SAN DIEGO (CNS) - A man accused of opening fire inside a Poway synagogue, killing a woman and injuring three other people, pleaded not guilty today to more than 100 federal hate crime charges alleging he acted out of hatred toward the Jewish and Muslim communities.John T. Earnest, 19, is accused not only of the synagogue shooting but also of an earlier arson fire at an Escondido mosque. He is being charged by both federal and state prosecutors and faces a possible death sentence in both cases. Neither office has made a decision regarding whether they will pursue the death penalty.Earnest, of Rancho Penasquitos, is accused of carrying out the shooting at Chabad of Poway on April 27 -- the last day of Passover -- killing Lori Gilbert Kaye, 60, who was shot twice in the synagogue's foyer and died at a hospital.The congregation's rabbi, Yisroel Goldstein, 57, lost an index finger in the shooting. Two other people -- Almog Peretz, 34, and his 8-year-old niece, Noya Dahan -- were also injured.Earnest is also accused of setting a March 24 fire at an Escondido mosque -- a crime to which Earnest allegedly confessed in an online manifesto he posted prior to the synagogue shooting.Following his initial appearance Tuesday afternoon, he's slated to return to court May 28 for a preliminary hearing. He remains held without bail.He was charged last Thursday with 109 federal hate crimes: -- 54 counts of obstruction of free exercise of religious beliefs using a dangerous weapon, resulting in death, bodily injury and attempts to kill; -- 54 counts of hate crimes stemming from the synagogue shooting in violation of the Matthew Shepard and James Byrd Jr. Hate Crimes Prevention Act; and -- one count of damage to religious property by use of fire.Each of the 54 hate crime and obstruction of free exercise of religious beliefs counts apply to a person who was inside the synagogue during the shooting, Brewer said. Among those people, 12 of the congregants present were children, he said.Earnest is due back in federal court May 28.Earnest is also charged in state court with murder, attempted murder and arson. Bernardo Drive, less than two miles west of the synagogue, Deputy District Attorney Leonard Trinh said.Earnest got out of his vehicle with his hands up and was taken into custody without further incident, according to police.In the ``open letter'' that authorities say Earnest posted online shortly before the shooting, the author espouses flagrant anti-Semitic sentiments and a need to protect the ``European race.'' Pollack ruled both the project's proposed bond funding mechanism and an agreement of cooperation with the Plaza de Panama Committee to be legal, allowing the city to proceed with the plan to reduce traffic congestion in the park, according to the city attorney's office.San Diegans for Open Government argued that the city should have allowed voters to decide whether the city should rely on million in bonds to help fund the project.The City Council approved the project by a 7-1 vote in 2012, but six years of challenges and litigation stalled its implementation.The project will limit vehicle access and improve parking in order to restore the Plaza de California and Plaza de Panama as dedicated pedestrian areas."Balboa Park truly is the jewel of San Diego, and I am excited that the city can finally move forward with its plans to revitalize the Park for the enjoyment of San Diegans and tourists alike," City Attorney Mara W. SAN DIEGO (CNS) - A man smashed a display case at a Mira Mesa jewelry store and stole several necklaces, police said Tuesday.The theft was reported shortly after 6:50 p.m. Monday at Daniel's Jewelers in the shopping center near Mira Mesa Boulevard and Camino Ruiz, San Diego police Officer John Buttle said.A man entered the store and smashed a glass display case with a hammer, Buttle said, adding that the thief did not threaten the employee.The thief then grabbed several necklaces from the display case and fled in an unknown direction, the officer said.The suspect was described as a 5-foot-9 to 5-foot-10 Black man in his late 20s. SAN DIEGO (CNS) - Cleveland National Forest officials Saturday announced elevated fire restrictions until Jan. 1, 2021, and ordered the closure of Three Sisters & Cedar Creek Fall Trails after a heat advisory was issued by the National Weather Service.The trails will be closed until Sunday, officials said."These restrictions are put into effect to provide for emergency resource protection and public safety during hazardous fire conditions," a forest official said.The new restrictions include:No smoking, except within an enclosed vehicle or building, or within a developed recreation sites; No welding or operating an acetylene or other torch with an open flame;No target shooting, discharging a firearm, air rifle, or gas gun;No building, maintaining, attending, or using a fire, campfire, or charcoal fire except within a developed recreation sites;No wood or charcoal fires are allowed except in identified developed campgrounds and developed picnic areas within designated fire rings.The Cleveland National Forest encompasses 460,000 acres and is the southernmost U.S. National Forest in California.
