prison sentences for violent crime and the de-gentrification of the city, among other demands. 1138

SAN MARCOS, Calif. (KGTV) – A group of San Marcos neighbors say that a homeowner is terrorizing the community with threats and harassment, among other complaints. Neighbors are now banding together to sue him with the hope that he'll pack up and leave. Team 10 investigative reporter Jennifer Kastner discovered that federal agents also seized explosives and ammunition from his house, that he wasn't supposed to have. Homeowner Mark Brody, though, denies all allegations of wrongdoing."You don't have to get along with all your neighbors. You don't have to be friends with all your neighbors, but you also don't have to terrorize them," says neighbor Heidi Hafley.Brody’s home sits behind a prominent security camera and high fences. “[It’s] a fortress,” says James Pyer, one of twelve neighbors who are suing Brody, accusing him in the lawsuit of threats, stalking, trespassing, and so on."This has been a nightmare," adds Hafley. She and Pyer got a restraining order against Brody.Court records show that Brody denies harming the neighborhood, but 10News dug into public records.According to a search warrant from last year, state investigators believed that Brody may have been harboring several weapons, even though he'd been banned from having firearms or ammo because of the restraining order. Agents reportedly found and seized 30 pounds of an explosive called tannerite that had to be turned over to a bomb squad. Additionally, they found four ammunition magazines and two rounds of caliber ammunition.“At one point they put everything in the middle of the street and told us to stand back,” says Hafley.This past May, he pleaded guilty to illegally having ammunition. He was given probation and community service.10News confirmed with the San Marcos Sheriff's Station that deputies have been called out to Brody's home more than 30 times since 2014. One Sheriff's report reveals accusations from neighbors that Brody had been shining a flashlight from his truck into Hafley's bedroom. In another report, neighbors claim he yelled that she was a "[expletive]".“I'm the main target now because I push back and I let him know [that] I'm not going to tolerate this,” she tells us.In fact, Brody tried to get a restraining order against Hafley, but failed.The City of San Marcos confirmed with 10News that there have been a number of code compliance violations issued to Brody.A cease and desist order from the City to Brody includes a photo of an unauthorized traffic control sign that Brody allegedly installed. Neighbors say that he spray painted the street, put in a speed bump and put up notices meant to insult his neighbors. Hafley adds that the signs would state, "'Watch for the cows crossing,’ which he's referencing myself and my neighbor. He would [write], ‘The old bat,” which is my nextdoor neighbor [and he would write], ‘The troll,’ which is me."Brody would not do an interview with 10News. In a court response, he wrote that he categorically denies the allegations and claims to have never acted [violently] towards the neighbors."We don't go out of our houses anymore. Children don't play on the street," says Hafley.She and the eleven others on the new lawsuit against him just want him to move out so they can move on. “I don't want any other neighborhood to go through this," she adds.Each neighbor is asking for at least ,000 in damages. SANTEE, Calif. (KGTV) - After seven years of planning and more than a year of construction, Mast Park in Santee is almost ready to reopen.The new park features all modern technology and brand new amenities, but planners wanted to make sure it kept its original feel of being surrounded by nature."If you think of Santee's parks along the river as a string of pearls, this one was the oldest and needed some polishing," says Bill Maertz, the City of Santee's Director of Community Services."We've kept the feel of the natural park," he adds. "So we have a brand new park here, but we've got 100-year-old trees here."The park's new features include three picnic shelters, a larger parking lot with electric car charging stations, three larger dog parks, a nature discovery play area, a forest-themed playground, a new basketball court, and an enhanced disc golf course.There are also more than 100 new trees planted throughout the 80-acre park, as well as native and drought-resistant landscaping."A portion of the park is part of the San Diego River Trail. So we wanted to keep that natural experience along the river," says Maertz.Multiple public meetings also showed that the community wanted to help kids build a connection to nature through the park."Children have a nature deficit disorder, there's too much time with screens, TVs and stuff," says Maertz. "So, we're trying to get them reconnected back to nature."The park will also have an active storm-water drainage system that runs through it like a river. Water runoff from nearby apartment complexes and businesses will filter through the park, with natural elements helping to clean it and block debris and trash from entering the San Diego River. The city built 12 bridges in the park to let people walk over the runoff areas like they're walking through a forest."The only reason we have 12 bridges is that we didn't have room for 13," jokes Maertz.The park will also have new bathrooms and a concession stand. It will sell burgers, drinks, and also dog treats and toys.City leaders hope to have a grand opening in February."We already have an amazing park system, and this just adds the frosting on the cake," says Maertz.For full details of the project, click here. 2239

  

SAN FRANCISCO, Calif. – California has confirmed its first openly gay justice to the state’s supreme court.Martin J. Jenkins made history Tuesday as he was confirmed as Associate Justice of the Supreme Court of California. The appointment was approved by a unanimous vote in the supreme court courtroom in San Francisco.Justice Jenkins fills the vacancy created by the retirement of Justice Ming Chin on Aug. 31, according to a press release from the state’s judicial branch.Along with being the state’s first openly gay justice, he’s also only the third African American man ever to serve on the court.The judicial branch says Jenkins has held several prominent state and federal judicial positions throughout his career, with his most recent being the governor’s judicial appointments secretary.Prior to his role with the governor, Jenkins served as an associate justice on the First District Court of Appeal from 2008 to 2019. He was appointed by President Bill Clinton to the U.S. District Court for the Northern District of California in 1997 and served on that bench until 2008.Jenkins earned a Juris Doctor degree from the University of San Francisco School of Law. 1180
