San Diego will seek to invalidate its landmark pension law, a citizens' initiative 65 percent of voters approved in 2012.The City Council voted 6-3 Monday to go to court to invalidate 2012's Proposition B, which switched most new hires from a pension to a 401(k) style plan. The decision came after multiple courts ruled the city skipped a key step in the campaign. The courts said then-Mayor Jerry Sanders' involvement meant the city needed to meet and confer with unions, but didn't. The courts required the city to make employees whole plus a seven percent penalty, but didn't invalidate the law. The city will now to go to court along side its employee associations to get it off the books. "It's illogical for the city to believe that having broken the law in order to get Prop B into the charter that you should be allowed to keep it in there," said attorney Ann Smith, representing the Municipal Employees Association. Firefighter John Hernandez II said he's seen a number of his colleagues leave for other departments, which offer better benefits - namely a pension."In my line of work, we can't work as long as most people, and that's why we need pensions," he said. But Councilman Scott Sherman, who voted to protect Prop B, said ultimately going back to pensions could cripple the city. "Every single year we make a 0 million minimum payment on our pension debt from the old system that too us to that point, and now they're asking us to go right back to that system," he said.Sherman said it's low unemployment, not a lack of benefits, leading to the city's worker retention issues. Former City Councilman Carl DeMaio, a major proponent of Prop B, said he would seek to defend the measure in court. 1722

SAN DIEGO, Calif. (KGTV) - Developers in San Diego are offering a new concept for families looking for homes: Multi-Generational Housing.The homes include a separate suite within a single structure. The suite has a bedroom, living area, bathroom and a small kitchen.Developers say the idea designed with let elderly relatives, adult children who move back home or relatives with special needs in mind."You’re still with the family, but you have that privacy to step away and still be independent," says Bill Ostrem, the San Diego Division President for Lennar Homes. "At the same time, if you want to engage with the family, the family wants to engage with you it’s right there."Lennar says they started developing these kinds of homes in 2011 in Arizona. They saw a need as more extended families began living together.The suites help with that.Currently, Lennar is building their "NextGen" homes in the Sterling Heights community near 4-S Ranch. Ostrem says it's become their most popular model.About 1/3 of all the homes they've sold in Sterling Heights have the extra suite. They have other developments with NextGen homes in 13 states."I think it just makes sense," says Austin Dias, a Co-Partner with The Phair Company. They're about to start construction on La Mesa Summit Estates just north of the 94 freeway near Lemon Grove. The overwhelming response they got was from families looking for these kinds of homes."We see this a lot in other countries," Dias says. "Now people in America are starting to embrace it."The homes are pricey. Models in Lennar's Sterling Heights development run between .7 and million. SAN DIEGO, CA — SAN DIEGO (KGTV) - The City of San Diego calls it the "Get It Done" App, but a Normal Heights man says he wants to know when work will get done."They block the sidewalk. They've ripped through my canopy. They've killed my two lemon trees," said Mike Scaglione as he stood in front of his home. He's referring to the damage caused by palm fronds that fall from two trees on city property he says are in serious need of maintenance. "It'll be seven years tomorrow that I've lived here and in that time frame I've probably picked up 3 or 4 hundred palm fronds."Scaglione said he's been trying for several months to get the city to keep up with the trimming of the two palms outside his home. "They say they're going to, or they direct me to somebody, but it just keeps going no where until it's a dead end." Scaglione says aside from the damaged to his property, he fears a potential for much worse. "Its kind of hard to see," he says, grabbing a palm frond from a pile collected near the trees, "but if you run your hand along here there's a pretty jagged toothed edge on here that if it was to land on somebody it could rip them pretty nicely."Scaglione has been using the city's Get It Done app. Past reports show crews have responded to clean up the fronds once they're on the ground. But when it came to a neighborhood tree trim last October he says, "They came through here and trimmed every tree on the block except mine." Scaglione said he asked the crews why. "They didn't have anything that could get up that high." Scaglione estimates the trees at 40 to 50 feet.In response to an inquiry by 10News, a city spokesperson sent an email explaining San Diego is on a two-year cycle for trimming city owned palm trees. Scaglione's block was on the schedule for October. But there's still more work to be done. So, does that mean the trees in front of Scaglione's home will be trimmed? "Yes," replied the spokesperson, "It is on the schedule." Though Mike feels like he's been here before."They would look into it when they were doing similar work in the neighborhood. San Diego City Council Tuesday night unanimously passed the location of a high-pressure underground pipeline to move sewage from San Diego's Morena treatment plant to a facility in Miramar. Residents say they're concerned the pipeline could break, wreaking havoc on the area. "Our concern is if that line was ruptured, bnecause it's under so miuch pressure, that it would spew raw sewage into the environment," said Ruth DeSantis, a longtime U.C. resident who heads the area's community foundation. DeSantis added that neighbors are concerned over traffic, noise, property values, and even smells seeping out of vents. There's a middle school, park, and hundreds of homes nearby. The city says it took various measures to minimize health and safety hazards, although some impacts like noise and traffic are unavoidable during construction.San Diego spokesman Jerry McCormick added that sewage geysers would not be possible under the pipeline system."Unlike a potable water system, where there are multiple loops to provide continuous pressure and in time of a rupture must be isolated by multiple valves, often times creating large releases of water, this system will not operate like that," McCormick said. "Instead, if there is a rupture, we can shut down the pumps and the flow will come to a very abrupt and quick stop."Community groups in University City are now teaming up with those in Clairemont to fight the project."We can put everything in Clairemont and Clairemont is sleeping, and I just wanted to say, that's not right," said Roseline Feral, of the nonprofit Clairemont Town Council. The city is aiming to have about a third of its water supply be reclaimed water by 2035. SAN DIEGO, California — One year ago, life forever changed for Navy EOD technician Kenton Stacy and his family.He was in a Syrian hospital clearing IEDs when one exploded, leaving him with a two percent chance of survival. His comrades fought to save his life and did, but Kenton was left paralyzed and unable to talk.He's now receiving care at the VA Medical Center in La Jolla.“We’re all ready for him to come home, it's just been hard juggling being here, being with the kids," said Lindsey Stacy, Kenton's wife.The couple has four children, one with special needs.As they work through Kenton's recovery, the family was hit with yet another unexpected hardship.They've been renting their Chesapeake, VA home for the last two years, not realizing tenants were destroying the house.The carpet and blinds were destroyed as well as much of the hardwood floors. The tenants also smoked cigarettes in the home."I just couldn't believe that people would destroy someone else’s property like that, shocking and it hurt,” said Lindsey.She shared what happened on their Facebook page #StacyStrong.It didn't take long for the community to step up and help make it right, with members of the EOD community spending hours to repair the house.Real estate agent Julie Fish, wife of an EOD tech, also stepped up to help.She's going to help sell the house without taking a commission and has enlisted help for labor and needed repairs. "The EOD community, they really have made it that they're taking care of it and it's one less thing I have to worry about," said Lindsey.
