SAN DIEGO (AP) — An appeals court on Wednesday upheld a freeze on Pentagon money to build a border wall with Mexico, casting doubt on President Donald Trump's ability to make good on a signature campaign promise before the 2020 election.A divided three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco agreed with a lower court ruling that prevented the government from tapping Defense Department counterdrug money to build high-priority sections of wall in Arizona and New Mexico.The decision is a setback for Trump's ambitious plans. He ended a 35-day government shutdown in February after Congress gave him far less than he wanted. He then declared a national emergency that the White House said would free billions of dollars from the Pentagon.The case may still be considered, but the administration cannot build during the legal challenge.A freeze imposed by U.S. District Judge Haywood Gilliam Jr. of Oakland in May prevented work on two Pentagon-funded wall contracts — one spanning 46 miles (74 kilometers) in New Mexico and another covering 5 miles (8 kilometers) in Yuma, Arizona.While the order applied only to those first-in-line projects, Gilliam made clear that he felt the American Civil Liberties Union and other groups were likely to prevail at trial in their argument that the president was ignoring Congress' wishes by diverting Defense Department money."Congress's 'absolute' control over federal expenditures — even when that control may frustrate the desires of the Executive Branch regarding initiatives it views as important — is not a bug in our constitutional system. SAN DIEGO — SAN DIEGO (KGTV) -- A life science development firm has unveiled plans to transform eight acres along San Diego's waterfront into a mixed-use hub that could attract numerous leading edge companies to the city.Development firm IQHQ announced Monday that it closed on the site along Harbor Drive and will break ground on the project's first phase this week. The firm says it has entitlements and key permits for new office, lab and support retail space for the complex, called the San Diego Research and Development District, or RaDD. In a news release, the firm said this would be the largest urban commercial waterfront site along the Pacific Coast. The development is sure to bolster an already vibrant life sciences industry in San Diego, with biotechs clustered mostly in the Torrey Pines area. This could attract more to relocate downtown. The project would be the third major commercial development in downtown, along with the Padres plan to build office space at Tailgate Park, and the redevelopment of Horton Plaza into a tech hub."This is probably, in terms of the commercial sector, the most important pivotal moment in San Diego's modern redevelopment history," said Gary London, of commercial real estate consulting firm London Moeder Advisors.IQHQ chief executive Stephen Rosetta told ABC-10News this was the premier site to build on the west coast, if not the entire USA. "This project is really special to us because we're headquartered here in San Diego, and the partners live locally and have for most of our lives," he siad. Manchester Financial recently completed the new U.S. Navy Headquarters, on the north end of the site, with move-ins scheduled for October. Saguache County, Colorado is larger than the states of Delaware and Rhode Island combined.It is a valley surrounded by mountain peaks that draws people who are looking for the secluded lifestyle that rural America can offer.“Everybody knows everybody,” said Doug Peeples, who owns a grocery market in the county seat of Saguache.The town of Saguache is small, having never boasted more than 700 full-time residents in the last 30 years. The county is even more dispersed as the population density is less than two people per square mile.Then, in 2014, all of that changed once Colorado became the first state in the country to legalize recreational marijuana.“I would venture to guess we saw 2,000 to 3,000 people in overnight,” said Saguache County Sheriff Dan Warwick.“All of a sudden we had an influx of people that were out-of-towners,” added Peeples.Located in the southern part of Colorado, the county became a destination for people from neighboring states who wanted to use the weed recreationally, but particularly those who wanted to start grow operations before returning the product back to their home state-- something that is illegal.“With only six deputies, how do you try and catch these bad actors?” said Warwick. “You just hope to come across it.”The influx led to squalor and crime as sheds laid abandoned after people would use them for growing marijuana before skipping town once they harvested.“You’d see people come in and they would grow on a piece of property that they leased for a short period of time,” said Warwick. “They would leave all their trash and junk everywhere and then just pack up and leave.”It became a divisive issue in the county as full-time residents would be left to deal with the mess.“For a while, this place was the Wild Wild West,” said county commissioner Jason Anderson.Anderson, along with the rest of the county commissioners, worked to find a solution by passing an excise tax in 2016 that would give them 5 percent of the profits when legal growers would sell to retailers.In theory, the legislation would allow the county to benefit from something that had caused so much turbulence as the commissioners allocated money to go towards schools, enforcement, and other areas that needed improvement, but it started off slow.“The first year [of the tax] we only saw ,000, again, because the legal operations weren’t up and running yet,” said Anderson.Gradually, however, that tax money started to increase.
