SAN DIEGO (KGTV) — A San Diego-area man and his grandmother filed a federal lawsuit against two San Diego County Sheriff's Deputies.The lawsuit alleges deputies responded to the wrong address and pulled a then-17-year-old out of his apartment. "I've never experienced something like that," said Cesar Jaramillo.Jaramillo says last October he was watching TV on the couch when he heard a knock at the door. He says deputies asked if someone from the residence called 911.According to his lawsuit, "Cesar informed defendants the call was not from his residence. When defendants asked Cesar if there was a young black female in the apartment, Cesar said 'No,' and informed defendants that they were at the wrong apartment building. Cesar knew who defendants were referencing and knew they lived in the other building. Cesar informed the deputies over half-a-dozen times that defendants were at the wrong building."Jaramillo tells 10News he complied with everything the deputies asked but felt like they didn't believe him."That's when I started closing the wide door, that's when he just reached in and grabbed my hand," Jaramillo said.The lawsuit claims, "Without warrant or probable cause, both defendants unreasonably lured Cesar to unlock and open the door, then entered into Plaintiff's residence and forcibly pulled Cesar by the forearms into submission, leaving instant bruises on both arms."Jaramillo's grandmother was in the back of the house at the time and said she woke up to the commotion."I saw my grandson laying on the ground, in handcuffs and I went crazy, and I said, what is happening," said Teodora Villalobos.According to the lawsuit, "Due to unreasonable seizure and force used on her grandson Cesar, as well as defendants' indifferent attitude, Teodora began having heart complications on scene."Jaramillo's lawsuit alleges negligence, battery, and unreasonable search and seizure, among other things.10News reached out to the San Diego County Sheriff's Department for comment, but a spokesperson they can't comment on pending litigation. 2066
SAN DIEGO (KGTV) -- A second person has died and three children remain hospitalized after a fire tore through a Logan Heights home Sunday morning. The family’s oldest son told 10News his mother and father, who he identified as Nicolasa Mayo and Jose Romero, were killed in the fire. His two younger sisters and brother remain in the hospital following the blaze. The 26-year-old says he awoke Sunday morning to find his bed on fire. The man tells 10News he tried yelling at his family to get out of the home. "My dogs were jumping on me, trying to wake me up. I woke up. When I woke up, my bed was on fire. I jumped out of bed and started screaming the house is on fire," said Wilber Romero.The fire started around 4:30 Sunday morning on the 3100 block of Clay Street. "The minute I stepped out of my restroom, my house on the inside felt warm, like really warm. The curtain was open and I looked across the neighbors house was just bursting in flames," said Maria Orona, who lives nearby. According to the San Diego Fire-Rescue Department, firefighters had to go inside the home to pull many of the victims out. One witness who was nearby when the fire started told 10News he could see one of the victims reaching through bars in the windows, unable to escape.At least three fire engines and dozens of firefighters responded to the blaze.At this time, it’s unclear what sparked the fire, but the metro arson strike team was called to the home to investigate.A GoFundMe has been set up for the family to help cover funeral expenses. 1541

SAN DIEGO (KGTV) -- An arraignment was postponed Wednesday for the woman police say stole a car with two children inside before trying to cross the border into Mexico. According to police, Leslie Saenz has a criminal history of theft but nothing like what she’s accused of doing Monday.Officers say she jumped into a car outside a Lincoln Park store after the children’s father went inside.RELATED: Police: Woman arrested after stealing car with kids inside, trying to cross border into Mexico?9-year-old Malaia Cole and her 3-year-old brother were in the car at the time of the incident.Malaia was able to call police and tell them where the three were located.Border Patrol agents stopped the car just north of the border crossing. 746
SAN DIEGO (KGTV) — A third Marine has reportedly tested positive for coronavirus at MCAS Miramar.The Marine is currently quarantined at his home, MCAS Miramar officials told 10News.Navy medical staff is investigating anyone the Marine may have had contact with, as well.No further information on the base's third case was immediately released.Last week, a Marine tested positive for coronavirus after returning from leave in Washington state where he was visiting family. Then Saturday, the base confirmed a second Marine tested positive for the virus.Those two Marines are currently in isolation and quarantined in an empty barracks that was designated to treat potential cases of COVID-19.MCAS Miramar is currently a quarantine site for individuals evacuated from Wuhan last month and passengers aboard the Grand Princess cruise ship. Those quarantined passengers are being treated by Centers for Disease Control and Prevention staff.The two Marines who had contracted coronavirus last week did not have any contact with cruise passengers, according to the base. SAN DIEGO (KGTV) — A water hydrant break Friday flooded a stretch of Midway District road and swallowed a traffic signal.The break was reported on Midway Drive between Sports Arena Boulevard and Kemper Street, according to San Diego police. The stretch of road was closed fdue to flooding.There was no estimated time of restoration.The flooding in the area was so severe, a traffic signal sunk about halfway into the ground.San Diego Fire-Rescue crews were able to shut the water off shortly before 5:30 p.m. 516
