SAN FRANCISCO (AP) — A U.S. judge on Monday blocked the Trump administration's policy of returning asylum seekers to Mexico as they wait for an immigration court to hear their cases but the order won't immediately go into effect.Judge Richard Seeborg in San Francisco granted a request by civil liberties groups to halt the practice while their lawsuit moves forward. He put the decision on hold until Friday to give U.S. officials the chance to appeal.The launch of the policy in January in San Diego at the nation's busiest border crossing marked an unprecedented change to the U.S. asylum system, government officials and asylum experts said. Families seeking asylum typically had been released in the U.S. with notices to appear in court.President Donald Trump's administration says the policy responds to a crisis at the southern border that has overwhelmed the ability of immigration officials to detain migrants. Growing numbers of families are fleeing poverty and gang violence in Guatemala, Honduras and El Salvador.The lawsuit on behalf of 11 asylum seekers from Central America and legal advocacy groups says the Trump administration is violating U.S. law by failing to adequately evaluate the dangers that migrants face in Mexico.It also accuses Homeland Security and immigration officials of depriving migrants of their right to apply for asylum by making it difficult or impossible for them to do so.Under the new policy, asylum seekers are not guaranteed interpreters or lawyers and don't get to argue to a judge that they face the potential of persecution or torture if they are sent back to Mexico, Judy Rabinovitz, an attorney for the American Civil Liberties Union, said at a March court hearing.Seeborg appeared skeptical of the lawsuit's argument that the administration misapplied a U.S. law that allows the return of immigrants to Mexico. The ACLU and other groups that are suing say that law does not apply to asylum seekers who cross the border illegally or arrive at a border crossing without proper documents.The judge also questioned the Justice Department's argument that asylum seekers sent back to Mexico are not eligible for certain protections, such as a hearing before an immigration judge.The administration hopes that making asylum seekers wait in Mexico will discourage weak claims and help reduce an immigration court backlog of more than 800,000 cases.Justice Department attorney Scott Stewart said there is a process to protect immigrants who could face harm in Mexico. SAN DIEGO, Calif. (KGTV) - A large San Diego Church is continuing to hold in person, indoor services despite orders from San Diego County to hold services in outdoor settings only. Awaken Church has gotten three cease and desist orders at different locations and also had an outbreak at one of those locations, according to San Diego County.County Supervisor Nathan Fletcher said the church is not cooperating with the county in regards to the outbreak at their Balboa location, so the county had to publicly announce the community outbreak and ask anyone impacted to quarantine. A church would have to prove that they were treated differently.“If religions are being treated in a nondiscriminatory fashion, in other words if there’s a general law that establishes how many people can be in a room or what are the conditions, and it happens to have an incidentally impact on religion, that’s not a special problem as long as government has a rational reason for doing that, that’s alright. It’s only when government discriminates against religion that a special level of review called strict scrutiny is required and government has to have a really really good reason for discrimination,” said Smith.He added that the makeup of a court will also impact any future decisions on religious freedom, saying when Justice Ruth Bader Ginsburg was alive, cases regarding religious freedom during the pandemic were found to not be discriminatory, however with the newly appointed Justice Barrett, it’s more likely the Supreme Court would rule in favor of a church. 3009

SAN DIEGO (KGTV)- Business owners across San Diego County were bracing for the possibility of shifting back into the most restrictive purple tier Tuesday.The county barely avoided the move and can stay in the red tier for now.“The up and down is very difficult to run any business without having any known information about what the future brings,” said Scott Lutwak, CEO of Fit Athletic Club, which has five locations in the county. “It’s been just a rollercoaster of open and close again.”If the county had to move back into the purple tier, gyms and fitness centers would have to go back to outdoor operations only.“It’s not easy to just move all the equipment that you had inside and move it into your parking lot and create a gym,” he said.Under the red tier, they can operate inside at 10 percent capacity. Lutwak said that’s still just not enough.“This number has been a very difficult number for our industry to digest because we simply cannot operate at 10 percent of our capacity.”Restaurants were also set to move back outside if we hit the purple tier. Under the red, they can offer indoor dining at 25 percent capacity.“There’s no clear path to 100 percent, there’s no plan to get us back open, and that’s really shocking to us,” said Angie Weber, co-owner of Cowboy Star Restaurant and Butcher Shop.She said her East Village business would not survive another shutdown.Weber said California’s color-coded tier system makes things more difficult for already struggling business owners, as they’re constantly worrying about what could happen next.“We need to fix this, we’re just going to be on this seesaw,” she said.While San Diego County teeters between the red and purple tiers with no orange or yellow in sight yet, both Lutwak and Weber hope county leaders and health officials can take back local control.“If we use the governor’s formula, our businesses are basically never going to be able to reopen,” said Lutwak. 1943

Cal Fire is urging residents not to let their guard down, but cautions, this is not the time to start clearing defensible space. "This week we really want people to tap the brakes on going out and clearing their property, we don't want them to start the next fire trying to do the right thing, the wrong way, at the wrong time, so please don't clear your property this week, focus on having an evacuation plan so you can get your family members, pets and livestock out when the need arises," said Captain Thomas Shoots, Public Information Officer for Cal Fire San Diego.RELATED: Check 10News Pinpoint Weather ConditionsFirefighters from San Diego, Chula Vista, Coronado, Imperial Beach, and Cal Fire are helping to fight the fires in Sonoma County and the Getty Fire in Los Angeles. Still, Shoots said there is no strain on local resources. "We know that a lot of times, this time of year, we'll have multiple major events happen at the same time, so we can send out plenty of resources and still be staffed up in San Diego so we are watching that very closely and we want to make sure that if anything takes off here we have plenty of resources to draw from," said Captain Shoots. Crews are able to monitor all the fire activity across the state from the command center at the Cal Fire Headquarters in Rancho San Diego. "Regionally, we're looking pretty good, we're fortunate that both fires that we had on Friday we were able to jump on it, put a ton of resources on it, and we were able to stop those before they became major incidents," said Captain Shoots. According to Shoots, this has been a mild fire season compared to last year. "We continue to see fires this year, but most people haven't heard about a lot of the fires that we've had because we've been able to keep them small. With Cal Fire, our goal is to keep 95% of the fires at 10 acres or less, and we've been fortunate with that this year because the conditions have been milder," said Shoots. Right now, Cal Fire crews are working seven-day shifts, instead of the standard three."We've been pretty lucky with the fire activity around the state has been pretty light. Most other years, we've been hit pretty hard, and we start to get worn down this time of year, but 2019 has been relatively good to us. San Diego (KGTV)- The San Diego Police Department will soon be adding 63 new officers on our streets. The department held the orientation for its 120th police academy this morning. This academy class is the largest class in over 25 years.“It’s very exciting,” says recruit Samantha Koegel. “I’m really excited to start this new journey of my life.”Koegel says her interest in the police force started began as a senior in high school after participating in a ride-along with an SDPD officer. Koegel graduated from Ramona High School. She received her degree from The University of Nevada- Reno, in Criminal Justice. All recruits went through an extensive screening process before being invited to the academy. “This is probably within 5 to 7 percent of all the applicants that we’ve gotten,” says Lt. Steve Waldheim. In the past, the San Diego Police Department has been understaffed. They currently have 1,800 officers but are budgeted for over 2,000. Lt. Waldheim says they the department needs more officers on the streets.“We need more officers in patrol so that they are out answering radio calls that can lower our response times.”The average salary for a San Diego Police recruit is ,000. After they become an officer, that number jumps to around ,000. “The salary now with SDPD, at the end of these pay raises that city council approved, we will be on par with the rest of the agencies around San Diego County,” says Lt.
