INDIANAPOLIS, Indiana — A new effort is underway aimed at better protecting the health of Indiana children in the classroom.A recent WRTV television station found most schools do not test for radon, a lung cancer-causing gas that comes up through the soil, even though the EPA recommends schools test at least every five years.The federal EPA estimates one in five schools has a classroom with dangerous levels of radon.State lawmakers have already vowed to take action, including looking at possible legislation requiring schools test for the radioactive material or requiring new school buildings use radon-resistant materials.Now, environmental groups are getting involved in the movement as well as the Indiana State Department of Health.Following the WRTV investigation, the Sierra Club’s Hoosier Chapter passed a resolution supporting requirements for radon testing in daycares and schools in Indiana.The Hoosier Environmental Council also supports requirements.“Yes, I think Indiana should have testing requirements for schools,” said Dr. Indra Frank, environmental health director with the Hoosier Environmental Council. “It is estimated that 1 in 3 Indiana homes has elevated levels of radon that can be unhealthy.”The EPA map shows much of Central Indiana is in a hot zone for radon, meaning the gas is widespread throughout the soil and buildings in our state.Dr. Frank emphasized radon can be in new or old buildings, including homes and schools."Radon isn't going to discriminate about which type of building it seeps into," said Frank.Improving Kids’ Environment, a group that trains Indiana schools on air quality issues, is also concerned about radon."I think with schools if you don't hold their feet to the fire, because they have so many things that they are accountable for, they just let those things go," said Margaret Frericks, Program Manager with Improving Kids’ Environment.A dozen other states have laws or regulations in place regarding radon in schools, and Frericks says it’s time for Indiana.Frericks said many people overlook radon because children often do not get lung cancer, and there’s no signs or symptoms associated with radon exposure.“It should be done,” said Frericks. “Not knowing is not an excuse."As environmental groups get ready for the upcoming legislative session, WRTV is already getting results at the Indiana State Department of Health.After our story aired, ISDH added information about radon to the indoor air quality website for schools, and they’re now in the process of developing best practices regarding radon in the classroom.“ISDH is required to review the best practices documents every three years, but we make changes and updates as needed,” said Megan Wade-Taxter, a spokeswoman for ISDH. “Ensuring that schools have the most up-to-date information on how to best protect the health of students, faculty and all those who enter their buildings is important.”Environmental groups say it’s a step in the right direction, and that we all pay down the road for people who develop radon-induced lung cancer.“Preventing an unhealthy exposure is much less expensive than trying to cure a disease once it’s arisen,” said Frank. 3212

In yet another aggressive attempt to bypass federal appeals courts, the Trump administration asked the Supreme Court on Friday to hear a challenge to President Donald Trump's policy that bars most transgender individuals from military service.The policy, first announced by the President in July 2017 via Twitter and later officially released by Secretary of Defense James Mattis, blocks individuals who suffer from a condition known as gender dysphoria from serving with limited exceptions. It also specifies that individuals without the condition can serve but only if they do so according to the sex they were assigned at birth.District courts across the country have so far blocked the policy from going into effect. The 9th Circuit Court of Appeals heard arguments in one challenge earlier this fall and the DC Circuit will hear arguments in early December.On Friday, Solicitor General Noel Francisco filed petitions asking the justices to take up the issue in three separate cases that are still in lower courts so it could be decided definitively this term. Francisco argues that lower court rulings imposing nationwide injunctions are wrong and warrant immediate review.He writes because of the injunctions, "the military has been forced to maintain that prior policy for nearly a year" despite a determination by Mattis and a panel of experts that the "prior policy, adopted by (Defense Secretary Ash Carter), posed too great a risk to military effectiveness and lethality."House Democratic Leader Nancy Pelosi vowed to "fight this discriminatory action" in a statement Saturday."The President's ban is a cruel and arbitrary decision designed to humiliate transgender Americans who have stepped forward to serve our country," she added. "This bigoted ban weakens our military readiness and our country, and shows this president's stunning lack of loyalty to those who risk all to defend our freedoms."Earlier in the month, the Department of Justice warned the 