SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809

SAN DIEGO (KGTV) - The National Weather Service says that conditions are in place for a La Ni?a weather pattern in the fall and winter of 2020-21. That could bring warmer, drier than usual weather to San Diego over the next few months.By definition, La Ni?a happens when the water along the equator is colder than usual. That pushes the jet stream farther north and directs storms away from the Pacific Southwest region of the United States.Because of that, Southern California typically sees less rain during La Ni?a years."What that means for everyone is that our winters can be variable, meaning they can be all or nothing," explains National Weather Service Meteorologist Alex Tardy. "It doesn't necessarily result in more or less rain, though. You just have a very inconsistent winter in general with a La Ni?a pattern like we're seeing developed now."The numbers bear that out. According to the San Diego County Water Authority, San Diego averages 10.34 inches of rain every year, with most of it falling from December through February.But in La Ni?a years, the rainfall is usually below average. During La Ni?a in 2018, San Diego only saw 3.34 inches. A La Ni?a in 2017 brought 12.73 inches. La Ni?as in 2017 and 2012 got 8.18 and 7.90 inches of rain, respectively."The bulk of the historical cases have been somewhat below average," says Dan Cayan from the Scripps Institution of Oceanography. "It's 10 to maybe 30% below what we would normally achieve in those in those core winter months."That's bad news for firefighters across California. Already this year, the state has set records for wildfire disasters, with 7,982 wildfires burning more than 3.6 million acres. A dry, warm fall and winter will prolong wildfire season."That's not a real welcome signal for us here in Southern California, particularly after this extended dry period and heatwaves," says Cayan. "A wetter winter this next year would have been a welcome relief. But the roll of the statistical dice right now does not look like they're in our favor."Tardy puts it more bluntly."We are a tinderbox," he says. "We're looking at fuel moisture that is not just dry the way it should be, but it is record dry."La Ni?a weather also brings more Santa Ana winds, which can help wildfires spread. SAN DIEGO (KGTV) — The COVID-19 pandemic has been tough on kids, as they have been stuck at home for school and for play. However, a second-grader from the College Area is putting his time to good use. Seven-year-old Max Kelley came up with an idea to help feed those in need. Max and his younger sister Lucy were playing out in the backyard when he approached his mom with an idea of wanting to start a business."He wanted to do a water recycling business," says his mom Lauren. "So we went around collecting water bottles and cans. We went around to high schools, the bay, and the beach. Every week, we would return it to the recycling center, and we would get the money."And while some kids might take the money to buy something for themselves, Max wanted to do something completely different, and completely unselfish. His first thought was to think of others, and how the money might benefit somebody else."I realized that there are people in need," says Max. "And need food and water." His mother wasn't surprised at all, describing her son as very caring."He came up with the idea himself, and that was to donate the money to a local food bank," Lauren said.So the day before Thanksgiving, Max, Lucy, and the family donated their collection of 8.43 to the Special Delivery Food Bank in Mission Hills. "My family and the kids all got a standing ovation from all the patrons that were there," says Lauren.One check has been delivered, but Max is definitely not finished giving to those in need. SAN DIEGO (KGTV) — The County Board of Supervisors voted Tuesday to send a letter to Gov. Gavin Newsom requesting they be allowed to reopen the local economy.The board voted 4-1, with Supervisor Nathan Fletcher voting "no," to take further steps into reopening amid the coronavirus pandemic. The letter requests San Diego County be permitted to reopen gyms, hotels, nail salons, wineries and breweries, churches at full capacity, theme parks, youth sports, charter and fishing boats, community pools, and museums, Supervisor Jim Desmond tweeted.Following the vote, Desmond said in a statement that it will be up to Newsom, but that most of the board believes the county is ready.RELATED: Passive recreation activities now allowed at San Diego County beaches"Just now, the Board approved a plan telling the Governor we are ready to open for business.