9th Circuit Court of Appeals that it planned to ask for emergency relief to lift the nationwide injunction.The filing comes after Chief Justice John Roberts and Trump got into a public dispute about the independence of the judiciary this week. Roberts issued a rare statement on Wednesday criticizing the President for calling one lower court judge who ruled against him an "Obama judge." The President responded via Twitter criticizing Roberts and accusing the American judiciary of undermining national security.Under normal circumstances, the Supreme Court does not like to take up an issue before it has made its way through the lower courts. The justices like to have issues percolate below so that they can benefit from the opinions of lower court judges.Francisco has moved aggressively at times to get cases before a Supreme Court that is more solidly conservative with the addition of Justice Brett Kavanaugh.Francisco asked the justices to step in to review the lower court's decision in a case related to the addition of a citizenship question to the 2020 Census. It was just a few days before Thanksgiving, when an 8th grader was shot and killed in Milwaukee, Wisconsin.Sandra Parks was sitting in her room watching TV, when a stray bullet came through the window.“She said, ‘Mama, call the police. I been shot,’” Sandra’s mother, Bernice, describes of that night. “She was laying on the floor. I thought she was playing, but I called the police anyway because I’m like that’s too many gunshots, what the hell is going on?”The 13-year-old’s award-winning essay is now being shared around the world and read on national news outlets. In the young girl’s essay, “Our Truth,” Sandra wrote about gun violence.Sandra’s words are now some of the only things her mom says she has left of her daughter.“I don’t have her flesh. I don’t have her smiling at me all the time. I don’t have what I want, and I want my baby,” Bernice says. “Ain’t nothing gonna make that better. It’s just that being in this house, since she been gone, it’s strange, scary, and it’s unacceptable.”Bernice says her daughter’s words are giving her strength as she prepares for the funeral. The mother hopes Sandra’s essay might prevent another family from going through the same pain.“The stuff that she wrote, people should listen to it. Heed to it. Follow it, because it’s only right that kids should live. Adults should live,” she says. “I don’t think nobody should die, not by the hands of body else for no apparent reason. It's a frightening case of road rage that happened in broad daylight and spanned several communities.Now Police in Allen Park, Michigan are asking for the public's help in finding the man who was driving a black Nissan Altima with a damaged fender and out of state plates on the front and back of the vehicle. Detective Jim Thorburn with the Allen Park Police Department said the man chased another driver several miles and then unleashed at least eight rounds of gunfire at another driver in broad daylight on the southbound Southfield Fwy ramp to I-94. It all started with a fender bender around 3:30 p.m. on Sunday in Detroit, in the area of Chicago near Greenfield. The driver of a pick up truck tried to exchange information, he told police, when the black Nissan Altima driver pulled out a gun. That when he ran. "He was being chased by a Nissan Ultima and he had a big pick up truck and he thought by cutting through fields and stuff he would lose the Ultima," Thorburn said.But that didn't happen. The victim hopped on the Southfield Freeway southbound driving to the I-94 ramp, where the suspect who was still chasing him, opened fire. The victim was hit in the backside but was able to keep driving, he finally lost the shooter, pulled over in Taylor and called police. Police photos show the side of the pick up truck riddled with bullet holes. A big bullet hole in the head rest was a sign that the suspect was likely shooting to kill. The victim escaped with a superficial bullet wound to the backside. Today he said he is in pain, but recovering.  Police are hoping to find someone who might have seen the male suspect fire eight to nine gun shots through the passenger window of his black Nissan Ultima in broad daylight on the busy freeway. Inmates in Iowa's correctional system are suing the state to strike down a recently passed law that has banned pornography in prison, CNN affiliate KCCI reported. Iowa attempted to pass a similar law 30 years ago, but a federal judge struck the law down for being too vague. One expert told KCCI that the new law is more specific, and will likely withstand judicial review. "Prisoners generally have rights to access -- absent some incredibly dangerous person -- (including) reading materials," Drake University Constitutional Law Center Director Mark Kende. "And they have constitutional rights, even though they're in prison, the rights are diminished, but they have them."The law eliminates both viewing porn within individual jail cells, and in pornography reading rooms. Among the lawsuit, 58 inmates have joined the lawsuit, and are also asking the state to pay them ,000 each in damages.  931
